The term "dangerous houses" as mentioned in these Measures refers to houses whose structures have been seriously damaged or whose load-bearing members are in danger, which may lose structural stability and bearing capacity at any time and cannot guarantee the safety of living and use. Article 3 The management of urban dangerous houses shall follow the principles of overall planning of dangerous old buildings, giving priority to disaster relief and government leading. Article 4 The municipal real estate administrative department is the competent department in charge of the management of dangerous houses in our city.
Counties (districts, including Benxi High-tech Zone, the same below) are responsible for the early warning, hedging, emergency rescue, rescue and collection of dangerous houses in cities and towns within their respective jurisdictions.
Planning and construction, land and resources, development and reform, finance, public security, auditing, discipline inspection and supervision, comprehensive law enforcement and other departments shall, in accordance with their respective responsibilities, do a good job in the management of dangerous houses. Chapter II Appraisal Article 5 The house safety appraisal institution established by the municipal real estate administrative department shall be specifically responsible for the appraisal of the house risk level, and accept the professional guidance, supervision and management of the municipal real estate administrative department. Sixth housing safety appraisal, there must be more than two appraisers with corresponding professional and technical qualifications to participate in, for special and complex appraisal projects, the municipal housing safety appraisal institution shall entrust a housing quality inspection institution with corresponding qualifications for testing. Seventh houses in any of the following circumstances, the person in charge of housing repair or the owner or user of the house shall apply to the municipal real estate management department for housing safety appraisal:
Unsafe factors;
(2) It has reached the specified service life or the service life determined by the previous safety appraisal;
(3) The change of use endangers safety;
(four) the decoration of the house endangers the safety of the house.
If a house is found under any of the circumstances specified in the preceding paragraph, the relevant interested parties and the local government of the house shall report to the municipal real estate administrative department.
* * * The premises shall apply for safety appraisal once every five years from the date of completion acceptance. Eighth applications for housing safety appraisal shall submit the following materials:
(1) the identity certificate of the applicant;
(two) the housing ownership certificate or public housing lease certificate and other relevant legal documents;
(3) Where the application is entrusted to others, the power of attorney and the identity certificate of the client shall also be submitted.
If the applicant cannot provide the certification materials specified in Item (2) of the preceding paragraph, it shall be accepted after being recognized by the municipal real estate administrative department. Article 9 The municipal real estate administrative department shall, within 2 working days from the date of receiving the application for appraisal, entrust a housing safety appraisal institution to conduct appraisal, and the housing safety appraisal institution shall serve the Housing Safety Appraisal Report to the applicant within 5 working days from the date of accepting the application for appraisal. Tenth housing safety appraisal institutions shall conduct housing safety appraisal in accordance with the following procedures:
(1) Accepting the application;
(two) preliminary investigation, find out the history and present situation of the house;
(three) on-site investigation, detection and recording of all kinds of damaged data and conditions;
(4) Checking and sorting out technical data;
(five) comprehensive analysis, demonstration and qualitative analysis, make a comprehensive judgment, and put forward suggestions;
(6) issue an evaluation service report. Article 11 The appraisal of dangerous houses shall be carried out in accordance with the Appraisal Standard for Dangerous Houses (JJ125-2016) promulgated by the Ministry of Housing and Urban-Rural Development, with reference to relevant professional technical standards, norms and procedures.
Housing risk assessment is divided into grade A, grade B, grade C and grade D. ..
Grade A: there are no dangerous components, and the building structure can meet the requirements of safe use;
Grade B: individual structural members are assessed as dangerous members, but the safety of the main structure is not affected, which can basically meet the requirements for safe use;
Grade C: Some load-bearing structures can't meet the requirements of safe use, and the house is in a dangerous state locally, which constitutes a local dangerous house;
Grade D: The load-bearing structure can no longer meet the requirements of safe use, and the whole house is in a dangerous state, which constitutes a whole dangerous house. Article 12 The appraisal report issued by the house safety appraisal institution shall use uniform terminology, indicate the appraisal grade and handling opinions of house danger, and affix the special seal for house safety appraisal.
If it is identified as a non-dangerous house, the validity period of the house safety appraisal report is 1 year. Chapter III Governance and Expropriation Article 13 The municipal real estate administrative department shall prepare an emergency plan for the avoidance of dangerous houses and emergency rescue and disaster relief in Benxi City, and after it is approved by the Municipal People's Government, it shall be organized and implemented by the people's governments of counties (districts). Article 14 the municipal real estate administrative department shall conduct a safety survey on all kinds of houses in the city every year, and report the investigation to the Municipal People's government before September 30 of that year, and send a copy to the people's governments of counties (districts). Fifteenth people responsible for house repair should regularly check the safety of houses, and make preparations in advance in the rainy and snowy seasons.
