Provisions of Shandong Province on the Administration of Books and Newspapers Market
Article 1 These Provisions are formulated in accordance with the relevant provisions of the state and the Regulations of Shandong Province on the Administration of Cultural Markets for the purpose of strengthening the management of books and newspapers, prospering the books and newspapers market and promoting the construction of socialist spiritual civilization. Article 2 All the people, collective units and individuals who deal in books (including picture albums, picture albums, calendars, desk calendars, etc.) (hereinafter referred to as distribution units and individuals). ) and the distribution of newspapers in our province (including wholesale, retail and rental) shall abide by these provisions. Article 3 The administrative department of press and publication shall be responsible for the management of the book and newspaper market. Public security, industry and commerce administration, culture, postal services and other relevant departments shall, in accordance with their respective functions and duties, cooperate with the administrative department of press and publication to supervise and inspect the book and newspaper market according to law. Counties (cities, districts) without press and publication administrative departments should do a good job in the management of books and newspapers market according to the requirements of higher-level press and publication and cultural administrative departments.

Press and publication management personnel should hold the press and publication inspection certificate to supervise and inspect the book and newspaper market. "Press and publication inspection certificate" issued by the provincial administrative department of press and publication. Article 4 The publishing business of books, newspapers and periodicals shall go through the formalities of examination, approval and registration in accordance with the following provisions:

(a) units and individuals engaged in the retail business of books, newspapers and periodicals shall, with the consent of the competent department or the subdistrict office and the township (town) government, report to the county-level administrative department of books, newspapers and periodicals for examination and approval, and the municipal (prefectural) press and publication administrative department shall issue the retail license for books and newspapers.

(II) Units engaged in the wholesale business of books, newspapers and periodicals shall be approved by the administrative department of press and publication of the city (prefecture), submitted to the administrative department of press and publication of the province for approval, and issued the Wholesale License for Books, Newspapers and Periodicals. Provincial departments and central and foreign provinces and cities engaged in wholesale business in Shandong, directly to the provincial press and publication administrative departments for examination and approval and certification procedures.

(3) After receiving the Retail License of Books and Newspapers or the Wholesale License of Books and Newspapers, the issuing units and individuals shall apply to the local administrative department for industry and commerce for registration, and may start business only after being approved and issued a business license.

(4) When the card-issuing unit or individual changes its business mode or business scope, closes its business or changes jobs, it shall go through the registration of change or cancellation according to the business opening examination and approval procedures. Article 5 An entity engaged in the retail business of books, newspapers and periodicals shall meet the following conditions:

(1) Having managers who are familiar with books, newspapers and periodicals;

(2) Having a sound financial and operational management system;

(3) Having a fixed business place and storage facilities;

(4) Having registered capital suitable for the registered business projects. Article 6 An individual bookstore (stall) engaged in the retail business of books, newspapers and periodicals shall meet the following conditions:

(a) enterprise personnel are unemployed and retired employees with permanent residence;

(2) Having a fixed business place;

(3) Having funds above the prescribed amount;

(four) other conditions required by the state for individual industrial and commercial households in urban and rural areas. Article 7 A unit that engages in the wholesale business of books, newspapers and periodicals shall meet the following conditions in addition to those specified in Article 5 of these Provisions:

(a) there is a clear superior department in charge;

(2) It must be an economic entity with independent accounting, self-financing and legal personality;

(three) to start wholesale business, it must be a unit owned by the whole people with the right to distribute books, newspapers and periodicals; To start the secondary wholesale business, it must be a national and collective unit that operates the publishing business of books, newspapers and periodicals;

(4) Having been engaged in the retail business of books, newspapers and periodicals for more than half a year, and not violating the provisions of the state on the administration of the distribution of books, newspapers and periodicals. Eighth newspapers and periodicals, publishing houses outside the province to set up distribution units in our province, shall go through the approval formalities with the provincial administrative department of press and publication of the province (autonomous region or municipality directly under the central government). Article 9 Distribution units and individuals shall operate books published by publishing units approved by the state and newspapers and periodicals with unified domestic serial numbers. It is strictly prohibited to operate and sell the following books, newspapers and periodicals:

(a) reactionary content, serious political mistakes, obscenity, advocating feudal superstition and murder and violence;

(two) the cover and illustrations contain pornographic, lewd, murder, horror pictures or irritating and provocative words:

(3) illegally publishing or smuggling into the country;

(4) Books published by periodical agencies with serial numbers and publications published by publishing houses with serial numbers. Article 10 Books, newspapers and periodicals published by publishing units for internal distribution shall be sold internally in strict accordance with the provisions on internal distribution of books, newspapers and periodicals, and shall not be distributed to collective and individual bookstores (stalls), publicized and advertised in newspapers, radio and television, or publicly displayed on bookshelves and bookcases in retail outlets.

Non-profit commercial information books and teaching materials for internal use approved by non-publishing units must be used within the prescribed scope and may not enter the market for sale. Article 11 The business unit, individual or organizer shall report to the provincial press and publication administrative department for examination and approval in advance when operating books and newspapers published overseas and in Hong Kong, Macao and Taiwan, or holding exhibitions and exhibitions of books and newspapers published overseas and in Hong Kong, Macao and Taiwan. Article 12 Books for teaching and counseling in primary and secondary schools and textbooks for institutions of higher learning that are underwritten by the state shall be uniformly subscribed and distributed by Xinhua Bookstore.
