Article 1 In order to do a good job in the resettlement of demobilized military cadres, these rules are formulated in accordance with the Interim Measures for the Resettlement of Demobilized Military Cadres issued by the Central Committee, the State Council and the Central Military Commission, combined with the actual situation in our province.

Article 2 Demobilized military cadres mentioned in these Detailed Rules refer to officers and civilian cadres who have been discharged from active service and placed.

Article 3 Demobilized military cadres are an integral part of party and state cadres, an important human resource and an important force in socialist modernization. Demobilized military cadres have made sacrifices and contributions to national defense and army building and should be respected and supported by the whole society. It is an important system for the state and the army to transfer military cadres to local jobs. The resettlement of demobilized military cadres should combine planned distribution with independent employment. Party committees and governments are responsible for arranging jobs and posts for demobilized military cadres who plan to be assigned; Demobilized military cadres who choose their own jobs are helped by the government to find jobs and given retirement benefits.

Article 4 The resettlement of demobilized military cadres shall serve economic and social development and army building, and the principles of proper resettlement, rational use, giving full play to people's talents and giving them their proper places shall be implemented.

Fifth the resettlement of demobilized military cadres in the province is carried out under the leadership of the provincial party committee and the provincial government. Article 8 Units and individuals that have made outstanding contributions to the socialist modernization in our province and made remarkable achievements in the resettlement of demobilized military cadres shall be commended and rewarded.

Chapter II Handover and Receiving

Article 9 The files of demobilized military cadres and their families shall be handed over to our province by the military transfer department according to the plan issued by the state. The reception and review of archives shall be organized and implemented by the competent department of resettlement work of the provincial army.

Tenth demobilized military cadres who meet one of the following conditions shall be accepted and placed by our province: (1) those who are from Hebei Province or enlisted in the army; (2) The spouse has obtained a permanent residence in Hebei Province (the settlement time should be before the military cadres are approved to change jobs, the same below); Demobilized military cadres placed in the provincial capital, whose spouses have obtained permanent residence in Shijiazhuang for 2 years after joining the army; (3) The spouse's permanent residence was in Hebei Province before enlistment or at the time of marriage; (four) parents permanent residence in Hebei Province, no children around or I am unmarried; (five) the spouse is an only child, and the parents' permanent residence is now in Hebei Province; (6) One or both parents are soldiers and have worked in remote and hard areas for 10 years, and their origin, place of enlistment or place of discharge are in Hebei Province; (7) The spouses, parents, spouse's parents and children of demobilized military cadres who have worked in remote and hard areas or in flying or naval vessels for 10 years, won the third-class merit in wartime at ordinary times, were disabled by the war and chose their own jobs have 1 permanent residence in Hebei Province; (eight) both husband and wife are military cadres and transferred to other jobs at the same time, and one of the spouses who meet the requirements of the army is in Hebei Province or one of them is from Hebei Province; (nine) both husband and wife are military cadres, and one of them has changed jobs, and the one who stays in the team meets the requirements for the spouse to join the army and is stationed in Hebei Province; (ten) all kinds of talents urgently needed in our province, with the approval of the provincial department in charge of resettlement of demobilized military cadres, can receive resettlement.

Eleventh demobilized military cadres who hold posts below the regimental level shall not be included in the scope of receiving and resettling in our province under any of the following circumstances: (1) Those who have reached the age of 50; (2) Persons with disabilities above Grade A; (three) suffering from serious illness, confirmed by hospitals above the garrison hospital (frontier defense, fire fighting and armed police guards are designated hospitals), can not adhere to the normal work; (four) the review has not yet reached a conclusion or the probation period has not expired; (five) intentional crime is subject to criminal punishment; (6) Being expelled from the Party or disqualified as a cadre by reeducation through labor; (seven) other reasons should not be accepted.

Article 12 Military cadres who hold division posts (including bureau-level civilian cadres) or senior professional and technical positions, who are over 50 years of age, may receive resettlement due to the needs of local work, with the consent of the provincial party committee and the government, and with the approval of the national competent department for resettlement of demobilized military cadres, and shall be handled separately.

Chapter III Planning and Resettlement

Thirteenth military demobilized cadres resettlement plan by the office, institutions, personnel, staffing and other relevant departments. Article 18 Demobilized military cadres assigned according to the plan shall be assigned jobs according to their ability and political integrity and their ranks, contributions and specialties in the army. Demobilized military cadres placed in party and government organs below the battalion level shall go through the recruitment procedures for national civil servants (staff) in accordance with relevant regulations.

Article 19 Demobilized military cadres who are planned to be assigned to public institutions shall be assigned corresponding management or professional and technical posts according to their military ranks, and given an adaptation period of three years. Enterprises receiving demobilized military cadres, under the guidance of the plan, according to the voluntary distribution of demobilized military cadres themselves, enterprises arrange management or professional and technical posts, and give them a two-year adaptation period.

Twentieth encourage demobilized military cadres to voluntarily work in difficult areas and grassroots units. Demobilized military cadres assigned to the front-line work of township, social and economic construction shall be assigned corresponding leadership positions. Those who have both ability and political integrity can be promoted and used, and appropriate care should be given in terms of wages and benefits, family employment, and children's arrangements. Cities and counties may, according to local conditions, adopt some special policies and measures to encourage demobilized cadres to voluntarily work in non-public enterprises or establish economic entities.

Twenty-first demobilized military cadres who hold leadership positions at the division or regiment level and have served for a minimum period of time are generally assigned corresponding leadership positions. In areas where there are many demobilized military cadres at the division or regiment level and it is indeed difficult to arrange leadership positions, corresponding non-leadership positions can be arranged. Other demobilized military cadres who hold posts at the division, regiment or battalion level shall be reasonably arranged with reference to the above provisions. Demobilized military cadres who have worked continuously for five years in Tibet or other areas above 3,500 meters above sea level shall be assigned corresponding leadership positions or non-leadership positions. If it is indeed difficult for leading cadres to arrange their posts, they shall arrange deputies at the same level.

Article 22 All localities, departments and units shall, in accordance with the management authority of cadres, take measures such as making use of vacant leadership positions, increasing non-leadership positions according to regulations, and allocating posts, and arrange the work and responsibilities of demobilized military cadres at the division and regiment levels. Party and government organs at all levels have increased their administrative establishment according to the number of resettlement plans for demobilized military cadres of 15%. The increased establishment is mainly used for arranging division and regiment-level demobilized cadres. All localities, departments and units should make overall consideration of the arrangement of demobilized military cadres at the divisional level and the construction of local leading bodies, and plan to transport demobilized military cadres at the divisional level with both ability and political integrity to the leading bodies of cities, counties (cities) or institutions and large and medium-sized state-owned enterprises. Demobilized cadres who cannot arrange regimental leadership positions will not be resettled at the county level in principle.

Article 23. Demobilized military cadres who are placed in institutions and hold professional and technical posts, who are engaged in the same or similar professional and technical posts, can generally be employed in corresponding professional and technical posts according to their professional and technical posts in the army or their professional and technical qualifications recognized by the state and according to the structural proportion of their units. If the professional and technical positions are different from those of the original army, the corresponding professional and technical qualifications shall be re-evaluated. If necessary, you can arrange administrative duties. Demobilized military cadres who hold administrative posts and professional and technical posts may, according to the needs of local work and their own wishes, arrange corresponding administrative posts or appoint corresponding professional and technical posts. With the approval of the competent department of professional titles, the number of posts can be appropriately increased.

Article 24. Demobilized military cadres who have made outstanding achievements in urgent and dangerous tasks such as fighting floods, winning second-class merit, being disabled by war, serving in remote and hard areas, and working on flights and naval vessels for more than 10 years, in addition to giving preferential treatment according to the existing regulations, shall be given appropriate care in their work or work arrangements.

Article 25 When deploying demobilized military cadres, the Party committees and governments in the resettlement areas shall, in accordance with the division of labor, arrange cadres by the personnel department, teachers by the education department and workers by the labor and social security department, and make reasonable arrangements with reference to their job grades and occupations, and issue plans, receive resettlement and issue registration notices at the same time with demobilized military cadres. Transfer-in and transfer-out units increase or decrease the total wages accordingly.

Article 26 Labor and social security departments at all levels should effectively provide employment services for spouses and children of demobilized military cadres, actively coordinate with employers, and help spouses and children of demobilized military cadres who meet the employment conditions to achieve employment. Public welfare employment agencies shall provide free employment introduction and employment guidance for spouses and children of demobilized military cadres; Those who engage in self-employment or set up economic entities shall be given policy support, and taxes and fees shall be reduced or exempted in accordance with the relevant provisions of the state and resettlement places to promote employment.

Twenty-seventh demobilized military cadres' spouses and children who did not participate in the work can move with them, and the local public security department shall handle the relocation and settlement procedures in time with the notice of the competent department for resettlement of demobilized military cadres. Suiqian children need to transfer or enroll in school, and the education administrative department of the resettlement place shall be responsible for the arrangement before the start of the new semester by virtue of the household registration card or the settlement certificate of the competent department for resettlement of demobilized military cadres; When applying for various colleges and universities, priority will be given to admission under the same conditions as other candidates. Demobilized military cadres who have no children around them can be transferred to working children and their spouses. All localities shall not charge fees other than those stipulated by state policies when handling the work arrangement, settlement, transfer and enrollment of demobilized military cadres and their accompanying spouses and children.

Chapter IV Training

Twenty-eighth demobilized military cadres training is an important part of the resettlement of demobilized military cadres. Party committees, governments and relevant departments at all levels should incorporate the training of demobilized military cadres into the overall planning of cadre education and talent development, and give necessary guarantees in terms of policies and funds. The planning, organization, coordination, supervision and inspection of the training of demobilized military cadres shall be the responsibility of the competent department of resettlement of demobilized military cadres.

Article 29 The training of demobilized military cadres allocated according to the plan shall follow the principles of combining learning with application, teaching according to needs, paying attention to actual effect, and combining training, assessment and use, so as to enhance pertinence and effectiveness and improve training quality. Employment training for demobilized military cadres who choose their own jobs should adhere to the principle of individual voluntariness, on-demand training and relying on the help of society and government, and strengthen targeted vocational skills training in accordance with the standards of vocational qualification certificate or practice qualification certificate training. Set up professional courses reasonably to improve their employment competitiveness.

Thirtieth planned demobilized military cadres should organize no less than one week of adaptive training before resettlement; After the internship, according to the department or professional placement, centralized organization of professional training, the time is not less than 3 months.

Article 31 The training of demobilized military cadres who choose their own jobs mainly depends on the specific implementation of the training centers for demobilized military cadres at all levels, and local colleges and vocational training institutions may also be entrusted to undertake specific work.

Article 32 Demobilized military cadres with both ability and political integrity shall be selected in a planned way for academic education. Training funds shall be borne by individuals, receiving units and the competent department of resettlement of demobilized military cadres. Education administrative departments at all levels should support the training of demobilized military cadres. Demobilized military cadres who take the entrance examination for ordinary colleges and universities are given priority in admission under the same conditions as other candidates; Those who have won the second-class merit award can reduce their investment by 20 points under the school investment line, and they will be selected by the school.

Thirty-third demobilized military cadres resettlement departments should strengthen the management of demobilized military cadres training center. It is said that the income from social services provided by the training center for demobilized military cadres is used to subsidize the lack of training funds. Training centers and other training bases established in the name of demobilized training centers shall be owned by the competent department of demobilized military cadres, and shall not be sold, leased, misappropriated or misappropriated without the approval of the competent department of demobilized military cadres at a higher level.

Chapter V Treatment and Social Security

Thirty-fourth demobilized military cadres assigned according to the plan shall enjoy the political treatment of personnel in their units who are corresponding to or have the same conditions as their military posts.

Article 35 The salary and welfare benefits of demobilized military cadres who are planned to be assigned to party and government organs, organizations and institutions shall be determined according to the standards not lower than the corresponding or equivalent conditions of the receiving units and their military posts, and the allowances, subsidies, bonuses and other welfare benefits shall be implemented in accordance with relevant state regulations. Demobilized military cadres shall enjoy all the benefits of the on-the-job personnel in the receiving and resettlement unit during the professional training organized by the competent department for resettlement of demobilized military cadres.

Thirty-sixth demobilized military cadres who are planned to be assigned to party and government organs, organizations and institutions shall enjoy retirement benefits if their positions in their own units are equivalent or have the same conditions as the army at the time of demobilization. The provisions of this article do not apply to demobilized military cadres who have been demoted or above after arriving in the local area.

Article 37 The wages, allowances, subsidies, bonuses and other welfare benefits of demobilized military cadres planned to be distributed to enterprises shall be implemented in accordance with the relevant provisions of the state and the enterprises where they work. During the adaptation period, it shall not be lower than the wage standard stipulated by the state.

Article 38 For demobilized military cadres who are planned to be assigned to enterprises and institutions, they may sign employment contracts with the employing units with no fixed term or fixed term in accordance with relevant regulations, and the employing units shall not dissolve, dismiss or terminate the employment contracts in violation of the contract. Demobilized military cadres assigned to enterprises and institutions that implement contract system and appointment system shall be allocated with their spouses and given a two-year adaptation period. During the adaptation period, the employment contract shall not be dismissed, dissolved or terminated for reasons other than my own.

Thirty-ninth length of military service, a demobilized military cadre, is included in the continuous length of service (working years) of the receiving and resettlement unit and enjoys corresponding treatment. Fortieth demobilized military cadres who are awarded honorary titles by the Central Military Commission during their active service shall enjoy corresponding treatment according to the national model workers (advanced workers); Those who have been awarded the honorary title or won the first-class merit by units at the corps level, and who have been rated as national model demobilized military cadres after being transferred to civilian work, shall enjoy corresponding treatment by referring to provincial model workers (advanced workers); Those who have been rated as provincial model demobilized military cadres will enjoy corresponding treatment according to the municipal model workers (advanced workers) after being demobilized.

Article 41 The housing of demobilized military cadres shall be guaranteed by the local government in accordance with the principles of overall planning, priority arrangement, key guarantee and reasonable burden, and it shall be mainly solved by purchasing affordable housing, existing housing, leasing revolving housing and building self-owned housing. Demobilized military cadres who plan to be assigned to work in local units, the resettlement government or the receiving resettlement unit shall establish housing provident fund for them in accordance with relevant regulations. Spouses of demobilized military cadres have no housing subsidies, and the purchase of affordable housing exceeds the reasonable burden of families. Personal payment is indeed difficult, the resettlement government should give priority to providing housing provident fund loans. Specific measures for housing security for demobilized military cadres shall be implemented in accordance with relevant state regulations.

Article 42 length of military service, a demobilized military cadre, shall be deemed to have paid social insurance. Social insurance premiums such as medical care during their active service are transferred to the social insurance agency in the resettlement area. Demobilized military cadres and their spouses and children have participated in social insurance, and their social insurance relationship and personal account storage amount are transferred to the social insurance agency in the resettlement place according to the relevant provisions of the state and province, and continue to participate in social insurance. Article 43 demobilized military cadres who plan to be assigned to party and government organs, organizations and institutions shall participate in social insurance in the receiving and resettlement units in accordance with regulations, and enjoy social insurance benefits such as medical care, old-age care, unemployment, work-related injuries, maternity, etc. for personnel in the receiving units who are equivalent to or under the same conditions as their military posts; Demobilized military cadres who plan to be assigned to enterprises will be paid social insurance premiums by units and individuals according to regulations from the date of demobilization.

Forty-fourth administrative expenses, training fees, living allowances for demobilized military cadres, resettlement subsidies, housing subsidies during active service, etc., shall be guaranteed in accordance with the existing funding supply channels. The insufficient funds for the training of demobilized military cadres are partially subsidized by local finance. Resettlement business funds included in the fiscal budget, solved by the financial department at the same level, and gradually increase investment according to economic and social development.

Chapter VI Management of Demobilized Military Cadres Who Choose Their Own Jobs

Forty-fifth provinces and cities should set up management centers for demobilized military cadres to choose their own jobs, allocate funds and prepare for their careers. Accept the guidance of the resettlement department of demobilized military cadres.

Article 46 For demobilized military cadres who choose their own jobs, local governments should take measures such as providing policy advice, organizing employment training, broadening employment channels, recommending them to employers, and bringing them into the talent market to create conditions for their employment.

Article 47 Party and government organs, people's organizations, enterprises and institutions at all levels shall give priority to the employment of demobilized military cadres who choose their own jobs under the same conditions.

Forty-eighth retired military cadres who choose their own jobs should be adjusted and increased according to the adjustment of living expenses of retired military cadres who have been transferred to local resettlement. Retirement fees for demobilized military cadres who choose their own jobs are exempt from personal income tax. Demobilized military cadres who choose their own jobs are transferred to regular staff by party and government organs, people's organizations or institutions with financial allocations, and their retirement benefits are stopped. Wages and other welfare benefits shall be implemented in accordance with the provisions of Article 35 of these Rules.

Article 49 The establishment of social security and housing accumulation fund for demobilized military cadres who choose their own jobs, as well as funeral subsidies and pensions, shall be implemented in accordance with the relevant provisions of the Opinions on Several Issues Concerning the Resettlement Management of Demobilized Military Cadres who choose their own jobs ([200 1] No.8 of the State Council).

Chapter VII Management and Supervision

Article 50 The resettlement of demobilized military cadres shall be incorporated into the target management of party committees and governments at all levels, and the leadership responsibility system shall be implemented as an important content of assessing the achievements of leading bodies and leading cadres and an important condition for selecting model cities (counties) with double support.

Article 51 Party committees and governments at all levels should strengthen supervision and inspection of the resettlement of demobilized military cadres and resolutely stop and correct violations of laws, regulations and policies; For departments and units that refuse to accept demobilized military cadres or fail to complete the resettlement task, according to the opinions of the competent department of resettlement work, the relevant departments of organization, personnel and preparation shall suspend the transfer, employment and preparation of examination and approval personnel, and if necessary, expose them through the news media and informed criticism.

Fifty-second resettlement funds for demobilized military cadres shall be earmarked for special purposes, and shall not be misappropriated, withheld, deducted or misappropriated. Relevant functional departments shall supervise and inspect the use of resettlement funds.

Fifty-third demobilized military cadres to report to the local authorities, the original department is responsible for handling; Problems arising after reporting to the local government shall be handled by the resettlement government, and those involving the original troops shall be assisted by the original troops to deal with them. Anyone who practices fraud, whether reporting or not, will be returned to the original troops for handling.

Article 54 demobilized military cadres who have retired from active service and decided to be transferred to the reserve of officers shall register as reserve officers at the local people's armed forces department when reporting to the local receiving and resettlement units, and perform their duties and obligations as reserve officers.

Fifty-fifth resettlement work at all levels shall be open to the public, and shall be widely supervised by demobilized military cadres and society. Personnel engaged in the resettlement of demobilized military cadres at all levels and departments must resolutely implement the policies and regulations on the resettlement of demobilized military cadres, adhere to principles, be honest and perform their duties in strict accordance with the law, strive to improve their own quality, and serve demobilized military cadres wholeheartedly.

Fifty-sixth units and individuals that violate the provisions of these rules and have a serious impact on the resettlement of demobilized military cadres shall be criticized, educated or punished according to the seriousness of the case; If a crime is constituted, criminal responsibility shall be investigated according to law.

Chapter VIII Supplementary Provisions

Article 57 The resettlement of demobilized cadres of the Chinese People's Armed Police Force stationed in Hebei Province shall be implemented with reference to these Detailed Rules.

Article 58 These Rules shall come into force as of the date of promulgation, and shall be applicable to demobilized military cadres who have been resettled after 200 1.
