Provisions of Hainan Province on the Administration of Safe Production of Marine Fishing Vessels
Article 1 These Provisions are formulated in accordance with relevant laws and regulations and combined with the actual situation of this province in order to strengthen the management of safe production of marine fishing boats, safeguard the legitimate rights and interests of fishing boat owners and operators and the safety of fishermen's lives and property, and promote the development of fishery economy. Article 2 The people's governments at all levels in coastal cities and counties shall strengthen their leadership over the work of safe production of marine fishing vessels, implement the responsibility of safety supervision, take effective measures to ensure the safe production of marine fishing vessels, and implement the system of accountability for safety accidents of marine fishing vessels.

The owner or operator of a fishing boat is fully responsible for the safe production of the fishing boat, and the captain is directly responsible for the safety of the ship and its crew. Third provincial fishery administrative departments shall be responsible for the supervision and inspection of the safety production of marine fishing vessels in the province.

The fishery administrative departments of coastal cities and counties shall be responsible for the supervision and administration of the safe production of marine fishing vessels within their respective jurisdictions.

Relevant departments of production safety supervision, maritime affairs, public security and frontier defense, meteorology, etc. shall, according to their respective duties, do a good job in the production safety of marine fishing vessels according to law. Fourth people's governments at or above the county level shall commend and reward the units and individuals that have made outstanding achievements in the safe production of marine fishing vessels. Article 5 The manufacture, modification, purchase and import of marine fishing vessels shall apply to the relevant departments for inspection, registration and fishing license according to law. Article 6 Units engaged in the design, manufacture, renovation and transformation of fishing boats shall obtain qualifications according to law and obtain corresponding qualification certificates. Seventh fishing boats must meet the following conditions before they can sail and operate:

(1) Holding a fishing vessel inspection certificate, a fishing vessel registration certificate and a fishing license;

(two) in accordance with the provisions of the fire, life-saving, communications, navigation AIDS, meteorological information receiving equipment and other safety equipment, and keep it in good condition;

(three) the crew on duty holds the corresponding certificate of the crew on duty, and the ordinary crew holds the training certificate;

(4) The name, number and port of registry of the ship that meet the requirements;

(five) equipped with corresponding navigation books and charts and other materials;

(six) other conditions stipulated by laws, regulations and rules. Article 8 Fishing boats shall be equipped with radio communication equipment. Fishing boats with a non-steel ship15m, a steel ship12m or a main engine of more than 44. 1 kW shall be equipped with single sideband radios, radios and satellite navigation equipment. Fishing boats with the length of non-steel vessels less than15m, steel vessels less than12m and the main engine power less than 44. 1 kw shall be equipped with radio or other mobile communication equipment. Ninth fishery administrative departments at or above the county level shall, in accordance with the relevant standards and regulations, do a good job in the planning, construction and management of fishery radio stations in this area.

The township and village (neighborhood) committees that have set up fishery radio stations shall establish and improve the duty system, timely transmit information on fishing boat safety and meteorology, and provide services for the safe production of fishing boats. Article 10 The owner or operator of a fishing boat shall perform the following duties of fishery safety production:

(a) establish and improve the responsibility system for production safety;

(two) to organize the implementation of the relevant national safety rules and regulations and safety technology operating rules;

(three) to strengthen the management of production safety, timely eliminate hidden dangers of accidents;

(four) to educate the crew on safety and foreign-related laws and regulations;

(5) Organizing emergency rescue training and drills;

(six) timely and truthfully report the accidents and distress in production safety.

In the process of going to sea, the crew shall abide by the rules and regulations of fishery safety production and the operating rules of safety technology, obey the management, and wear and use the protective articles for fishery operations correctly.

The crew members have the right to put forward rectification opinions on the safety hazards of fishing boats, and may refuse to go aboard for operation before the safety hazards are eliminated. Article 11 The owner or operator of a fishing boat shall purchase personal injury insurance for fishermen who go out to sea.

People's governments at all levels may take subsidies and other measures to encourage fishing boat owners or operators to buy personal injury insurance and fishing boat property insurance for fishermen who go out to sea. Twelfth fishing boats at sea should implement the class (group) production system, and the same class (group) fishing boats have the responsibility of mutual assistance and rescue.

Fishing boats can organize fishing fleets (groups) according to the mode of operation and the sea area of operation, and the fishing fleets (groups) shall be organized and implemented by the village (neighborhood) committee according to the township.

Fishing boats owned by fishery production enterprises shall be organized by the enterprises themselves to help (group) go to sea for operation. Thirteenth fishing boats and gangs (groups) shall go to sea with gangs (groups), and fishing boats shall not leave gangs (groups) without authorization; If it is really necessary to take off the gang (group), it shall report to the captain of the gang (group) ship and the village (neighborhood) Committee to which it belongs.

Fishing boats of the same gang (group) should keep a distance of less than 5 nautical miles when sailing or working; If it exceeds 5 nautical miles, it shall report to the leader (group) and keep the communication unblocked. Fourteenth during the sea operation, the port (group) leader should keep in touch with his fishing station every day and report the fishing boat dynamics to the port (group) leader regularly; The fishing boats that violate the production regulations of the team (group) shall be ordered to make corrections, and the relevant departments may be suggested to punish the fishing boats that violate the regulations. Article 15 The navigation, operation and anchoring of fishing boats shall abide by the International Regulations for Preventing Collisions at Sea and the relevant national regulations on maritime traffic safety and avoidance of fishing operations.
