Is occupational discrimination illegal?
In China, illegal and discriminatory job advertisements are illegal. As job seekers, when encountering such advertisements, they should actively exercise the rights conferred by law and safeguard their legitimate rights and interests; As an employer, be careful not to include discriminatory clauses in job advertisements, or you will be punished by law.

First, the specific concept of employment discrimination

(1) Any distinction, exclusion or preference based on race, color, sex, religion, political opinion, national origin or social origin, which has the effect of nullifying or impairing equal opportunities or equal treatment in employment or occupation;

(2) After consulting with representative organizations of employers and workers-if such organizations exist-and other relevant institutions, the members concerned may determine other differences, exclusions or preferences, the effect of which is to cancel or impair equality of opportunity or treatment in employment or occupation.

Second, the classification of employment discrimination

Pay discrimination. Refers to employees who do the same job, some of whom get lower wages than others because of their non-economic personal characteristics.

(2) Employment discrimination. It means that under the same other conditions, even if some labor suppliers have better labor supply conditions, they are rejected by employers because of their non-economic characteristics, thus bearing an inappropriate proportion of unemployment.

(3) Occupational discrimination. It means that in the labor market, even if some workers are fully competent, they are restricted or prohibited from entering certain occupations or are pushed out to the lower positions of the same occupation because of their non-economic personal characteristics.
