Why can cultural relics be auctioned?

2. The cultural relics auctioned by auction companies cannot include cultural relics prohibited by the state, and not all cultural relics can be auctioned.

3. Relevant regulations:

(1) The Law on the Protection of Cultural Relics stipulates that:

Article 54 An auction enterprise established according to law shall obtain a license for auction of cultural relics issued by the cultural relics administrative department of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.

(2) The Interim Provisions on the Administration of Cultural Relics Auction stipulates that:

Twelfth the following cultural relics shall not be used as the auction target of cultural relics:

1 cultural relics unearthed in China that should be handed over to the state according to law;

Cultural relics that should be handed over to the administrative department of cultural relics according to law, including law enforcement departments at all levels throughout the country, are investigating and handling illegal crimes.

Cultural relics confiscated and recovered according to law during the activities;

Cultural relics selected by banks, smelters, paper mills and waste materials recycling units;

4 state-owned cultural relics collection units and other state organs, armed forces, state-owned enterprises and institutions to collect and keep.

Cultural relics;

5. Precious cultural relics collected by state-owned cultural relics purchase and sale business units;

6. Precious cultural relics in non-state-owned collections;

7. Cultural relics whose right of disposition is disputed by the owner;

Other cultural relics that are not allowed to circulate according to laws and regulations.
