County (city) and district health administrative departments shall be responsible for the prohibition of smoking in public places within their respective jurisdictions.
Organs, organizations, military units, schools, hospitals, enterprises, institutions, civil aviation, railways, transportation and other departments are respectively responsible for the implementation of smoking ban in public places of this system and this unit.
News, education, culture, environmental protection, public security and other departments shall, according to their respective responsibilities, assist the administrative department of health in publicity and education on the health hazards of smoking. Article 3 Smoking is prohibited in the following public places within the administrative area of this Municipality:
(a) the diagnosis and treatment area of medical institutions;
(2) Teaching areas, nurseries and kindergartens of the school;
(3) Offices and meeting rooms of organs at all levels, and meeting rooms of enterprises and institutions;
(4) Audience Hall, Video Hall, Recreation Hall, Song and Dance Hall and Music Teahouse of theaters;
(5) Audience hall and competition hall of sports venues;
(6) Museums, libraries, cultural centers, exhibition halls and reading rooms;
(7) Shops, bookstores and business premises in the post and telecommunications and financial systems;
(eight) in public transport and its waiting room;
(nine) other places where smoking is prohibited as determined by the municipal public health administrative department. Article 4 Units that prohibit smoking in public places shall do the following work:
(a) to formulate the smoking ban system in public places of this unit and organize its implementation;
(two) do a good job in the publicity of smoking ban in public places;
(3) Setting up conspicuous no-smoking signs in public places where smoking is prohibited;
(four) in places where smoking is prohibited, except for the sales counters, it is strictly forbidden to put tobacco and smoking utensils, and no signs and articles with tobacco advertisements are allowed;
(5) Smoking rooms or designated smoking areas may be set up in public places where smoking is prohibited;
(6) Advise smokers in public places where smoking is prohibited to stop smoking or leave the place. Article 5 Passive smokers in public places where smoking is prohibited shall enjoy the following rights:
(a) require smokers to smoke in designated smoking rooms (areas) or stop smoking;
(two) to require units that prohibit smoking in public places to implement these provisions;
(three) to report violations of these provisions to the administrative department of health. Article 6 Where a smoking-forbidden unit violates Article 4 of these Provisions, the health administrative department shall order it to make corrections within a time limit and may impose a warning or a fine of 1000 yuan. Article 7 Anyone who smokes in a public place where smoking is prohibited shall be fined 10 yuan by the administrative department of health or the person entrusted by it. Article 8 The decision and execution of administrative punishment shall be implemented in accordance with the provisions of the Administrative Punishment Law.
When performing official duties, administrative law enforcement officers should wear law enforcement signs and show the law enforcement certificates issued by the municipal government to the parties, otherwise, the parties have the right to refuse. Article 9 Whoever refuses or obstructs an administrative law enforcement officer from performing official duties according to law shall be dealt with by the public security department in accordance with the Regulations on Administrative Penalties for Public Security; If a crime is constituted, criminal responsibility shall be investigated according to law. Article 10 If a party refuses to accept the administrative punishment, he may apply for administrative reconsideration or bring an administrative lawsuit in accordance with the Regulations on Administrative Reconsideration and the Administrative Procedure Law. Eleventh administrative law enforcement personnel should abide by the law, enforce the law impartially, and give administrative sanctions to those who practice favoritism and seek bribes; If a crime is constituted, criminal responsibility shall be investigated according to law. Twelfth organs, organizations, military units, schools, hospitals, enterprises, institutions and other organizations, in addition to the scope delineated in Article 3 of these Provisions, determine the places where smoking is prohibited within their own units, and manage them with reference to Article 4 of these Provisions. Thirteenth these Provisions shall be interpreted by the Municipal Health Bureau. Article 14 These Provisions shall come into force on June 1996 65438+ 10/day.
