Regulations on the Administration of Publishing (revised in 2020)
Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Constitution for the purpose of strengthening the management of publishing activities, developing and prospering the publishing industry in Socialism with Chinese characteristics, guaranteeing citizens' right to freedom of publication according to law, and promoting the construction of socialist spiritual civilization and material civilization. Article 2 These Regulations shall apply to publishing activities in People's Republic of China (PRC).

The publication activities mentioned in these Regulations include publication, printing or reproduction, import and distribution of publications.

Publications mentioned in these Regulations refer to newspapers, periodicals, books, audio-visual products and electronic publications. Article 3 Publishing activities must adhere to the direction of serving the people and socialism, adhere to the guidance of Marxism–Leninism, Mao Zedong Thought, Deng Xiaoping Theory and Theory of Three Represents, implement Scientific Outlook on Development, disseminate and accumulate scientific, technological and cultural knowledge that is conducive to improving national quality, economic development and social progress, carry forward excellent national culture, promote international cultural exchanges, and enrich and improve people's spiritual life. Article 4 Publishing activities should give priority to social benefits and realize the combination of social benefits and economic benefits. Article 5 People's governments at all levels shall guarantee citizens' freedom of the press according to law.

When exercising the right to freedom of the press, citizens must abide by the Constitution and laws, and must not oppose the basic principles stipulated in the Constitution, nor harm the interests of the state, society and the collective or the legitimate freedoms and rights of other citizens. Article 6 The administrative department of publishing in the State Council shall be responsible for the supervision and administration of publishing activities throughout the country. Other relevant departments of the State Council are responsible for the supervision and management of publishing activities in accordance with the division of responsibilities stipulated by the State Council.

The local people's governments at or above the county level shall be responsible for the supervision and administration of publishing activities within their respective administrative areas. Other relevant departments of the local people's governments at or above the county level shall be responsible for the supervision and administration of relevant publishing activities within their respective functions and duties. Article 7 When investigating and dealing with suspected illegal activities such as publishing, printing or reproduction, import and distribution, the publishing administrative department may inspect articles and business premises related to suspected illegal activities. Based on the obtained evidence or report suspected of violating the law; Articles that are proved to be related to illegal activities may be sealed up or detained. Article 8 Social organizations in the publishing industry shall, in accordance with their articles of association and under the guidance of the publishing administrative department, implement self-discipline management. Chapter II Establishment and Management of Publishing Units Article 9 Newspapers, periodicals, books, audio-visual products and electronic publications shall be published by publishing units.

The publishing units mentioned in these Regulations include newspapers, periodical agencies, book publishing houses, audio-visual publishing houses and electronic publication publishing houses.

If a legal person has not established a newspaper or periodical agency to publish newspapers and periodicals, the newspaper editorial department and periodical editorial department established by it shall be regarded as publishing units. Article 10 The administrative department of publishing in the State Council shall formulate plans for the total number, structure and layout of publishing units throughout the country, and guide and coordinate the development of publishing industry and publishing undertakings. Article 11 The establishment of a publishing entity shall meet the following conditions:

(1) Having the name and articles of association of the publishing entity;

(two) there are organizers and their competent departments that meet the requirements of the administrative department of publishing in the State Council;

(3) Having a definite business scope;

(4) Having a registered capital of more than 300,000 yuan and a fixed workplace;

(5) Having an organization meeting the needs of its business scope and editing and publishing professionals meeting the qualifications prescribed by the state;

(6) Other conditions stipulated by laws and administrative regulations.

The examination and approval of the establishment of a publishing unit shall not only meet the conditions listed in the preceding paragraph, but also conform to the state's plan on the total number, structure and layout of publishing units. Article 12 To establish a publishing unit, the organizer shall apply to the publishing administrative department of the local people's government of the province, autonomous region or municipality directly under the Central Government; After the approval of the publishing administrative department of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government, it shall be reported to the publishing administrative department of the State Council for examination and approval. If the publishing unit established is a public institution, it shall also go through the formalities for examination and approval of institutional establishment. Article 13 An application for the establishment of a publishing entity shall include the following contents:

(1) The name and address of the publishing entity;

(2) The name, address and competent authority of the sponsor of the publishing entity;

(three) the name, address and qualification certificate of the legal representative or principal responsible person of the publishing unit;

(four) the source and amount of funds of the publishing unit.

Where a newspaper or periodical agency or newspaper editorial department or periodical editorial department is established, the application shall also specify the name, date of issue, format or format and printing place of the newspaper or periodical.

The application shall be accompanied by the articles of association of the publishing unit and the relevant certification materials for the establishment of the publishing unit by the organizer and its competent authorities. Article 14 The publishing administrative department of the State Council shall, within 60 days from the date of accepting the application for establishing a publishing entity, make a decision of approval or disapproval, and the publishing administrative department of the people's government of a province, autonomous region or municipality directly under the Central Government shall notify the organizer in writing; If it is not approved, it shall explain the reasons.
