Detailed Rules for the Implementation of the Regulations of Shanghai Municipality on the Administration of Books and Newspapers Market
Chapter I General Provisions Article 1 These Detailed Rules are formulated in accordance with the Regulations of Shanghai Municipality on the Administration of Books, Newspapers and Periodicals Market. Article 2 All units and individuals engaged in the wholesale, retail and rental of books, newspapers and periodicals within this Municipality must abide by these Provisions. Article 3 The Municipal Press and Publication Bureau is the competent department of this Municipality's book and newspaper market, and its book and newspaper market management office (hereinafter referred to as the Municipal Book and Newspaper Market Management Office) is specifically responsible for the management of this Municipality's book and newspaper market.

The book and newspaper market management departments of all districts and counties are responsible for the management of the book and newspaper market within their respective jurisdictions. Chapter II Operation and Management Article 4 Units that need to engage in the wholesale business of books and newspapers, as well as units and individuals engaged in the retail and rental business of books and newspapers in this Municipality must apply for the Shanghai Book and Newspaper Business License (hereinafter referred to as the License) in accordance with the procedures stipulated in the Regulations of Shanghai Municipality on the Administration of Books and Newspapers Market (hereinafter referred to as the Regulations) before starting business.

The license is reviewed once a year. Units and individuals that fail to review or fail to pass the examination within the time limit shall not continue to engage in the business of books, newspapers and periodicals. Article 5 If a publishing unit of books and newspapers in other provinces and cities needs to engage in the business of books and newspapers in this city, it must apply for a license from the book and newspaper market management department of this city according to the procedures stipulated in the Regulations with the approval documents of the local provincial press and publication management department or the State Press and Publication Administration and the business license issued by the local administration for industry and commerce, and then apply for a business license from the administrative department for industry and commerce in the place where this city operates. Article 6 An entity applying to engage in the retail and rental business of books and newspapers shall provide the following materials in addition to the conditions stipulated in Article 9 of the Regulations:

(a) the approval documents of the higher authorities;

(two) the qualification certificate of business training for employees;

(3) documents proving the effective use of the fixed business premises. Article 7 An individual applying to engage in the retail or rental business of books, newspapers and periodicals shall provide the following materials:

(1) Certificate of permanent residence in this Municipality;

(2) Certificate of graduation from junior high school or above;

(3) proof of unemployment;

(four) books, newspapers and periodicals business training qualification certificate;

(five) the effective use of the fixed business premises. Article 8 Units engaged in the wholesale business of books, newspapers and periodicals shall engage in relevant businesses in accordance with the provisions of the State and these Regulations.

Newspaper sales outlets affiliated to the post and telecommunications departments of this Municipality may engage in the wholesale business of domestic newspapers and periodicals in accordance with the relevant provisions and the business scope and methods approved by the license.

Wholesale books, newspapers and periodicals should issue invoices. The invoice shall indicate the title, number of copies, price and license number.

Wholesale units of books, newspapers and periodicals shall submit the Statistical Table of Shanghai Book and Newspaper Distribution Business to the relevant administrative departments in accordance with regulations. Article 9 Units or individuals engaged in the business of books, newspapers and periodicals shall engage in business in accordance with the business scope, methods and places approved by the license.

Units or individuals engaged in the business of books and newspapers may not purchase books and newspapers from unlicensed units or individuals, and may not sell books and newspapers to unlicensed units or individuals on a commission basis.

Units or individuals engaged in the business of books and newspapers must establish a purchase record system when purchasing books and newspapers, and the purchase vouchers shall be kept for at least half a year for verification. Tenth units or individuals engaged in books, newspapers and periodicals business shall apply to the Municipal Book Market Management Office, which shall make a decision on examination and approval within ten days from the date of receiving the application. Eleventh rental books and periodicals, must be approved by the district and county books and periodicals market management department and stamped with the seal of inspection, before renting. Article 12 Where a unit or individual engaged in the business of books and newspapers needs to hold an exhibition of books and newspapers in a place other than the business place approved by the license, the organizer shall go through the examination and approval procedures with the municipal book and newspaper market management office ten days before the exhibition starts, and file with the district or county book and newspaper market management department where the exhibition is located. At the same time, go to the public security and industrial and commercial administrative departments to handle the examination and approval procedures for commodity exhibition activities. Article 13 Except for newspapers and periodicals listed in the unified subscription catalogue of the municipal post and telecommunications departments, units or individuals engaged in books and periodicals business can purchase books and periodicals sold in this city directly from publishing houses or distribution units in other provinces and cities, and must report to the Municipal Book and Newspaper Market Management Office and submit the relevant publication and distribution certificates and samples of books and periodicals for sale in this city.

City book market management office should give a reply within two days after receiving the above certificates and books and newspapers samples. Fourteenth books, newspapers, advertisements, orders, shall not use propaganda reactionary, obscene, pornographic, murderous violence, feudal superstition and undermine national unity or other harmful content, and shall not make false propaganda.

Books, periodicals and informal publications issued internally shall not be advertised. Article 15 Books, newspapers and periodicals distributed within a publishing unit must be distributed within the prescribed scope by the publishing department of the unit or Xinhua Bookstore, and may not be wholesale to other business units or individuals of books, newspapers and periodicals.

Internal books and periodicals published by non-publishing units and approved by the Press and Publication Administration shall not be sold in the market.
