Article 1 In order to promote the economic and social development of ethnic autonomous areas, these Provisions are formulated in accordance with the Law of People's Republic of China (PRC) on Regional Ethnic Autonomy, Several Provisions of the State Council on Implementing the Law of People's Republic of China (PRC) on Regional Ethnic Autonomy, and combined with the actual situation in Sichuan.

Article 3 People's governments at all levels shall commend and reward units and individuals that have made outstanding contributions to the economic and social development of ethnic autonomous areas and the maintenance of national unity and social stability.

Article 4 People's governments at higher levels and their departments shall, when formulating and implementing economic and social development plans, formulate preferential policies and measures according to the characteristics and needs of ethnic autonomous areas to accelerate the development of economic and social undertakings in ethnic autonomous areas.

Article 5 People's governments at higher levels should fully consider the differences in public service costs in ethnic autonomous areas, and gradually increase financial transfer payments to ethnic autonomous areas through general financial transfer payments, special financial transfer payments, and transfer payments for ethnic preferential policies. When calculating the transfer payment, the part of tax reduced due to the introduction of tax relief policy by the people's government at a higher level should be considered.

When allocating special funds, the relevant departments of the people's governments at higher levels shall take care of ethnic autonomous areas.

Article 6 The municipal people's governments of provinces, autonomous prefectures, autonomous counties and autonomous counties shall set up special funds such as "Minority Development Fund", "Mobile Fund for Ethnic Work", "Ethnic Subsidies" and "Mixed Ethnic Development Fund", which will gradually increase with the economic development and fiscal revenue growth.

Article 7 People's governments at higher levels shall help ethnic autonomous areas improve their financial resources and financial security capabilities. People's governments at the provincial level do not participate in the tax sharing of value-added tax (local part), general business tax, personal income tax (local part), resource tax, property tax, stamp duty, urban land use tax, deed tax and other taxes in ethnic autonomous areas.

Enterprises engaged in the development and utilization of resources in ethnic autonomous areas shall be registered in the resource development areas, pay relevant taxes and fees locally, and accept the supervision and management of taxation, industry and commerce and other administrative departments. Except as otherwise provided by laws and regulations.

Local taxes paid by enterprises in ethnic autonomous areas in different places shall be returned to ethnic autonomous areas in accordance with the prescribed proportion, and the people's government where the enterprises are located shall support them.

For construction projects implemented across ethnic autonomous areas, ethnic autonomous areas shall share the local tax revenue of the project in accordance with the relevant provisions of the provincial people's government.

Article 8 Donations and preferential loans from international organizations and foreign governments arranged by the people's governments at higher levels are conditionally inclined to ethnic autonomous areas.

According to the needs of economic and social development, the people's governments at higher levels encourage and support the establishment of local commercial banks and urban and rural credit cooperative organizations in ethnic autonomous areas in accordance with relevant laws and regulations.

Article 9 People's governments at all levels shall organize and coordinate enterprises, scientific research institutions, medical and health institutions, schools and various social forces inside and outside the province, and carry out counterpart support and cooperation with ethnic autonomous areas.

People's governments at all levels shall take measures to promote employment in ethnic autonomous areas, train rural laborers in ethnic autonomous areas, organize employees in ethnic autonomous areas to go out for business, and effectively protect the legitimate rights and interests of business workers.

Article 10 The people's governments at higher levels shall formulate special policies and measures to support the production of ethnic trade, special articles for ethnic needs and traditional handicrafts, and support the development of foreign trade in ethnic autonomous areas.

Eleventh people's governments at higher levels should strengthen the construction of agricultural infrastructure in ethnic autonomous areas from the project and funds, speed up the construction of rural information service system, support farmers' scientific and technological training, and give priority to the promotion of new varieties and technologies.

Article 12 People's governments at higher levels shall help ethnic autonomous areas to formulate plans for ecological protection and animal husbandry development in pastoral areas, and increase investment in grassland ecological protection and construction, improvement of livestock and poultry varieties, prevention and control of epidemics, construction of forage base, circulation, processing and service system construction of livestock products.

Article 13 People's governments at higher levels shall help and guide ethnic autonomous areas to scientifically formulate regional plans, overall urban plans and protection plans for scenic spots, natural resources, intangible cultural heritage, cultural monuments and famous cultural cities (towns and villages), and give them financial, talent and technical support.

Fourteenth people's governments at higher levels should focus on supporting traffic construction projects in ethnic autonomous areas, strengthening rural highway construction and improving management level.

Highway fees collected in ethnic autonomous areas should be used exclusively for highway maintenance and construction in ethnic autonomous areas.

Fifteenth people's governments at higher levels shall give policy and financial support to the construction of postal infrastructure and communication infrastructure in ethnic autonomous areas.

Article 16 People's governments at higher levels should intensify poverty alleviation and development in ethnic autonomous areas, giving priority to poverty alleviation and development projects and funds.

Article 17 The people's governments at higher levels shall give great financial and technical support to ethnic autonomous areas in implementing projects such as replacing firewood with electricity, solar energy, biogas, geothermal energy and comprehensive utilization of wind energy.

Eighteenth people's governments at higher levels shall help ethnic autonomous areas to formulate emergency plans for public emergencies, establish corresponding emergency mechanisms, strengthen preventive and rescue measures, and give financial and technical support.

Article 19 People's governments at higher levels shall increase capital investment in land development, reclamation and consolidation and geological disaster prevention projects in ethnic autonomous areas, and strengthen the investigation, exploration and long-term investigation and evaluation of mineral resources in ethnic autonomous areas.

The compensation fee for mineral resources, the use fee for exploration and mining rights and the price of exploration and mining rights funded by the state formed in ethnic autonomous areas shall be used exclusively for the protection, exploration and development of mineral resources in ethnic autonomous areas in accordance with relevant state regulations and procedures, except for the part turned over to the state.

Twentieth people's governments at higher levels shall, in accordance with the relevant provisions of the state, increase ecological compensation and investment in major ecological balance and environmental protection comprehensive management projects and environmental protection infrastructure construction projects in ethnic autonomous areas.

Twenty-first people's governments at higher levels should focus on supporting the construction of forestry infrastructure, wildlife protection, nature reserve construction, forestry ecological construction and forest resources cultivation and development in ethnic autonomous areas.

The afforestation funds and forest vegetation restoration fees collected in ethnic autonomous areas shall be used exclusively for forestry development and forestry ecological environment construction in ethnic autonomous areas in accordance with relevant state regulations and procedures.

Twenty-second people's governments at higher levels shall give priority to the planning, project establishment and construction of energy construction projects such as water conservancy and hydropower in ethnic autonomous areas.

The water resources in the reservoir area formed by the construction of power stations and reservoirs in ethnic autonomous areas shall be given priority to development and utilization by ethnic autonomous areas on the premise of being conducive to the unified planning of ecological protection and project management units.

In ethnic autonomous areas, the water resources fees collected in accordance with the law for accessing groundwater and surface water and the water resources fees collected from hydropower facilities below 250,000 kilowatts are all used for the conservation, protection, conservation, planning management and development and utilization of water resources in ethnic autonomous areas, except for those turned over to the state.

Article 23 People's governments at higher levels shall help ethnic autonomous areas to protect and rationally develop and utilize natural and cultural tourism resources, strengthen the construction of tourism infrastructure in ethnic autonomous areas, guide and support the construction of scenic spots and their supporting facilities, and give support in terms of policies, funds and personnel training.

Twenty-fourth people's governments at higher levels shall help ethnic autonomous areas to formulate scientific and technological development plans and popularize scientific and technological knowledge; Increase the construction of scientific and technological infrastructure in ethnic autonomous areas and support the experimental demonstration and popularization and application of practical scientific and technological achievements.

Article 25 People's governments at higher levels should increase investment in education in ethnic autonomous areas, help ethnic autonomous areas to speed up the construction of educational informatization, vigorously develop vocational and technical education, strengthen the construction of teachers, encourage and attract all kinds of talents to enrich the teachers in ethnic autonomous areas by formulating preferential policies, and organize developed areas to support the development of education in ethnic autonomous areas.

Establish a long-term mechanism for the maintenance and renovation of rural primary and secondary schools, and the funds for the maintenance and renovation of rural primary and secondary schools in ethnic autonomous areas shall be borne by the provincial finance.

Article 26 The people's governments at higher levels shall bring compulsory education in ethnic autonomous areas into the scope of public finance, and the growth rate of investment in compulsory education in ethnic autonomous areas shall be higher than the average level of the whole province, giving priority to supporting compulsory education in poverty-stricken areas and areas inhabited by ethnic minorities, and implementing the policy of exempting students from tuition and miscellaneous fees. Textbook fees and living expenses for boarding students in compulsory education in ethnic autonomous areas in rural areas shall be subsidized, and special subsidies for minority education shall be arranged in accordance with relevant regulations.

Article 27 People's governments at higher levels shall support the construction of cultural infrastructure such as museums, libraries, cultural centers and cultural stations in ethnic autonomous areas in terms of funds and policies, and protect ethnic and folk ancient books, cultural relics and ethnic and folk traditional culture.

People's governments at all levels shall regularly organize ethnic cultural and artistic exchange activities, cultivate and develop ethnic cultural industries, and tap and train ethnic cultural and artistic talents.

Twenty-eighth people's governments at higher levels shall help ethnic autonomous areas to build sports infrastructure and carry out traditional sports activities of ethnic minorities; Pay attention to the excavation and arrangement of traditional sports of ethnic minorities and cultivate sports talents.

Article 29 People's governments at higher levels shall support and help ethnic autonomous areas to develop medical and health undertakings, increase capital investment and technical support for the construction of public health system in ethnic autonomous areas, and establish and improve rural health service system, new rural cooperative medical system and medical assistance system.

People's governments at all levels should increase investment in ethnic medicine, develop ethnic medicine industry in ethnic autonomous areas, and protect and scientifically develop ethnic medicine resources.

Article 30 People's governments at higher levels shall help ethnic autonomous areas to establish and improve family planning service networks, formulate preferential policies, encourage ethnic autonomous areas to implement family planning and prenatal and postnatal care, and give financial, technical and talent support to family planning technical service institutions.

Article 31 People's governments at higher levels shall give key support to the social security undertakings in ethnic autonomous areas, help ethnic autonomous areas to speed up the construction of social security systems, and establish and improve systems for providing for the aged, unemployment, medical care, work injury and maternity insurance, and the minimum living guarantee for urban and rural residents.

Thirty-second people's governments at higher levels and the leaders of their departments should be reasonably equipped with minority cadres; Ethnic autonomous areas and their working departments shall be equipped with leading cadres of ethnic groups and other ethnic groups that exercise regional autonomy according to law.

Article 33 When recruiting or employing national staff below the chief clerk or other equivalent positions, ethnic autonomous areas shall appropriately relax the conditions for local ethnic minority candidates in accordance with state regulations, and may set aside a certain proportion according to needs and take measures such as extra points to take care of local ethnic minority candidates. Specific measures shall be formulated by the competent department of recruitment and employment.

Thirty-fourth people's governments at higher levels shall guide ethnic autonomous areas to formulate talent development plans and take various measures to train all kinds of talents of ethnic minorities; In a planned way, select minority cadres from ethnic autonomous areas to exchange or post in economically developed areas; Organize and send all kinds of talents from economically developed areas to work in ethnic autonomous areas.

Ethnic autonomous areas take various measures to encourage and treat all kinds of professionals to participate in the construction of ethnic autonomous areas, and provide them with preferential and convenient working and living conditions.

Thirty-fifth people's governments at all levels are responsible for organizing the implementation of these provisions. The ethnic work departments of the people's governments at all levels shall be responsible for the supervision and inspection of the implementation of these Provisions, and report the supervision and inspection to the people's governments at the same level every year and put forward opinions and suggestions.

National autonomous areas shall use and manage the projects and funds funded by the state and the people's governments at higher levels in accordance with the provisions, and accept the supervision of the relevant departments at higher levels.

Article 36 Whoever, in violation of the state financial system and financial system, misappropriates, deducts or intercepts the funds used by the state finance and higher-level finance for ethnic autonomous areas shall be ordered to return the misappropriated, deducted or intercepted funds within a time limit, and the responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 37 Where the administrative departments of the people's governments at all levels violate the provisions of this Law and fail to perform their duties according to law, they shall be ordered to make corrections by the administrative organs at higher levels or the supervisory organs.

Staff of administrative organs at all levels who abuse their powers, neglect their duties or engage in malpractices for selfish ends in the implementation of these Provisions shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 38 The municipal people's government under the jurisdiction of the relevant departments of the provincial people's government, autonomous prefectures and autonomous counties shall formulate specific implementation measures in accordance with these Provisions and report the implementation to the provincial people's government.

Thirty-ninth counties (districts) approved by the provincial people's government to enjoy the treatment of ethnic minority areas shall be implemented with reference to these regulations.

Fortieth ethnic autonomous areas mentioned in these Provisions refer to autonomous prefectures and autonomous counties within the administrative area of Sichuan Province; The people's governments at higher levels mentioned in these Provisions refer to the local people's governments at higher levels in ethnic autonomous areas.

Article 41 These Provisions shall come into force on June 6+1October 6+1October 6, 2007.
