Article 1 In order to strengthen map management, safeguard national sovereignty, security and interests, promote the healthy development of geographic information industry, and serve economic construction, social development and people's lives, these Regulations are formulated in accordance with the Surveying and Mapping Law of People's Republic of China (PRC).
Article 2 The compilation, examination and publication of public maps, Internet map services and supervision and inspection activities within the territory of People's Republic of China (PRC) shall abide by these Regulations.
Article 3 Map work shall follow the principles of safeguarding national sovereignty, ensuring the safety of geographic information and facilitating people's lives.
The compilation, examination and publication of maps and Internet map services shall comply with the provisions of relevant laws and regulations on confidentiality.
Article 4 The administrative department of surveying and mapping geographic information in the State Council shall be responsible for the unified supervision and management of the national map work. Other relevant departments in the State Council are responsible for the related map work according to the division of responsibilities stipulated by the State Council.
The administrative department in charge of surveying and mapping geographic information of the local people's governments at or above the county level (hereinafter referred to as the administrative department of surveying and mapping geographic information) is responsible for the unified supervision and management of the map work within their respective administrative areas. Other relevant departments of the local people's governments at or above the county level shall be responsible for relevant map work in accordance with the division of responsibilities stipulated by the people's governments at the corresponding levels.
Article 5 People's governments at all levels, their relevant departments and the news media shall strengthen publicity and education on national territory and enhance citizens' awareness of national territory.
National territory consciousness education should be included in the teaching content of primary and secondary schools.
Citizens, legal persons and other organizations should use maps that correctly represent the territory of the country.
Article 6 The State encourages the compilation and publication of various map products that meet the standards and norms, supports the technological innovation and industrial development of geographic information, accelerates the structural adjustment, optimization and upgrading of geographic information industry, and promotes the in-depth application of geographic information.
The people's governments at or above the county level shall establish and improve the sharing mechanism of geographic information resources among government departments.
The administrative department of surveying and mapping geographic information of the people's government at or above the county level shall take effective measures to obtain, process and update basic geographic information data in time, and provide geographic information public services to the society through the geographic information public service platform to realize the opening and sharing of geographic information data.
Chapter II Map Compilation
Seventh units engaged in surveying and mapping activities shall obtain the corresponding surveying and mapping qualification certificate according to law, and carry out surveying and mapping work within the scope permitted by the qualification grade.
Article 8 The compilation of maps shall implement the relevant national map compilation standards and abide by the provisions of the state on the representation of map contents.
The following contents shall not be marked on the map:
Endangering national unity, sovereignty and territorial integrity;
(2) endangering national security and damaging national honor and interests;
(3) Belonging to state secrets;
(4) Affecting national unity and infringing on national customs and habits;
(5) Other contents that may not be expressed according to laws and regulations.
Article 9 When compiling a map, the latest map data should be selected and supplemented or updated in time to correctly reflect the geographical position, shape, name and relationship of each element, and the content should meet the purpose of map use.
The compilation of world maps and national maps involving the people of China and the border of China should fully represent the people of China and the territory of China.
Article 10 The following provisions shall be observed when drawing the borders of People's Republic of China (PRC), China and other countries on the map:
(1) The boundary of People's Republic of China (PRC) shall be drawn according to the standard map of the boundary of China;
(two) the historical boundary of China, according to the relevant historical data, the actual historical boundary shall prevail;
(3) The national boundaries between countries in the world shall be drawn with reference to the reference sample of Drawing Methods of National Borders in the World;
(4) Historical boundaries between countries in the world should be demarcated according to actual historical boundaries on the basis of relevant historical materials.
The standard sample map of China border map and the reference sample map of the world border map were drawn up by the Ministry of Foreign Affairs and the administrative department of Surveying and Mapping Geographic Information of the State Council, and published after being approved by the State Council.
Article 11 The drawing of administrative boundaries or ranges of China at or above the county level on the map shall conform to the standard map of administrative boundaries, the map of administrative regions of special administrative regions approved by the State Council and other relevant provisions of the state.
The standard map of administrative boundaries was drawn up by the civil affairs department of the State Council and the administrative department of surveying and mapping geographic information of the State Council, and was published after being approved by the State Council.
Twelfth important geographic information data on the map, should use the important geographic information data published according to law.
Thirteenth the use of surveying and mapping results involving state secrets shall be used by the administrative department of surveying and mapping geographic information of the State Council or the administrative department of surveying and mapping geographic information of the people's governments of provinces, autonomous regions and municipalities directly under the central government according to law.
Article 14 The administrative department of surveying and mapping geographic information of the people's government at or above the county level shall release public welfare maps to the society for free use.
The administrative department of Surveying and Mapping Geographic Information of the people's government at or above the county level shall timely organize and collect the changes of administrative divisions, place names, transportation, water system, vegetation, public facilities and residential areas related to the map content for the regular update of public welfare maps. Relevant departments and units shall provide relevant updated information in time.
Chapter III Map Audit
Article 15 The State implements a map review system.
Maps that are open to the public shall be submitted to the administrative department of surveying and mapping geographic information for examination and approval. Except for maps with simple contents such as scenic spots, blocks and subway routes.
Map review shall not be charged.
Sixteenth map publishing, submitted by the publishing unit; If a map that is not a publication is displayed or published, it shall be submitted to the exhibitor or publisher for review; Importers shall submit for inspection non-published maps or products with map graphics; The import of maps belonging to publications shall be implemented in accordance with the relevant provisions of the Regulations on the Administration of Publication; The export of maps of products that are not publications or attached with maps and graphics shall be submitted to the exporter; The production of products with maps and graphics shall be submitted to the producer for examination.
The following materials shall be submitted during the review:
(a) the map review application form;
(2) map samples or samples that need to be audited;
(3) Surveying and mapping qualification certificates of surveying and mapping units.
For importing non-publications and maps with map graphic products, only the materials specified in Items 1 and 2 of the preceding paragraph need to be submitted. The use of surveying and mapping results involving state secrets in the preparation of maps shall also be submitted to the security technology processing certificate.
Seventeenth the State Council Surveying and mapping geographic information administrative departments responsible for the audit of the following maps:
(1) National maps and maps mainly representing administrative regions of two or more provinces, autonomous regions and municipalities directly under the Central Government;
(2) Regional maps of Hong Kong Special Administrative Region, Macao Special Administrative Region and Taiwan Province Province;
(3) World maps and maps mainly representing foreign countries;
(4) Historical map.
Eighteenth provinces, autonomous regions and municipalities directly under the central government, the administrative department of Surveying and mapping geographic information is responsible for the examination and approval of maps mainly in their respective administrative areas. Among them, maps that are mainly displayed in the administrative area of a city divided into districts and do not involve national boundaries shall be examined by the administrative department of surveying and mapping geographic information of the municipal people's government divided into districts.
Nineteenth administrative departments of Surveying and mapping geographic information with the right to audit shall make an audit decision within 20 working days from the date of accepting the application for map audit.
If maps are attached to current political propaganda maps, books, newspapers and periodicals with high timeliness requirements, an audit decision shall be made within 7 working days from the date of accepting the application for map audit.
Emergency support and other special circumstances need to use the map, it should be immediately submitted for trial.
Twentieth maps involving professional content shall be audited in accordance with the audit basis formulated by the administrative department of Surveying and Mapping Geographic Information of the State Council in conjunction with relevant departments. There is no clear audit basis, the competent administrative department of Surveying and mapping geographic information with the right to audit shall solicit the opinions of relevant departments, and the relevant departments shall put forward their opinions within 20 working days from the date of receiving the materials for soliciting opinions. The time for soliciting opinions is not included in the time limit for map review.
World maps, historical maps, and current affairs propaganda maps are not clearly audited, and shall be audited by the administrative department of Surveying and Mapping Geographic Information of the State Council in consultation with the Ministry of Foreign Affairs.
Article 21 If the map submitted for examination meets the following requirements, the competent administrative department of surveying and mapping geographic information with the power of examination and approval shall issue a document of examination and approval of the map, and indicate the examination number:
(a) in line with the relevant national mapping standards, and fully represent the people of China and the national territory;
(2) National boundaries, boundaries, historical boundaries, administrative boundaries or ranges, important geographic information data, place names, etc. Comply with the provisions of the state on the representation of map content;
(three) does not contain the content that cannot be expressed on the map.
Map approval documents and map audit numbers shall be published in a timely manner on the website of the administrative department of surveying and mapping geographic information or other news media.
Twenty-second after examination and approval of the map, the approval number shall be marked in the appropriate position of the map or the product with map graphics. Among them, if it belongs to a publication, the design approval number shall be marked on the copyright page.
Twenty-third national primary and secondary school teaching map, by the administrative department of education in the State Council in conjunction with the administrative department of Surveying and mapping geographic information in the State Council, the Ministry of foreign affairs organization approval; The teaching maps of local primary and secondary schools shall be examined by the education administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government in conjunction with the administrative departments of surveying and mapping geographic information of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.
Article 24 No unit or individual may publish, display, publish, sell, import or export maps that do not meet the relevant national standards and regulations, and may not carry or mail maps that do not meet the relevant national standards and regulations into or out of the country.
When importing or exporting a map, a map approval document and a map audit number shall be submitted to the customs.
Twenty-fifth after the examination and approval of the map, the submitter shall, in accordance with the relevant provisions, send free samples to the competent administrative department of Surveying and mapping geographic information.
Chapter IV Map Publishing
Twenty-sixth people's governments at or above the county level shall strengthen the supervision and management of map publishing activities and investigate and deal with illegal acts of map publishing according to law.
Twenty-seventh publishing units engaged in map publishing activities, should have the map publishing business scope approved by the administrative department of the State Council, and go through the examination and approval procedures in accordance with the relevant provisions of the Regulations on the Administration of Publishing.
Twenty-eighth publishing units can insert approved maps into their publications as needed.
Twenty-ninth any publishing unit shall not publish the teaching map of primary and secondary schools without approval.
Thirtieth publishing units shall, in accordance with the relevant provisions of the state, send samples free of charge to the National Library, China Map Library and the State Council Publishing Administration Department.
Thirty-first map copyright protection, in accordance with the provisions of the relevant copyright laws and regulations.
Chapter V Internet Map Services
Article 32 The State encourages and supports Internet map service units to develop and utilize geographic information and provide value-added services.
The people's governments at or above the county level shall strengthen the policy support, supervision and management of the Internet map service industry.
Thirty-third Internet map service units to provide services to the public, such as geographic location, geographic information uploading and labeling, map database development, etc., shall obtain corresponding surveying and mapping qualification certificates according to law.
Internet map service units engaged in Internet map publishing activities shall be subject to the examination and approval of the publishing administrative department of the State Council according to law.
Thirty-fourth Internet map service units shall set up a server for storing map data in People's Republic of China (PRC), and formulate the security management system and safeguard measures for Internet map data.
The administrative departments of surveying and mapping geographic information of the people's governments at or above the county level shall, jointly with relevant departments, strengthen the supervision and management of Internet map data security.
Article 35 When collecting and using users' personal information, Internet map service units shall clearly indicate the purpose, method and scope of collecting and using information, and obtain users' consent.
Internet map service units that need to collect and use users' personal information shall openly collect and use the rules, and shall not disclose, tamper with, sell or illegally provide users' personal information to others.
Internet map service units shall take technical measures and other necessary measures to prevent users' personal information from being leaked or lost.
Article 36 Map databases and other databases used by Internet map service units to provide services shall not store or record contents that are not allowed to be expressed on maps according to relevant state regulations. If an Internet map service unit finds that the map information transmitted by its website contains contents that cannot be expressed, it shall immediately stop the transmission, keep relevant records, and report to the administrative department of surveying and mapping geographic information of the people's government at or above the county level, the administrative department of publishing, the administrative department of network security and informatization and other relevant departments.
Article 37 No unit or individual may upload or mark on the Internet the contents that are not allowed to be displayed on the map according to the relevant regulations of the state.
Article 38 Internet map service units shall use the maps examined and approved according to law, strengthen the verification and proofreading of the new contents of Internet maps, and file with the administrative departments of surveying and mapping geographic information in the State Council or provinces, autonomous regions and municipalities directly under the Central Government in accordance with the relevant provisions of the state.
Thirty-ninth Internet map service units shall keep confidential the information related to state secrets and commercial secrets obtained in their work.
Fortieth Internet map service units should strengthen industry self-discipline, promote the construction of industry credit system and improve service level.
Article 41 The provisions of this chapter shall apply to Internet map service activities; Where there are no provisions in this chapter, other relevant provisions of this Ordinance shall apply.
Chapter VI Supervision and Inspection
Forty-second people's governments at or above the county level and their relevant departments shall strengthen the supervision and inspection of map compilation, publication, display, publication, production, sales, import and export according to law.
Forty-third people's governments at or above the county level shall have the right to take the following measures when conducting supervision and inspection according to law:
(a) to enter the place suspected of illegal map behavior to carry out on-site inspection;
(2) consulting and copying relevant contracts, bills, account books and other materials;
(three) seizure, seizure of suspected illegal maps, products with map graphics, as well as equipment, tools, raw materials, etc. Used to achieve map violations.
Forty-fourth the State Council Surveying and mapping geographic information administrative departments and the State Council publishing administrative departments shall establish and improve the map supervision and management information system, realize the sharing of information resources, and facilitate public inquiries.
Forty-fifth people's governments at or above the county level shall, in accordance with the relevant national standards and technical specifications, strengthen the supervision and management of map quality.
Units that compile, publish, display, publish, produce, sell and import and export maps shall establish and improve the responsibility system for map quality and take effective measures to ensure the quality of maps.
Forty-sixth any unit or individual has the right to report illegal acts of maps.
The people's government or the relevant department that receives the report shall promptly investigate and deal with it according to law, and keep the informer confidential.
Chapter VII Legal Liability
Forty-seventh people's governments at or above the county level and their relevant departments in violation of the provisions of this Ordinance, one of the following acts, the competent department or the supervisory organ shall order it to make corrections; If the circumstances are serious, the directly responsible person in charge and other directly responsible personnel shall be punished according to law; If the behavior of the directly responsible person in charge and other directly responsible personnel constitutes a crime, criminal responsibility shall be investigated according to law:
(1) Failing to make an administrative licensing decision or handle the approval documents according to law;
(two) found illegal acts or received a report of illegal acts will not be investigated;
(three) other acts that do not perform their duties in accordance with the provisions of these regulations.
Forty-eighth in violation of the provisions of this Ordinance, without obtaining the qualification certificate of Surveying and mapping or beyond the scope of the qualification grade of Surveying and mapping, engaged in map compilation activities or Internet map service activities, shall be punished in accordance with the relevant provisions of the Surveying and Mapping Law of People's Republic of China (PRC).
Forty-ninth in violation of the provisions of this Ordinance, should be submitted for trial but not submitted for trial, shall be ordered to make corrections, given a warning, confiscate the illegal map or products with map graphics, and may be fined 6,543,800 yuan; Illegal income, confiscate the illegal income; If a crime is constituted, criminal responsibility shall be investigated according to law.
Fiftieth in violation of the provisions of this Ordinance, the map that does not need to be submitted for trial does not meet the relevant national standards and regulations, shall be ordered to make corrections, given a warning, confiscated illegal maps or products with map graphics, and may be fined 6,543,800 yuan; Illegal income, confiscate the illegal income; If the circumstances are serious, you can inform the society; If a crime is constituted, criminal responsibility shall be investigated according to law.
Article 51 Anyone who, in violation of the provisions of these Regulations, discloses a map that fails to meet the relevant national standards and regulations after examination and fails to make amendments according to the examination requirements shall be ordered to make corrections, given a warning, and the illegal map or products with map graphics shall be confiscated, and a fine of more than 6,543,800 yuan may be imposed; Illegal income, confiscate the illegal income; If the circumstances are serious, it shall be ordered to suspend business for rectification, lower the level of qualification or revoke the qualification certificate of surveying and mapping, and may notify the society; If a crime is constituted, criminal responsibility shall be investigated according to law.
Article 52 Whoever, in violation of the provisions of these Regulations, defrauds or forges application materials to obtain map approval documents, or forges or fraudulently uses map approval documents and map audit numbers, shall be ordered to stop the illegal act, given a warning, confiscate illegal maps and products with map graphics, and impose a fine of 654.38 million yuan to 200,000 yuan; Illegal income, confiscate the illegal income; If the circumstances are serious, it shall be ordered to suspend business for rectification, lower the level of qualification or revoke the qualification certificate of surveying and mapping; If a crime is constituted, criminal responsibility shall be investigated according to law.
Article 53 Whoever, in violation of the provisions of these Regulations, fails to mark the approval number in the appropriate position of the map, or fails to provide the sample map in accordance with the relevant provisions, shall be ordered to make corrections and given a warning; If the circumstances are serious,
