Provisions of Shanghai Municipality on the Administration of Books and Newspapers Market (1989)
Article 1 In order to strengthen the management of books, newspapers and periodicals market and promote the construction of socialist spiritual civilization, these Provisions are formulated in accordance with the relevant provisions of the state and the actual situation of this Municipality. Article 2 All units under ownership by the whole people, units under collective ownership and individual industrial and commercial households engaged in the distribution of books, newspapers and periodicals in this Municipality (including wholesale and retail, the same below) must abide by these provisions. Article 3 The Shanghai Municipal Press and Publication Bureau is responsible for organizing the implementation of these Provisions, and its affiliated Municipal Book and Newspaper Market Management Office (hereinafter referred to as the Municipal Book and Newspaper Management Office) is responsible for the specific management of the book and newspaper market.

The District and County Cultural Bureau is responsible for the management of the books and newspapers market in the district and county, and is led by the Municipal Press and Publication Bureau in business.

Industry and commerce administration, public security and price departments at all levels shall be responsible for the supervision and inspection of books, newspapers and periodicals markets within their respective administrative areas. Article 4 Books, newspapers and periodicals operated by units under ownership by the whole people, units under collective ownership and individual industrial and commercial households must be official publications published by publishing units approved by the state. It is strictly forbidden to sell reactionary, obscene, pornographic, horrible, feudal superstitious and other bad books, newspapers and other illegal publications. Article 5 The publishing business of books, newspapers and periodicals shall go through the formalities of examination, approval and registration in accordance with the following provisions:

(a) units under ownership by the whole people and units under collective ownership engaged in publishing books, newspapers and periodicals must apply to the district or county cultural bureau where they are located; After being examined by the District and County Cultural Bureau, approved by the Municipal Press and Publication Bureau, and issued with the Business License of Shanghai Books, Newspapers and Publishing Industry, the certificate shall go through the industrial and commercial registration formalities with the local and county administrative departments for industry and commerce and obtain the business license.

(two) individual industrial and commercial households engaged in the retail business of books, newspapers and periodicals shall apply to the district and county cultural bureau; After being examined and approved by the District/County Cultural Bureau, and being issued with the "Shanghai Book, Newspaper and Periodical Retail Business License", you can apply for a business license with this certificate to the district/county administrative department for industry and commerce.

(3) Mobile retailers engaged in books, newspapers and periodicals in units under ownership by the whole people or collective ownership must apply to the Municipal Press and Publication Bureau by their subordinate units, and can only carry out mobile retail business after being approved to issue the Shanghai Mobile Retailer Business License.

When the above-mentioned units and individual industrial and commercial households dealing in books, newspapers and periodicals close down, change jobs or change their mode of operation and scope of business, they must go through the formalities of closing down or changing registration according to the examination and approval procedures for opening. Article 6 An entity applying for the retail business of books, newspapers and periodicals shall meet the following conditions:

(1) Having managers who are familiar with books, newspapers and periodicals;

(2) Having a practical management system for books, newspapers and periodicals;

(3) It has a fixed business place (including sales offices and warehouses) and necessary business facilities;

(4) Having a registered capital of more than the prescribed amount. Article 7 An entity applying for the wholesale business of books, newspapers and periodicals shall meet the following conditions in addition to those specified in Article 6 of these Provisions:

(a) must be a publishing unit approved by the state or a unit specializing in the trade of bulk books, newspapers and periodicals;

(2) It must be an economic entity with independent accounting, self-financing, independent operation and legal personality;

(3) Having been engaged in the retail business of books, newspapers and periodicals for more than half a year, and taking publishing books, newspapers and periodicals as its main business. Article 8 Individual industrial and commercial households applying for the retail business of books, newspapers and periodicals shall meet the following conditions:

(a) unemployed, retired (divorced) personnel with permanent residence in cities and towns in this Municipality;

(2) Having a fixed business place;

(3) Having funds above the prescribed amount;

(four) other conditions required by the state and this Municipality for individual industrial and commercial households in urban and rural areas. Article 9 Any unit or individual that temporarily opens a shop by occupying roads must go through the examination and approval procedures in accordance with the Measures of Shanghai Municipality for the Administration of Temporary Occupation of Roads; Temporary shops in newly-built villages and lanes occupying roads must be approved by the township (town) people's government or street offices. Article 10 Units and individual industrial and commercial households engaged in the retail business of books, newspapers and periodicals must purchase goods from wholesale units of books, newspapers and periodicals with business licenses, and may not purchase goods from unlicensed vendors. Books and newspapers wholesale units shall not wholesale books and newspapers to units and individuals without business licenses. The business license shall not be lent, leased or copied.

Individual industrial and commercial households shall not engage in the wholesale business of books, newspapers and periodicals. Units under collective ownership shall not underwrite the general distribution of books, newspapers and periodicals to publishing units. Eleventh management of foreign countries and Hong Kong, Macao and Taiwan published books and newspapers, must be approved by the Municipal Press and Publication Bureau. To hold exhibitions and exhibitions of books, newspapers and periodicals published in foreign countries, Hong Kong, Macao and Taiwan, an application shall be submitted to the Municipal Press and Publication Bureau, and the examination and approval procedures shall be handled according to the relevant provisions of the state. Article 12 No unit or individual may engage in the following books, newspapers and periodicals:

(1) Books with serial numbers published by periodical agencies and periodicals with serial numbers published by publishing houses;

(2) Books and newspapers published without the approval of the administrative department of press and publication;

(3) Books, newspapers and periodicals whose publication is prohibited by the administrative department of press and publication. Article 13 The self-run distribution departments of Xinhua Bookstore and Publishing House may operate books, newspapers and periodicals distributed internally, but they shall not be publicly displayed. Other units and individuals shall not engage in books, newspapers and periodicals distributed internally.
