Provisions on fire supervision and inspection
Chapter I General Provisions Article 1 In order to strengthen fire control supervision, standardize fire control supervision and inspection behaviors and ensure the implementation of fire control laws and regulations, these Provisions are formulated in accordance with the Fire Protection Law of People's Republic of China (PRC). Article 2 The term "fire control supervision and inspection" as mentioned in these Provisions refers to the supervision and inspection by public security fire control institutions on the compliance of organs, groups, enterprises and institutions with fire control laws and regulations according to law; Violation of fire laws and regulations, shall be ordered to correct, and shall be punished according to law. Article 3 These Provisions shall be implemented by public security fire control institutions at all levels. The public security fire control institutions at higher levels are responsible for supervising, inspecting and guiding the fire control supervision and inspection work of the public security fire control institutions at lower levels; City (municipality directly under the central government, sub-provincial cities, prefecture-level cities, county-level cities and municipal districts), prefecture (state, league) and county (flag) public security fire control institutions shall specifically implement fire control supervision and inspection.

The police station shall perform fire control supervision and inspection on the management units, residents' committees, villagers' committees and units authorized by the public security organs at higher levels in residential areas. Fourth public security fire control institutions engaged in fire supervision and inspection personnel should have the corresponding post qualifications, certificates. Chapter II Forms and Emphasis of Inspection Article 5 Public security fire control institutions shall promptly carry out the following forms of fire control supervision and inspection:

(a) regular supervision and inspection of key units of fire safety, and sampling supervision and inspection of non-key units of fire safety;

(two) fire supervision and inspection before the use or opening of public gathering places and before holding large-scale mass activities with fire danger;

(three) supervision and inspection of reports and complaints in violation of fire laws and regulations;

(four) to conduct fire supervision and inspection on major festivals, major events and fire-prone seasons;

(5) Other special supervision and inspection as required. Article 6 Public security fire control institutions at or above the county level shall, in accordance with the provisions of the Fire Protection Law and in light of local conditions, identify the following units within their respective administrative areas that may be subject to fire, which may cause heavy casualties or property losses:

(a) shopping malls, markets, hotels, restaurants, stadiums (gymnasiums), auditoriums, public places of entertainment and other public gathering places;

(two) stations, airports, docks, radio stations, television stations, posts and telecommunications, communication hubs and other important places;

(3) the head of government;

(4) Important scientific research institutions, institutions of higher learning and hospitals;

(five) high-rise office buildings, commercial and residential buildings, comprehensive buildings and other public buildings;

(6) Libraries, archives, exhibition halls, museums, important cultural relics and ancient buildings;

(7) Underground railways and other underground public buildings;

(eight) large warehouses and yards where grain, cotton, wood, department stores and other materials are concentrated;

(nine) power plants (stations) and regional power supply system substations;

(ten) city gas and fuel supply plants (stations), large and medium-sized oil depots, dangerous goods warehouses, petrochemical enterprises and other inflammable and explosive goods production, storage and sales units;

(eleven) the construction site of national and provincial key projects and other large-scale projects;

(twelve) other important places and industrial enterprises.

Whether the identified key units of fire safety are included in the key units of fire safety shall be re-determined according to the changes in the nature of use. If it is no longer included, it shall be reported to the people's government at the same level and the public security fire control institution at the next higher level for the record. Seventh public security fire control institutions shall supervise and inspect the key units of fire safety in this area, at least once every quarter; The supervision and inspection workload of each fire supervision and inspection personnel should be quantified according to the local actual situation. Eighth public security fire control institutions should be in violation of fire laws and regulations, which may cause fire hazards, as a fire hazard; If there will be serious violations of fire laws and regulations, which may lead to heavy casualties or heavy property losses, it will be identified as a major fire hazard. Chapter III Contents and Methods of Inspection Article 9 The contents of fire supervision and inspection are:

(a) whether the buildings and places of the inspected units have gone through the relevant inspection, acceptance or inspection procedures according to law before construction, use or opening.

(two) the use and change of the following items that have passed the fire design audit and fire acceptance:

(1) fire spacing, fire truck access, fire water source, etc. General layout and layout related to fire safety;

(two) the fire category and fire resistance rating of the building;

(3) Building fire prevention and smoke prevention areas and building structures;

(4) Safe evacuation passages and exits;

(5) Automatic fire alarm and automatic fire extinguishing system;

(six) smoke control facilities and fire prevention equipment of ventilation and air conditioning system;

(7) Fireproof materials for interior decoration of buildings;

(8) Other contents of fire protection design acceptance.

(three) the following contents of fire safety management:

(1) Formulation and implementation of fire safety management system and fire safety operation procedures;

(2) Implement the fire safety responsibility system and the person responsible for fire safety;

(three) fire safety education and training for employees and key types of work;

(4) the formulation and implementation of the fire inspection system and the rectification of fire hazards;

(5) On-the-job situation and equipment operation records of the personnel on duty in the fire control room;

(six) the determination and management of key fire safety parts;

(7) Implementation of fire and explosion prevention measures for inflammable and explosive dangerous goods and places;

(8) Establishment and perfection of fire prevention files;

(9) the implementation of daily fire inspection and inspection records;

(10) The establishment and implementation of the system of regular inspection, detection and maintenance of fire-fighting facilities, and the configuration and effective use of fire-fighting equipment;

(1 1) Formulate fire-fighting plans and emergency evacuation plans for key units of fire safety and organize drills regularly.
