Measures of Shenyang Municipality on the Administration of Motor Vehicle Parking Lot
Chapter I General Provisions Article 1 In order to strengthen the management of motor vehicle parking lots, standardize vehicle parking, and ensure the safe and smooth urban road traffic, these measures are formulated in accordance with the provisions of the Urban and Rural Planning Law of People's Republic of China (PRC), the Road Traffic Safety Law of the People's Republic of China and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the planning, construction, operation, use and management of motor vehicle parking lots in urban areas of this Municipality.

These Measures are not applicable to the planning, construction and management of passenger and freight parking lots on public roads. Article 3 The term "parking lot" as mentioned in these Measures refers to outdoor or indoor places for parking motor vehicles. Including public parking lots, special parking lots and road parking spaces.

Public * * * parking lot refers to the motor vehicle parking place built independently according to the plan, supporting the construction of public * * * buildings, and set up in the form of temporary land occupation.

Special parking lot refers to the place where the unit and the residential area park motor vehicles.

Road parking spaces refer to motor vehicle parking spaces set up on urban roads according to law. Article 4 The municipal public security organ is the competent department of the parking lot and is responsible for organizing the implementation of these measures.

Development and reform, planning, urban and rural construction, urban construction, industry and commerce, taxation, price, quality supervision, civil air defense and other administrative departments shall, within the scope of their respective duties, do a good job in the management of parking lots. Article 5 The municipal public security organ shall, jointly with the relevant departments, formulate standards for the construction of intelligent parking lots, organize the construction of public parking information systems such as parking guidance systems, and manage parking lots by means of intelligence and informatization. Article 6 The municipal and district people's governments shall incorporate the public parking lot projects invested by the government into the annual financial budget and investment plan of the government at the corresponding level. Chapter II Planning and Construction of Parking Lot Article 7 The construction of public parking lots shall follow the principle of economical and intensive land use, and make full use of underground space and three-dimensional space to build parking lots. The construction of public parking lots should be rationally allocated and connected with the construction of urban transportation system.

When planning the construction of public parking lots, it should meet the needs of the popularization of new energy vehicles such as electric vehicles, and build or reserve related facilities such as charging. Article 8 The municipal competent department of urban and rural planning shall, according to the needs of the overall urban planning, special urban road traffic planning and urban construction and development, jointly with the administrative departments of development and reform, public security and urban and rural construction, formulate special parking lot planning and parking facilities allocation standards for construction projects, and implement them after being approved by the Municipal People's Government.

The municipal competent department of urban and rural construction shall, according to the special planning of the parking lot, prepare the recent construction plan of the public parking lot and the annual construction plan of the public parking lot, which shall be implemented after being approved by the Municipal People's government.

The parking lot land determined by the special parking lot planning shall not be changed without legal procedure adjustment. Article 9 The parking lot design scheme shall conform to the national and municipal parking lot setting standards and design specifications.

Parking lot setting standards and design specifications shall be formulated by the municipal competent department of urban and rural planning in conjunction with the municipal public security organs. Article 10 The municipal competent department of urban and rural planning shall obtain the consent of the public security organ when reviewing the planning and design scheme of public parking lots and large (medium) buildings and building additional parking lots. Article 11 When building a parking lot, facilities such as lighting, communication, drainage, ventilation, fire fighting and technical defense shall be built according to the needs, and perfect signs, marking lines and traffic safety facilities shall be set according to the parking lot setting standards and design specifications.

The construction of parking lots should provide convenient conditions for disabled people to park their cars independently. Twelfth after the completion of the parking lot construction project, the municipal public security organ shall participate in the project acceptance organized by the construction unit. Without acceptance or unqualified acceptance, it shall not be put into use. Thirteenth new public buildings, residential areas and commercial streets (districts), large (medium) buildings should be in accordance with the parking lot setting standards and design specifications, supporting the construction of parking lots. Supporting the construction of the parking lot should be synchronized with the main project design, synchronous construction, synchronous acceptance, synchronous delivery.

Parking lot construction should be carried out in accordance with the approved design scheme to ensure the quality of the project.

For large-scale public construction projects with a building scale of more than 20,000 square meters and residential projects with a building scale of more than 50,000 square meters, the construction unit shall conduct a special study on traffic impact assessment of construction projects to determine parking requirements. Fourteenth the following public buildings are not in accordance with the national and municipal parking lot setting standards and design specifications supporting the construction of parking lots, and should be rebuilt and expanded at the same time according to the plan:

(1) Railway stations, airports and hub stations where public transport and private vehicles transfer;

(2) stadiums, theaters, libraries, hospitals, schools, exhibition venues, tourist attractions, business office buildings and offices that undertake administrative affairs with foreign countries;

(three) shopping malls, hotels, restaurants, entertainment and other business places with a construction area of more than 5000 square meters.

If it is impossible to build a parking lot due to objective conditions, it shall choose another site for construction or take other measures to remedy it, and the number of parking spaces shall not be lower than the standard for allocation and construction. Article 15 No unit or individual is allowed to use the planned public parking lots and special parking lots for other purposes or stop using them without authorization, or to change the number of planned public parking lots and special parking lots without authorization.

If the function of the building changes, the built parking lot shall not be used for other purposes; If the parking lot is not up to standard after the function change, it shall be built according to the standard.
