(a) in order to implement the provisions of laws and regulations, according to the actual situation of this Municipality, it is necessary to make specific provisions;
(two) matters that belong to the local affairs of this Municipality and need to formulate local regulations;
(three) the state and the autonomous region have not yet formulated laws, administrative regulations and local regulations, and according to the specific conditions and actual needs of this Municipality, local regulations may be formulated in advance.
According to the first paragraph of this article, local regulations are limited to urban and rural construction and management, environmental protection, historical and cultural protection and other matters.
Where the law provides otherwise for the formulation of local regulations for cities divided into districts, such provisions shall prevail. Article 4 Local regulations that stipulate particularly important matters within the administrative area of this Municipality shall be adopted by the Municipal People's Congress.
When the Municipal People's Congress is not in session, the Standing Committee may partially supplement or amend the local regulations formulated by the Municipal People's Congress, but it shall not contravene the basic principles of the regulations. Article 5 The legislative activities of the Municipal People's Congress and its Standing Committee shall follow the following principles:
(a) follow the basic principles of the Constitution, take economic construction as the center, adhere to the socialist road, adhere to the people's democratic dictatorship, adhere to the leadership of the China * * * production party, adhere to Marxism-Leninism, Mao Zedong Thought and Deng Xiaoping Theory, and persist in reform and opening up;
(two) in accordance with the statutory authority and procedures, from the overall interests of the country, safeguard the unity and dignity of the socialist legal system;
(3) fully develop socialist democracy, adhere to the openness of legislation, reflect the will of the people of all ethnic groups, and ensure that people of all ethnic groups participate in legislative activities through various channels;
(4) proceeding from reality, highlighting local characteristics, and scientifically and reasonably stipulating the rights and obligations of citizens, legal persons and other organizations, as well as the rights and responsibilities of state organs. Article 6 Local regulations shall be clear, specific, targeted and enforceable.
Formulate local laws and regulations, and generally do not repeat the provisions of the contents that have been clearly stipulated by the superior law. Article 7 The Municipal People's Congress and its Standing Committee shall strengthen the organization and coordination of legislative work and play a leading role in legislative work. Chapter II Legislative Preparation Section 1 Legislative Planning and Legislative Plan Article 8 The Standing Committee adopts legislative planning and annual legislative plan to strengthen the overall arrangement of legislative work and improve the timeliness and pertinence of legislation.
When formulating legislative plans and annual legislative plans, legislative items should be determined according to the needs of economic and social development and the construction of democracy and the rule of law.
In the last year of each term of office of the Standing Committee, the meeting of directors of the Standing Committee shall put forward a draft proposal for the next legislative plan, which shall be decided by the next meeting of directors of the Standing Committee. In the fourth quarter of each year, the meeting of directors of the Standing Committee shall prepare the legislative plan for the next year.
The legislative plan and the annual legislative plan shall be adopted by the meeting of directors of the Standing Committee, printed and distributed to the meeting of the Standing Committee, and announced to the public.
Legislative plans and annual legislative plans and their adjustments in the implementation process shall be reported to the Standing Committee of the People's Congress of the autonomous region for the record. Article 9 The legislative affairs office of the Standing Committee shall be responsible for the specific work of compiling the legislative plan and the annual legislative plan, and supervise the implementation of the legislative plan and the annual legislative plan according to the requirements of the Standing Committee. Article 10 The legislative affairs office of the Standing Committee shall, before 10 every year, seek legislative suggestions from the relevant special committees of the Municipal People's Congress, the legislative affairs office of the Municipal People's Government, the Standing Committee of the People's Congress of Qixian District, the representatives of the Municipal People's Congress, the grassroots legislative contact points of the Standing Committee and other relevant organs and organizations; Through the media such as Baotou People's Congress Network and Baotou Daily, legislative suggestions are widely collected from the society.
The Legislative Affairs Office of the Municipal People's Government is responsible for collecting legislative suggestions from government departments.
Any state organs, political parties, social organizations, enterprises, institutions and citizens may put forward legislative proposals to the Standing Committee of the Municipal People's Congress. Article 11 When putting forward a legislative proposal, it shall be accompanied by a draft legislative proposal and its explanation, as well as investigation and demonstration materials on the legality, necessity, feasibility and legislative opportunity of the legislative proposal. Article 12 The legislative affairs office of the Standing Committee is responsible for establishing a legislative project library, incorporating the collected legislative suggestions into the legislative project library, and implementing dynamic management of the legislative project library.
The Legislative Affairs Office of the Standing Committee shall organize relevant special committees and the Legislative Affairs Office of the Municipal People's Government, as well as relevant departments and experts to demonstrate the legislative proposals.
