Chapter I: General Provisions
Article 1 These Regulations are formulated to safeguard the legitimate rights and interests of nurses, standardize nursing behaviors, promote the development of nursing career, and ensure medical safety and human health.
Article 2 The term "nurse" as mentioned in these Regulations refers to the health technical personnel who have obtained the nurse's practice certificate through practice registration, engaged in nursing activities in accordance with the provisions of these Regulations, and performed the duties of protecting life, alleviating pain and improving health.
Article 3 The personal dignity and personal safety of nurses are inviolable. Nurses perform their duties according to law and are protected by law. The whole society should respect nurses.
Article 4 Relevant departments of the State Council, local people's governments at or above the county level and their relevant departments and township (town) people's governments shall take measures to improve the working conditions of nurses, ensure the treatment of nurses, strengthen the construction of nurses, and promote the healthy development of nursing. Relevant departments of the State Council and local people's governments at or above the county level shall take measures to encourage nurses to work in rural areas and primary medical and health institutions.
Article 5 The competent department of health in the State Council is responsible for the supervision and management of nurses throughout the country. The competent health department of the local people's government at or above the county level shall be responsible for the supervision and management of nurses within their respective administrative areas.
Article 6 The relevant departments of the State Council shall award honorary titles or Bethune medals to nurses who have made outstanding contributions in nursing work, and the nurses who have been commended and rewarded shall enjoy the treatment of provincial and ministerial model workers and advanced workers; Nurses who have been engaged in nursing work for a long time should be awarded honorary certificates.
Specific measures shall be formulated by the relevant departments of the State Council. The local people's governments at or above the county level and their relevant departments shall commend and reward nurses who have made outstanding contributions within their respective administrative areas in accordance with the relevant provisions of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.
Chapter II: Practice Registration
Article 7 A nurse shall obtain a nurse's practice certificate after practicing registration.
To apply for nurse practice registration, the following conditions shall be met:
(1) Having full capacity for civil conduct;
(two) in secondary vocational schools and institutions of higher learning to complete more than 3 years of nursing, midwifery and other ordinary full-time professional courses, including teaching and general hospitals to complete more than 8 months of nursing clinical practice, and obtain the corresponding academic certificates;
(3) Having passed the nurse qualification examination organized by the competent health department of the State Council;
(four) in line with the health standards stipulated by the competent department of health in the State Council.
The application for nurse practice registration shall be filed within 3 years from the date of passing the nurse practice qualification examination; If an application is filed within the time limit, in addition to meeting the conditions specified in Items (1), (2) and (4) of the preceding paragraph, it shall also receive clinical nursing training for 3 months in medical and health institutions that meet the conditions specified by the competent health department of the State Council, and pass the examination.
Measures for the qualification examination of nurses shall be formulated by the competent health department of the State Council in conjunction with the personnel department of the State Council.
Article 8 Anyone who applies for practicing registration as a nurse shall apply to the competent health department of the people's government of the province, autonomous region or municipality directly under the Central Government. The competent health department that receives the application shall make a decision within 20 working days from the date of receiving the application, grant registration to those who meet the conditions stipulated in these regulations, and issue a nurse's practice certificate; Do not meet the requirements of this Ordinance, shall not be registered, and explain the reasons in writing. The validity period of nurse practice registration is 5 years.
Article 9 A nurse who changes her practice place within the validity period of practice registration shall report to the competent health department of the people's government of the province, autonomous region or municipality directly under the Central Government. The competent health department that receives the report shall handle the change formalities for it within 7 working days from the date of receiving the report.
If a nurse changes her practice place across provinces, autonomous regions and municipalities directly under the Central Government, the competent health department receiving the report shall also notify the competent health department of the people's government of the province, autonomous region or municipality directly under the Central Government where she originally practiced.
Article 10 If a nurse needs to continue practicing after the expiration of the validity period of the practice registration, he shall apply to the health authorities of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government for renewal of the registration 30 days before the expiration of the validity period of the practice registration.
The competent health department that has received the application shall grant the extension to those who meet the conditions stipulated in these regulations, and the extension of the practice registration shall be valid for 5 years; Does not comply with the provisions of this Ordinance, shall not be extended, and explain the reasons in writing.
If a nurse needs to cancel her practice registration in accordance with the provisions of the Administrative Licensing Law, the original registration department shall cancel her practice registration in accordance with the provisions of the Administrative Licensing Law.
Article 11 The competent health department of the local people's government at or above the county level shall establish good and bad records of nurses' practice within their respective administrative areas, and record them in the nurse practice information system.
The good record of nurses' practice includes the commendation and awards that nurses have received and the completion of government mandatory tasks. Bad practice records of nurses include cases where nurses are subject to administrative penalties and sanctions in violation of these regulations and other health management laws, regulations, rules or medical technical specifications.
Chapter III: Rights and Obligations
Twelfth practical nurse has the right to receive wages, enjoy welfare benefits and participate in social insurance in accordance with relevant state regulations. No unit or individual may deduct nurses' salary, reduce or cancel nurses' welfare and other benefits.
Thirteenth nurses have the right to obtain health protection and medical care services that are suitable for their nursing work. Nurses who are in direct contact with toxic and harmful substances and are at risk of infectious diseases have the right to accept occupational health supervision in accordance with the provisions of relevant laws and administrative regulations; Those who suffer from occupational diseases have the right to compensation in accordance with the provisions of relevant laws and administrative regulations.
Fourteenth nurses have the right to obtain professional and technical positions and titles corresponding to their professional ability and academic level in accordance with the relevant provisions of the state; Have the right to participate in professional training, engage in academic research and exchanges, and join trade associations and professional academic groups.
Fifteenth nurses have the right to obtain information related to the diagnosis, treatment and nursing of diseases and other rights related to the performance of nursing duties, and can put forward opinions and suggestions on the work of medical and health institutions and health authorities.
Sixteenth nurses should abide by the provisions of laws, regulations, rules and technical specifications for diagnosis and treatment.
Article 17 When a nurse discovers that a patient is in critical condition in practice, she shall immediately notify the doctor. In an emergency, in order to save the lives of dying patients, the necessary emergency rescue should be implemented first.
If the nurse finds that the doctor's advice violates the provisions of laws, regulations, rules or technical specifications for diagnosis and treatment, she shall promptly submit it to the doctor who issued the doctor's advice; When necessary, it shall report to the person in charge of the department where the doctor is located or the person in charge of medical service management in the medical and health institution.
Article 18 Nurses should respect, care for and cherish patients and protect their privacy.
Article 19 Nurses have the obligation to participate in public health and disease prevention and control. In the event of natural disasters, public health incidents and other emergencies that seriously threaten public life and health, nurses should obey the arrangements of the health authorities of the people's governments at or above the county level or their medical and health institutions and participate in medical rescue.
Chapter IV: Responsibilities of Medical and Health Institutions
Twentieth medical and health institutions equipped with the number of nurses shall not be lower than the standard of nurses prescribed by the competent department of health in the State Council.
Twenty-first medical and health institutions shall not allow the following personnel to engage in nursing activities stipulated in the technical specifications for diagnosis and treatment within their own institutions:
(a) personnel who have not obtained the nurse's practice certificate;
(two) nurses who have not gone through the formalities for changing their practice places in accordance with the provisions of Article 9 of these regulations;
(three) the validity period of the nurse's practice registration expires and the practice registration is not renewed. Personnel engaged in nursing clinical practice in teaching and general hospitals should carry out relevant work under the guidance of nurses.
Twenty-second medical and health institutions should provide nurses with health protection articles and take effective health protection measures and medical and health care measures.
Twenty-third medical and health institutions shall implement the relevant provisions of the state on wages and benefits, and pay social insurance premiums in full for nurses engaged in nursing work in their own institutions in accordance with the relevant provisions of the state to protect the legitimate rights and interests of nurses.
Nurses working in hard and remote areas, or nurses who are in direct contact with toxic and harmful substances and are at risk of infectious diseases, shall be subsidized by their medical and health institutions in accordance with relevant state regulations.
Twenty-fourth medical and health institutions shall formulate and implement the on-the-job training plan for nurses in their own institutions to ensure that nurses receive training.
Nurse training should pay attention to the application of new knowledge and technology; According to the development of clinical specialized nursing and the needs of specialized nursing posts, nurses were trained in specialized nursing.
Twenty-fifth medical and health institutions shall, in accordance with the provisions of the competent department of health in the State Council, set up special institutions or be equipped with full-time (part-time) staff to be responsible for nursing management.
Twenty-sixth medical and health institutions should establish a nurse post responsibility system, and carry out supervision and inspection.
If a nurse is complained of not performing her duties or violating professional ethics, the medical and health institution where she belongs shall conduct an investigation. After verification, the medical and health institution shall deal with the nurse and inform the complainant of the investigation and handling.
Chapter V: Legal Liability
Article 27 Any staff member of the competent department of health who fails to perform his duties in accordance with the provisions of these Regulations, abuses his power, engages in malpractices for selfish ends, or commits other dereliction of duty shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Twenty-eighth in any of the following circumstances, the competent health department of the local people's government at or above the county level shall, in accordance with the division of responsibilities, order it to make corrections within a time limit and give a warning; If no correction is made within the time limit, the number of nurses legally practicing in medical and health institutions shall be reduced in accordance with the standards for nurses prescribed by the health authorities in the State Council.
Or suspend its practice for more than 6 months 1 year; If the medical and health institutions run by the state are under any of the following circumstances and the circumstances are serious, the responsible person in charge and other directly responsible personnel shall be punished according to law:
(a) in violation of the provisions of this Ordinance, the number of nurses is lower than the standard of nurses prescribed by the competent department of health in the State Council;
(2) allowing a person who has not obtained a nurse's practice certificate or a nurse who has not gone through the formalities of changing the practice place and extending the validity period of practice registration in accordance with the provisions of these Regulations to engage in nursing activities stipulated in the technical specifications for diagnosis and treatment in this institution.
Twenty-ninth medical and health institutions in any of the following circumstances, shall be punished in accordance with the provisions of relevant laws and administrative regulations; If the medical and health institutions run by the state are under any of the following circumstances and the circumstances are serious, the responsible person in charge and other directly responsible personnel shall be punished according to law:
(a) do not implement the relevant state regulations on wages and benefits;
(two) nurses engaged in nursing work in this institution have not paid social insurance premiums in full in accordance with the relevant provisions of the state;
(3) Failing to provide health protection articles to nurses, or failing to take effective health protection measures and medical care measures;
(4) failing to give allowances to nurses who work in hard and remote areas or are in direct contact with toxic and harmful substances and are at risk of infectious diseases in accordance with relevant state regulations.
Thirtieth medical and health institutions in any of the following circumstances, by the competent health department of the local people's government at or above the county level in accordance with the division of responsibilities, shall be ordered to make corrections within a time limit, given a warning:
(1) Failing to formulate and implement the on-the-job training plan for nurses in this institution or failing to ensure that nurses receive training;
(two) failing to perform the duties of nurse management in accordance with the provisions of these regulations.
Thirty-first nurses in the practice of any of the following circumstances, by the competent department of health of the local people's governments at or above the county level in accordance with the division of responsibilities shall be ordered to make corrections, given a warning; If the circumstances are serious, their practice activities of less than 6 months 1 year shall be suspended until their nurse's practice certificate is revoked by the original issuing department:
(a) found that the patient was in critical condition and did not immediately notify the doctor;
(two) it is found that the doctor's advice violates the provisions of laws, regulations, rules or technical specifications for diagnosis and treatment, and it is not put forward or reported in accordance with the provisions of Article 17 of these regulations;
(3) disclosing the patient's privacy;
(four) the occurrence of natural disasters, public health incidents and other emergencies that seriously threaten public life and health, and do not obey the arrangement to participate in medical rescue.
Nurses who cause medical accidents in their practice activities shall bear legal responsibilities in accordance with the relevant provisions on the handling of medical accidents.
Article 32 A nurse whose practice certificate has been revoked may not apply for practice registration within 2 years from the date of revocation of her practice certificate.
Article 33 disturbing the medical order, preventing nurses from carrying out their professional activities according to law, insulting, threatening or beating nurses, or committing other illegal acts. The legitimate rights and interests of nurses shall be punished by the public security organs in accordance with the provisions of the Law on Public Security Administration Punishment; If a crime is constituted, criminal responsibility shall be investigated according to law.
Chapter VI: Supplementary Provisions
Thirty-fourth before the implementation of these regulations, those who have obtained the nurse's practice certificate or the professional technical title of nursing in accordance with the relevant provisions of the state and engaged in nursing activities shall be certified by the health authorities of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.
Medical and health institutions that have not reached the standard of nurse establishment before the implementation of these Regulations shall, in accordance with the implementation steps stipulated by the competent health department of the State Council, reach the standard of nurse establishment within 3 years from the date of implementation of these Regulations.
