Production and business units shall establish and improve the safety training system in accordance with the safety production law and relevant laws, administrative regulations and these Provisions. Article 4 The employees that a production and business operation entity should receive safety training include the principal responsible person, safety production management personnel, special operators and other employees.
Where production and business operation entities use labor dispatch personnel, they shall bring the labor dispatch personnel into the unified management of their employees, and educate and train the labor dispatch personnel in post safety operation procedures and safety operation skills. The labor dispatch unit shall provide the dispatched workers with necessary education and training in production safety.
Where a production and business operation entity accepts the internship of students from secondary vocational schools or institutions of higher learning, it shall conduct corresponding safety education and training for the interns and provide necessary labor protection articles. The school shall assist the production and business operation entities to carry out safety education and training for interns.
Employees of production and business units shall receive safety training, be familiar with relevant safety production rules and regulations and safety operation procedures, have the necessary knowledge of safety production, master the safety operation skills of their posts, understand the emergency treatment measures for accidents, and know their rights and obligations in safety production.
Employees who have not passed the safety training are not allowed to work at their posts. Article 5 state administration of work safety guides the national safety training, and supervises and manages the national safety training according to law.
The relevant departments in charge of the State Council shall guide and supervise the safety training in this industry according to their respective responsibilities, and formulate implementation measures according to these Provisions.
The State Administration of Coal Mine Safety shall guide, supervise and inspect the national coal mine safety training.
Safety production supervision and management departments at all levels and coal mine safety supervision institutions (hereinafter referred to as safety production supervision and supervision departments) shall, according to their respective duties, supervise and manage the safety training of production and business units according to law. Chapter II Safety Training for Principal Officials and Safety Production Management Personnel Article 6 Principal officials and safety production management personnel of production and business operation entities shall receive safety training, and have safety production knowledge and management ability suitable for their production and business operation activities. Article 7 The safety training for the principal responsible persons of production and business operation entities shall include the following contents:
(a) the national guidelines and policies on production safety and the laws, regulations, rules and standards related to production safety;
(two) the basic knowledge of production safety management, production safety technology and professional knowledge of production safety;
(three) the relevant provisions on the management of major hazard sources, the prevention of major accidents, emergency management and rescue organizations, and the investigation and handling of accidents;
(4) Occupational hazards and preventive measures;
(5) Advanced experience in safety production management at home and abroad;
(6) Analysis of typical accidents and emergency rescue cases;
(seven) other contents that need training. Article 8 The safety training of production safety management personnel of production and business operation entities shall include the following contents:
(a) the national guidelines and policies on production safety and the laws, regulations, rules and standards related to production safety;
(two) knowledge of safety production management, safety production technology and occupational health. ;
(3) Statistics and reports of casualty accidents and investigation and handling methods of occupational hazards;
(four) the contents and requirements of emergency management, emergency plan preparation and emergency disposal;
(5) Advanced experience in safety production management at home and abroad;
(6) Analysis of typical accidents and emergency rescue cases;
(seven) other contents that need training. Article 9 The first safety training time for the principal responsible persons and safety production management personnel of production and business operation entities shall not be less than 32 hours. The annual retraining time shall not be less than 12 class hours.
The primary safety training time for the principals and safety production management personnel of coal mines, non-coal mines, dangerous chemicals, fireworks and firecrackers, metal smelting and other production and business units shall not be less than 48 hours, and the annual retraining time shall not be less than 16 hours. Article 10 The safety training of the main persons in charge of production and business operation entities and safety production management personnel must be implemented in accordance with the safety training outline formulated by the safety production supervision and supervision department.
The safety training plan and assessment standards for the main persons in charge and safety production management personnel of non-coal mines, dangerous chemicals, fireworks, metal smelting and other production and business units shall be uniformly formulated by the State Administration of Work Safety.
The safety training syllabus and assessment standards for the main person in charge of coal mines and the safety production management personnel shall be formulated by the State Administration of Coal Mine Safety.
Safety training plans and assessment standards for the principal responsible persons and safety management personnel of production and business units other than coal mines, non-coal mines, dangerous chemicals, fireworks and firecrackers, and metal smelting shall be formulated by the safety production supervision and management departments of provinces, autonomous regions and municipalities directly under the Central Government.
