Interim Measures of Chongqing Municipality on the Administration of Private Non-academic Education and Training Institutions
Chapter I General Provisions Article 1 In order to standardize the education and training activities of private non-academic education and training institutions and promote the healthy development of the private education and training market in this Municipality, these Measures are formulated in accordance with the Law on the Promotion of Private Education in People's Republic of China (PRC), the Provisional Regulations on the Registration of Private Non-enterprise Units in the State Council, the Regulations on the Administration of Company Registration and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the establishment of private non-academic education and training institutions and the supervision and management of their education and training activities within the administrative area of this Municipality. Except as otherwise provided by laws and regulations.

The term "private non-academic education and training institutions" as mentioned in these Measures refers to schools and other education and training institutions that are organized by social organizations or individuals other than state institutions, do not have academic qualifications, mainly focus on cultural education or vocational skills training, and use non-state financial funds. Article 3 The Municipal People's Government shall be responsible for leading the work of private non-academic education in this Municipality, studying major issues in the development of private non-academic education, and promoting the healthy development of private education in this Municipality.

The people's governments of counties (autonomous counties) are responsible for the management of private non-academic education and training institutions within their respective administrative areas, the overall management of private non-academic education and training institutions within their respective administrative areas, the strengthening of supervision capacity building, the organization of special actions, and the coordination and handling of emergencies. Article 4 The administrative department of education shall be responsible for the supervision and management of private non-academic education and cultural education and training institutions; The human resources and social security department is responsible for the supervision and management of private non-academic education and training institutions for vocational training.

The civil affairs department is responsible for the registration and management of non-profit private non-academic education and training institutions; The administrative department for industry and commerce is responsible for the registration and management of for-profit private non-academic education and training institutions.

Public security, price and other relevant functional departments shall, in accordance with their respective responsibilities, strengthen the supervision and management of fire safety and charging behavior of private non-academic education and training institutions. Article 5 The supervision and management of private non-academic education and training institutions shall follow the principle of combining territorial management with classified management, and implement the accountability system of "who approves, who supervises, who organizes and who is responsible". Chapter II Establishment, Alteration and Termination Article 6 The establishment of private non-academic education and training institutions shall be registered in accordance with relevant laws and administrative regulations according to the different nature of running schools and management methods.

Non-profit private non-academic education and training institutions shall be registered as private non-enterprise units according to law; For-profit private non-academic education and training institutions shall be registered as enterprise legal persons according to law.

The same private non-academic education and training institution shall not be registered as a private non-enterprise unit and an enterprise legal person at the same time. Article 7 To establish a non-profit private non-academic education and training institution, the applicant shall, in accordance with the relevant provisions of the state, go through the examination and approval procedures with the education administrative department or the human resources and social security department, and after obtaining the school license, go through the legal person registration of private non-enterprise units with the civil affairs department according to law. Article 8 Where a profit-making private non-academic education and training institution is established, the applicant shall apply for registration with the administrative department for industry and commerce of the county (autonomous county) where it is established.

The administrative department for industry and commerce will send the relevant application materials to the education administrative department at the same level or the human resources and social security department for comments; The administrative department of education and the department of human resources and social security shall give written feedback within 30 days from the date of receiving the application materials. If it does not agree to the establishment, it shall explain the reasons.

The administrative department for industry and commerce shall, after receiving the written opinions of the administrative department of education or the department of human resources and social security, make a decision on whether to approve the registration. If it decides to approve the registration, it shall issue a business license and send a copy to the education administrative department or the human resources and social security department; If it decides not to register, it shall inform the reasons in writing.

The names of for-profit private non-academic education and training institutions approved by the administrative department for industry and commerce shall conform to the provisions of relevant laws and regulations such as the Provisions on the Administration of Enterprise Name Registration, and the words "training" shall be included in the names, and the words "school" and "college" shall not appear. Ninth city, county (Autonomous County) education administrative departments, human resources and social security departments of private non academic education and training institutions for examination and approval, audit authority, in accordance with the relevant provisions of the state and the city.

Private non-academic education and training institutions approved by the education administrative departments and human resources and social security departments of counties (autonomous counties) shall be submitted by the education administrative departments and human resources and social security departments of counties (autonomous counties) to the municipal education administrative departments and municipal human resources and social security departments for the record in accordance with relevant regulations. Tenth education administrative departments or human resources and social security departments shall, in accordance with the "People's Republic of China (PRC) Private Education Promotion Law" and other relevant laws and regulations, examine whether the applicant meets the conditions and standards for establishment. Eleventh private non-academic education and training institutions set standards by the municipal education administrative department, the municipal human resources and social security department in conjunction with the municipal civil affairs department, the municipal administrative department for Industry and commerce to develop, after the approval of the municipal government.

The establishment standards of private non-academic education and training institutions should be scientific and reasonable, adapt to the actual needs of different types and scales of education and training institutions, and solicit opinions from the public.
