In order to promote the application and industrial development of smart cars and Internet of Things technology, and standardize the testing and application of intelligent networked vehicles, these measures are formulated in accordance with the spirit of the Road Traffic Safety Law of the People's Republic of China, the Highway Law of People's Republic of China (PRC) and the Management Specification for Road Testing and Demonstration Application of Intelligent Networked Vehicles (for Trial Implementation) issued by the Ministry of Industry and Information Technology, and combined with the actual situation of our city.
I. General requirements
(a) these Measures shall apply to the testing and application activities such as intelligent networked automobile road testing and demonstration application within the administrative area of our city, as well as the relevant supervision and management work.
(II) The application of intelligent networked automobile testing follows the general idea of encouraging innovation, being safe and controllable, being inclusive and prudent, being open and cooperative, and being green and environmentally friendly, and follows the principle of automatic driving system from low risk level to high risk level, from simple type to complex type, and from low technology level to high technology level, and implements classified management.
(3) Support intelligent networked automobile enterprises to form industrial alliances, carry out research and development of key technologies, guide and encourage the strengthening of industry self-discipline, and promote fair competition and healthy and orderly development of the industry.
(4) Give priority to supporting the testing and application of intelligent networked vehicles in the fields of logistics distribution, short-distance connection, intelligent public transportation, sanitation operation and maintenance, gradually promote the access and road traffic of mass-produced intelligent networked vehicles, and cultivate new formats in the field of intelligent transportation.
(5) Give priority to the intelligent construction of road infrastructure into relevant urban road planning, promote the intelligent transformation and upgrading of road infrastructure, and promote the coordinated development of smart city infrastructure and intelligent networked vehicles.
Second, organization and management.
(1) The Hangzhou Intelligent Networked Vehicle Detection and Application Management Joint Working Group (hereinafter referred to as the Joint Working Group) was established by the Municipal Economic and Information Bureau, the Municipal Public Security Bureau, the Municipal Transportation Bureau, the Municipal Construction Committee and the Municipal Urban Management Bureau, and was responsible for organizing the concrete implementation of intelligent Networked Vehicle Detection and Application and coordinating the daily supervision and management. The office of the Joint Working Group is located in the Municipal Economic and Information Bureau.
The Municipal Bureau of Economy and Information Technology is responsible for promoting the development of intelligent networked automobile industry; Responsible for coordinating and handling the daily affairs of the joint working group, as well as the entrustment and management of third-party institutions.
The Municipal Public Security Bureau is responsible for the issuance and management of temporary motor vehicle license plates, the detection and application of traffic violations of vehicles and drivers, and the handling of traffic accidents; Responsible for defining the requirements of open test roads.
City Transportation Bureau is responsible for the road transportation management of vehicles operated by intelligent network.
The Municipal Construction Committee is responsible for the intelligent construction of road infrastructure.
The Municipal Urban Management Bureau is responsible for coordinating the related work of opening test roads and regional signs.
(2) An intelligent networked automobile testing and application expert committee composed of experts in transportation, communication, vehicles, electronics, computers, law and other related fields is responsible for demonstrating and evaluating the application for testing and application, and issuing expert opinions.
(3) The third-party organization is responsible for supporting the joint working group to supervise the whole process of intelligent networked automobile test application, including daily management work such as acceptance of test application, organization of expert demonstration and evaluation, tracking of test application and data collection.
III. Testing and Application Requirements
(1) Basic requirements for testing and application.
1. The testing application subject shall provide the safety self-declaration of the intelligent networked automobile testing application, and provide the corresponding application materials to the office of the joint working group, which shall be confirmed by the municipal economic and information bureau, the municipal public security bureau, the municipal transportation bureau, the municipal construction committee, the municipal urban management bureau and other departments.
The safety self-declaration shall include the subject of testing and application, vehicle identification code, driver's name and ID number, time, road section, area and project. Among them, the testing time shall not exceed 18 months in principle, and shall not exceed the validity period of the vehicle safety technical inspection certificate and insurance certificate applied for testing. If the safety self-declaration expires or related matters change, the testing and reporting entity shall update the information of the safety self-declaration and submit the change explanation and corresponding materials.
2. The applicant for the examination shall apply to the traffic administrative department of the public security organ for the examination of the temporary driving license plate of the motor vehicle with the proof (including the confirmed safety self-declaration and other materials) and vouchers required by the Regulations on the Administration of Motor Vehicle Registration.
The driving range specified in the temporary driving license plate shall be reasonably limited according to the test and application sections and areas specified in the safety self-declaration, and the validity period of the temporary driving license plate shall not exceed the test and application time specified in the safety self-declaration. If the temporary driver's license expires, the testing applicant can apply for a new temporary driver's license through safety self-declaration within the validity period.
3. The test and application of vehicles shall comply with the relevant provisions on the management of temporary driving license plates; Without obtaining a temporary driving license, it shall not be tested and applied. The car body should be marked with the words "Autopilot Road Test" and "Autopilot Demonstration Application" in a uniform and eye-catching color to remind the surrounding vehicles and other road users to pay attention.
4. The subjects and drivers of the examination and application shall abide by the laws and regulations on road traffic safety in China, and carry out the examination and application in strict accordance with the time, road section, area and project specified in the self-declaration on safety of examination and application. Do not test the braking performance on the road, and carry relevant information such as safety self-declaration with the vehicle for future reference. Autopilot mode is not allowed except for the road sections or areas specified in the safety self-declaration.
5. Testing and application The driver should always monitor the running state and surrounding environment of the vehicle and be ready to take over the vehicle at any time. When it is found that the vehicle is not suitable for automatic driving or the system prompts that manual operation is needed, corresponding measures should be taken in time.
6. In the process of testing and application, the software and hardware that may affect the function and performance of the vehicle shall not be changed without authorization. If the function, performance, software and hardware of the vehicle are changed due to test needs or other reasons, relevant safety instructions shall be provided to the office of the joint working group in time.
7. The test application subject should strengthen the network and data security capacity building in accordance with the requirements of relevant laws and regulations such as network security, data security, personal information protection, surveying and mapping, map management, establish and improve the network and data security compliance management system and test data traceability mechanism covering the whole life cycle of intelligent networked vehicles, strengthen the whole process management of software upgrade, and protect personal information and data security according to law.
(2) Road test requirements.
1. Intelligent networked vehicle road test refers to the automatic driving function test activities of intelligent networked vehicles on designated sections of various roads for social vehicles, such as expressways (including expressways), urban roads and regional areas.
2. Before the road test, the road test subject shall ensure that the road test vehicles have been fully tested and verified in specific areas such as the test area (field) or simulation test platform, and meet the relevant national and industry standards and specifications, and have the road test conditions.
3. During the road test, the test vehicle shall not carry other personnel or goods unrelated to the test except the professionally trained testers and the counterweight used to simulate the goods.
4. If the road test subject applies for increasing the number of test vehicles, it shall explain the number and necessity of the test vehicles to be increased, and submit relevant materials. The Municipal Economic and Information Bureau, together with the Municipal Public Security Bureau, the Municipal Transportation Bureau, the Municipal Construction Committee, the Municipal Urban Management Bureau and other departments, simplified the test process and test items in accordance with the "three-in-one principle" (the principle of consistent vehicle types, consistent automatic driving system and consistent system configuration).
5. Vehicles that have obtained the road test qualification in other provinces and cities and applied for the same or similar testing in our city can simplify the testing process and testing items according to the relevant provisions of the state and the situation that the vehicles have been tested.
6. On the basis of comprehensive road test, encourage the exploration of fully automatic driving test activities with remote drivers monitoring and testing vehicles.
(3) Demonstration application requirements.
1. The demonstration application of intelligent networked vehicles refers to the test activities of intelligent networked vehicles on designated sections of various roads for social vehicles, such as expressways (including expressways), urban roads and regional areas, which are manned or have pilot and trial effects.
2. For demonstration vehicles with the same initial application or additional configuration, the road test shall be carried out for at least 240 hours or 65,438+0,000 kilometers in the road section and area where the demonstration application is to be carried out under the automatic driving mode. During the test period, there were no traffic violations and no traffic accidents with responsibility for testing vehicles. The road section or area applying for demonstration application shall not exceed the road test section or area that the test vehicle has completed.
3. In the process of demonstration and application, people or goods needed for exploring business models can be carried according to regulations, but the carrier and the owner of the goods should be informed of relevant risks in advance and necessary safety measures should be taken. The personnel and goods carried shall not exceed the rated passengers and approved load mass of the demonstration vehicle.
4. The demonstration application subject should have the relevant business capabilities such as demonstration application operation service.
5. On the basis of fully carrying out demonstration applications, encourage the exploration of commercial trial operation activities of intelligent networked vehicles carrying people or special operations with pilot and trial operation effects.
6. Encourage low-speed unmanned vehicles to carry out special scene applications such as logistics distribution, inspection, retail and sanitation in closed and semi-closed areas. Support qualified counties (cities) to carry out low-speed unmanned vehicle applications in specific areas and specific routes, and manage them with reference to relevant regulations on non-motor vehicle management.
Four. Test and application management
(1) The Municipal Economic and Information Bureau, jointly with the Municipal Public Security Bureau, the Municipal Transportation Bureau, the Municipal Construction Committee, the Municipal Urban Management Bureau and other departments, selects several typical road sections and areas within the administrative area of our city, and uses them for the testing and application of intelligent networked vehicles after evaluation, and announces them to the public. Members of the joint working group shall, according to their respective responsibilities, guide local governments to open test roads and areas, and do a good job in setting up and upgrading road infrastructure and traffic safety facilities.
(II) The Municipal Bureau of Economic and Information, together with the Municipal Public Security Bureau, the Municipal Transportation Bureau, the Municipal Construction Committee, the Municipal Urban Management Bureau and other departments, timely released the time, items and safety precautions of the intelligent networked automobile test application to the society, especially around the test application area.
(3) The test and application subjects shall submit the test plan as required, submit the corresponding periodic report to the office of the Joint Working Group every six months, and submit the summary report within 1 month after the test and application. The joint working group reports the testing and application within its jurisdiction to the provincial authorities in June and February every year.
(four) one of the following circumstances occurs in the process of vehicle testing and application, and the Municipal Economic and Information Bureau shall terminate its testing and application in conjunction with the Municipal Public Security Bureau, the Municipal Transportation Bureau, the Municipal Construction Committee, the Municipal Urban Management Bureau and other departments:
1. The test and application of the vehicle are inconsistent with the safety self-declaration and related materials;
2. Inspection and application when the temporary driver's license expires or is revoked;
3. There are significant safety risks in testing and application activities;
4. Inspection and application for vehicles that violate traffic lights and go retrograde, or can be temporarily suspended, revoked or detained in accordance with road traffic safety laws and regulations;
5. Traffic accidents cause serious injury, death or vehicle damage, except those who are not responsible for the detection and application of vehicles.
The test and application subject shall be responsible for the integrity, authenticity and legality of all submitted materials and data. When the test and application are terminated, the traffic administrative department of the public security organ shall recover the temporary driving license plate; If it is not recovered, the traffic management department of the public security organ will declare the license plate invalid.
Verb (abbreviation of verb) Traffic violation and accident treatment
(1) In case of traffic violation during the test application, the traffic administrative department of the public security organ shall deal with the driver of the test application according to the current road traffic safety laws and regulations, or take corresponding measures for the application subject of low-speed driverless vehicles. Where laws, regulations and rules provide otherwise, such provisions shall prevail.
(two) in the process of testing and application of traffic accidents, in accordance with the laws and regulations of road traffic safety, the liability of the parties, and the liability for damages in accordance with relevant laws and regulations and judicial interpretation. The traffic administrative department of the public security organ shall punish the illegal acts of road traffic safety of the parties concerned according to law; If the case constitutes a crime, the criminal responsibility of the party concerned shall be investigated according to law.
(3) Testing and application When an accident occurs in the process of testing and application of a vehicle, the parties concerned shall protect the scene and immediately call the police. In case of serious injury, death or vehicle damage, the subject of test and application shall report the accident to the office of the Joint Working Group within 24 hours; Failure to report as required may suspend testing and application activities for 24 months. The joint working group shall report the accident to the provincial authorities within 3 working days.
(4) The testing application subject shall, within 5 working days after the identification of the accident responsibility, report the cause of the accident, the identification result of the responsibility and the complete accident analysis report and other related materials to the office of the Joint Working Group in written form; The joint working group shall report to the provincial authorities within 5 working days.
(5) If traffic accidents or other damages are caused by defects in intelligent networked automobile products, the victims may claim compensation from the producers or sellers according to law.
Supplementary clause of intransitive verbs
(1) The term "testing application subject" as mentioned in these Measures refers to the unit or unit consortium that applies for intelligent networked automobile testing application, organizes testing application and undertakes corresponding responsibilities.
(II) The term "test application vehicles" as mentioned in these Measures refers to the intelligent networked vehicles applying for test application, including passenger cars, commercial vehicles and special work vehicles with automatic driving function, as well as low-speed driverless vehicles that support innovative designs such as logistics distribution, testing, retail and sanitation. These include:
Intelligent networked vehicle refers to a new generation of vehicles equipped with on-board sensors, controllers, actuators and other equipment, which integrates modern communication and network technology, can realize intelligent information exchange and sharing between vehicles and people, vehicles and roads, and clouds, and has the functions of complex environment perception, intelligent decision-making, collaborative control and so on. , can realize safe, efficient, comfortable and energy-saving driving, and finally can realize substitution operation. The automatic driving functions of intelligent networked vehicles include conditional automatic driving, highly automatic driving and fully automatic driving.
Low-speed unmanned vehicle refers to a functional vehicle with automatic driving function and no cab, which supports logistics distribution, testing, retail, sanitation and other businesses.
(3) The term "test application driver" as mentioned in these Measures refers to the person authorized by the test application subject to be responsible for the safe operation of the test application and to implement emergency measures for the test application vehicle in case of emergency.
(4) The term "test area" as mentioned in these Measures refers to the site set in a fixed area with closed physical boundaries and roads, facilities and environmental conditions required for the automatic driving function test of intelligent networked vehicles.
(5) The term "simulation test platform" as mentioned in these Measures refers to a system that establishes a simulation test environment through technologies such as road modeling, traffic flow modeling and vehicle dynamics modeling to complete the automatic driving function test of intelligent networked automobiles.
(six) the relevant requirements for the test and application subjects, vehicles and drivers, and the application materials that the test and application subjects should provide. For reference, refer to the Management Specification for Intelligent Networked Vehicle Road Testing and Demonstration Application (Trial) issued by the Ministry of Industry and Information Technology and other three departments.
(seven) all districts and counties (cities) may formulate relevant regulations according to these measures and their own actual conditions, and encourage them to carry out various innovative application pilots.
