According to Article 13 of the National Defense Law of People's Republic of China (PRC), the Central Military Commission (CMC) leads the national armed forces and exercises the following functions and powers:
(a) Unified command of the national armed forces;
(2) To decide on the military strategy and operational policy of the armed forces;
(three) to lead and manage the construction of the China People's Liberation Army, formulate plans, plans and organize their implementation;
(four) to submit a motion to the National People's Congress or the NPC Standing Committee;
(5) To formulate military regulations and issue decisions and orders in accordance with the Constitution and laws;
(6) Deciding on the structure and establishment of the China People's Liberation Army, and defining the tasks and responsibilities of the headquarters, military regions, arms and services and other units at the military region level;
(seven) in accordance with the provisions of laws and military regulations, the appointment and removal, training, assessment and reward and punishment of members of the armed forces;
(eight) to approve the military weapons and equipment system and weapons and equipment development plan, and to cooperate with the State Council in leading and managing national defense research and production;
(nine) to manage national defense funds and national defense assets in conjunction with the State Council;
(ten) other functions and powers as prescribed by law.

People's Republic of China (PRC) National Defense Law Article 15 The local people's congresses at various levels and the standing committees of local people's congresses at or above the county level shall, within their respective administrative areas, ensure the observance and implementation of national defense laws and regulations. Local people's governments at various levels shall, within the limits of authority prescribed by law, administer conscription, militia, reserve, national defense education, national economic mobilization, civil air defense, national defense transportation, protection of national defense facilities, resettlement of ex-soldiers and pensions.
Article 17 The armed forces of People's Republic of China (PRC) belong to the people. Its task is to consolidate national defense, resist aggression, defend the motherland, safeguard the people's peaceful labor, participate in national construction and serve the people wholeheartedly.
