Chapter I General Provisions Article 1 In order to promote the construction of farmers' markets, standardize market operation and management, maintain market trading order, and protect the legitimate rights and interests of promoters, operators and consumers, these Measures are formulated in accordance with relevant national and provincial laws and regulations and in light of the actual situation in Kunming. Article 2 The term "farmer's market" as mentioned in these Measures refers to the trading market where the promoters provide fixed places and facilities and the operators enter the market for centralized and public trading of agricultural and sideline products. Article 3 These Measures shall apply to the start-up, operation, supervision and management of farmers' markets in four main districts, three development (holiday) districts, Chenggong New District, Airport Economic Zone and other county (city) district people's governments.

Where there are other provisions in national laws, regulations and rules, such provisions shall prevail. Article 4 The farmers' market shall be subject to territorial management. County (city) District People's Government and the three development (holiday) areas, Chenggong New District and Airport Economic Zone Administrative Committee shall set up a farmer's market management office, which shall be responsible for the overall coordination, supervision and management of the planning, construction and supervision of the farmer's market within its jurisdiction.

The relevant neighborhood offices and community neighborhood (village) committees shall designate specific departments (personnel) to be responsible for the comprehensive management of farmers' markets in their respective jurisdictions. Article 5 The administrative department for industry and commerce is the competent department in charge of supervision and management of farmers' markets. While performing the duties of industrial and commercial administration according to law, take the lead in organizing and implementing the standardized transformation and management of farmers' markets.

Business, planning, land, construction, urban management, health, public security, agriculture, water conservancy, price, quality supervision, comprehensive administrative law enforcement and other administrative departments shall, according to their respective responsibilities, do a good job in the supervision and management of the farmer's market according to law. Article 6 Citizens, legal persons, other organizations and overseas investors are encouraged to invest in the construction, reconstruction and expansion of farmers' markets in various forms in accordance with the principle of "whoever invests benefits". Chapter II Market Planning and Construction Article 7 The special planning of farmers' markets is an important part of the planning of commercial outlets.

Part of it is included in the detailed planning of urban and rural control. The municipal administrative department of commerce shall, jointly with the planning, land and other relevant departments, be responsible for the preparation of the special plan for the farmers' market in the main city of Kunming, which shall be implemented after being approved by the Municipal People's government; The rest of the county (city) District People's government is responsible for organizing the preparation of the county (city) District farmers' market special planning. Article 8 The county (city) people's government and the administrative committees of the three development (holiday) areas, Chenggong New District and Airport Economic Zone shall, according to the special planning of the farmers' market, formulate the implementation plan for the planning and construction of the farmers' market in their respective areas and organize their implementation.

To formulate the implementation plan for the planning and construction of farmers' markets, the following provisions shall be met:

(a) in line with the special planning of farmers' markets and the standards for the construction of farmers' markets;

(two) the scale and location of the farmers' market should be adapted to the living population and geographical scope of the surrounding areas;

(three) the establishment of farmers' markets should facilitate people's lives and meet their needs;

(four) the layout of the farmers' market should be coordinated with other community commercial service facilities and adapt to the degree of economic and social development. Ninth new construction, renovation and expansion of farmers' markets shall conform to the special planning and construction standards of farmers' markets, and go through the relevant examination and approval procedures for planning, construction and land use in accordance with relevant regulations. Tenth construction of farmers' markets shall not occupy roads, highways or hinder traffic.

The farmer's market project supporting the new residential area or the transformation of the old city should be planned, constructed and delivered simultaneously with the main project. Eleventh farmers' market demolition should follow the principle of "demolishing one building" and "building first, then moving and then demolition". Twelfth farmers' markets are not allowed to change the nature of use without authorization. If it is really necessary to change the nature of use, the main city should be reported to the municipal administrative department of commerce for approval, and the remaining counties (cities) should be reported to the administrative department of commerce at the same level for approval. Thirteenth municipal administrative department of commerce in conjunction with industry and commerce, health, planning, construction, urban management, public security and other departments, combined with the national health city (county) standards and other related requirements, responsible for the development of Kunming farmers' market construction standards. Chapter III Opening of the Market Article 14 Operators of farmers' markets shall go through the registration formalities with the administrative department for industry and commerce according to law and obtain a business license. Fifteenth farmers market operators, should establish and improve the market management system, do a good job in the daily management of the market.

(a) signed a "farmer's market management responsibility book" with the management office of the farmer's market in the area, earnestly performed the duties of the market promoters, and implemented standardized management measures.

(2) Signing a site lease and management agreement with the operator to clarify the rights and obligations of both parties; The establishment of the operator's file records the basic situation and credit status of the operator.

(3) Set up a consumer complaint service station to seriously accept consumer complaints. The consumer complaint service station shall have a complaint telephone number and a supervision telephone number, and assist and cooperate with relevant functional departments to properly handle consumer complaints according to the specific circumstances of complaints.

(4) Urge the operators in the market to correctly use the national legal measuring units and qualified measuring instruments, register the measuring instruments subject to compulsory verification, and file them with the local quality and technical supervision department, and cooperate with the quality and technical supervision department and its designated legal metrological verification institutions to do compulsory verification; Set up a fair scale that meets the requirements, and regularly send it to the legal metrological verification institution for verification; Cooperate with the quality and technical supervision department to do a good job in the measurement supervision and management of quantitatively packaged goods and retail goods in the market; Supervise operators to clearly mark the prices of agricultural and sideline products sold.

(5) Establish and improve the publicity system, and set up publicity columns and publicity columns at the gate of the farmers' market and other obvious positions to publicize the basic and major issues related to the transaction to consumers, including: the license of operators, records of violations of laws and regulations, market management system (including the access system for agricultural and sideline products), consumer complaint telephone numbers, sampling results of agricultural and sideline products quality and safety, delisting of unqualified products, etc.

(six) to establish a special market service management organization, equipped with management personnel responsible for maintaining market order, environmental sanitation, food hygiene, public security management, fire safety, building safety, price, information publicity and maintenance of facilities and equipment; Establish a responsibility system for market managers, conduct regular training and wear uniform certificates.
