When accepting temporary entrustment to engage in judicial expertise, specially appointed judicial appraisers shall enjoy rights and assume obligations with reference to the provisions of judicial appraisers in the field of implementing professional qualification system. Article 8 The practice of judicial appraisers shall be registered. Article 9 A judicial appraiser shall practice in one judicial authentication institution, and may not practice in more than two judicial authentication institutions at the same time, but may accept the engagement of other judicial authentication institutions to engage in judicial authentication activities on specific matters.
A judicial appraiser may not accept entrustment or collect fees without permission. Article 10 The practice of judicial appraisers must abide by the provisions of laws, regulations and rules, the principles of scientificity, objectivity, independence and impartiality, and the professional ethics and practice discipline of judicial appraisers. Article 11 The practice of judicial appraisers must be supervised by the state, society and the parties concerned according to law. Article 12 The practice of judicial appraisers in accordance with the law is protected by state laws and is not subject to illegal interference by any unit or individual. Chapter II Management of Professional Qualifications Article 15 The professional qualifications of judicial appraisers are divided into different types according to the nature of appraisal business. Article 16 A unified national examination and assessment system shall be implemented for obtaining and granting professional qualifications of judicial appraisers. Seventeenth applications to participate in the professional qualification examination and assessment of judicial appraisers must meet the following basic conditions:
(a) support the constitution of People's Republic of China (PRC);
(2) Abide by state laws and social ethics and have good conduct;
(3) Having a bachelor's degree or above in judicial expertise training in institutions of higher learning recognized by the judicial administrative organ of the State Council, or a junior college degree or above in judicial expertise related majors in institutions of higher learning and having more than two years of professional practice experience.
Professional and technical personnel who have been engaged in judicial authentication in judicial authentication institutions and engaged in industrial authentication in industrial authentication institutions apply for professional qualifications of judicial authenticators, and they can be granted professional qualifications of judicial authenticators upon examination.
Specific examination and assessment methods shall be formulated separately. Eighteenth in any of the following circumstances, the professional qualification of judicial appraiser shall not be granted:
(1) Having received criminal punishment for intentional crime;
(2) Being expelled from public office;
(3) Having no capacity for civil conduct or limited capacity for conduct;
(four) other circumstances in which the professional qualification is not provided for by laws and regulations. Article 19 Where a judicial appraiser is defrauded of his professional qualification by fraud or other means, the judicial administrative organ that originally issued the certificate shall confirm that his professional qualification is invalid and make an announcement. Chapter III Administration of Practice Certificates Article 20 A person who has obtained the professional qualification certificate of a judicial appraiser shall apply to the judicial administrative organ of the people's government at or above the province, autonomous region or municipality directly under the Central Government with the consent of the judicial authentication institution to be practiced or designated.
The judicial administrative organs of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall, within 30 days from the date of receiving the application materials, make a decision on whether to issue the practice certificate of judicial appraisers, and notify the applicant in writing. Twenty-first in any of the following circumstances, the practice certificate of judicial appraiser shall not be issued:
(1) Having received criminal punishment for intentional crime;
(2) Being expelled from public office;
(3) Having no capacity for civil conduct or limited capacity for conduct;
(four) other circumstances in which the practice certificate is not issued as stipulated by laws and regulations. Twenty-second fraudulent means to defraud the judicial appraiser's practice certificate, the judicial administrative organ that originally issued the certificate shall confirm that his practice certificate is invalid and make an announcement.
