Regulations of Jiangxi Province on the Promotion of Private Education
Chapter I General Provisions Article 1 In order to promote the healthy development of private education and safeguard the legitimate rights and interests of private schools and educatees, these Regulations are formulated in accordance with the provisions of the Law on the Promotion of Private Education in People's Republic of China (PRC) and the Regulations on the Implementation of the Law on the Promotion of Private Education in People's Republic of China (PRC), in combination with the actual situation of this province. Article 2 Within the administrative area of this province, these Regulations shall apply to social organizations or individuals other than state institutions who use non-state financial funds to organize activities of private schools and other educational institutions (hereinafter referred to as private schools) facing the society. Article 3 Private education is a public welfare undertaking and an integral part of socialist education. Private schools and public schools have the same legal status.

People's governments at all levels shall incorporate private education into the national economic and social development plan, encourage, support and guide the development of private education, and ensure the autonomy of private schools. Article 4 Private schools shall abide by laws and regulations, implement the national education policy, ensure the quality of education, and devote themselves to cultivating all kinds of talents for socialist construction.

Private schools should implement the principle of separating education from religion. No organization or individual may use religion to carry out activities that hinder the national education system. Article 5 The administrative department of education of the people's governments at or above the county level shall be in charge of the work of private education within their respective administrative areas, and guide, serve, manage and supervise private schools according to law.

The administrative departments of labor and social security of the people's governments at or above the county level and other relevant departments shall be responsible for the relevant private education within their respective functions and duties. Chapter II Establishment Article 6 The establishment of private schools shall meet the needs of educational development and meet the conditions prescribed by laws and regulations.

The setting standards of private schools shall be implemented with reference to the setting standards of similar public schools at the same level. Article 7 The application for the establishment of a private school is divided into two stages: preparation and formal establishment. Those who have the conditions for running a school and meet the set standards may directly apply for formal preparation.

To apply for the preparatory establishment and formal establishment of a private school, the sponsor shall submit relevant materials to the examination and approval authority in accordance with the provisions of the Law of People's Republic of China (PRC) on the Promotion of Private Education. Article 8 The establishment of private schools shall be examined and approved in accordance with the following authorities:

(a) ordinary higher undergraduate, normal and pharmaceutical higher vocational colleges, in accordance with the relevant provisions of the state, reported to the education administrative department of the State Council for examination and approval;

(two) higher vocational colleges, non-academic institutions of higher education and ordinary secondary specialized schools other than normal and medical schools shall be examined and approved by the provincial people's government;

(three) higher education self-study examination institutions approved by the education administrative department of the provincial people's government;

(four) senior middle schools and vocational and adult secondary specialized schools shall be examined and approved by the administrative department of education of the Municipal People's government with districts;

(5) Junior middle schools shall be examined and approved by the education administrative department of the people's government at the county level, and cities divided into districts shall be examined and approved by the education administrative department of the people's government divided into districts;

(6) Primary schools are approved by the education administrative department of the people's government at the county level;

(7) Private schools and private technical schools mainly engaged in vocational qualification training and vocational skills training shall be examined and approved by the administrative department of labor and social security of the people's government at or above the county level in accordance with the authority prescribed by the state, and copied to the education administrative department at the same level for the record.

Private schools below secondary education in special categories such as sports and medicine shall be reported to the corresponding education administrative department for examination and approval after being examined and approved by the relevant departments in accordance with the authority prescribed by the state.

Overseas organizations and individuals cooperating in running schools in this province shall be examined and approved in accordance with the authority prescribed by the state.

Urban pre-school education schools shall be registered by the education administrative department of the Municipal People's Government with districts where they are located; Rural preschool education schools shall be registered by the township people's governments and reported to the education administrative departments of the people's governments at the county level for the record. Article 9 The examination and approval authority shall announce the examination and approval items, basis, conditions, procedures, time limit and the list of application materials to be submitted for the establishment of private schools according to law, and make a decision on examination and approval according to law within the statutory time limit. The application for the establishment of a multi-level school can be accepted by the high-level examination and approval authority and make a decision on examination and approval.

After the examination and approval authority makes the examination and approval decision, it shall serve the examination and approval decision on the applicant in written form. Agree to the establishment and issue a letter of approval for the establishment; If it does not agree to the establishment, it shall explain the reasons. If the formal establishment is approved, a school license shall be issued; If it is not approved, it shall explain the reasons. Article 10 The examination and approval authority shall announce the name, articles of association, address, school level, category, scale, enrollment scope and other information of formally established private schools to the public through government websites and other media. Chapter III Organization and Activities of Schools Article 11 Private schools shall set up school affairs committees, boards of directors or other forms of decision-making bodies according to law; Implement democratic management and supervision systems such as staff congresses and open school affairs; Improve the management system of teaching, scientific research, personnel, finance and safety. Twelfth private schools shall, in accordance with the relevant provisions of the state, establish a team of teachers suitable for their school-running level, scale and professional setting, and train backbone teachers and academic leaders according to the actual needs of teaching and scientific research.

Encourage private schools to introduce teachers and school management talents from outside the province. The relevant departments shall, in accordance with the relevant provisions, go through the formalities of registered permanent residence's migration and social insurance in time.
