Chapter I General Principles
Article 1 In order to effectively implement the supervision and management of power safety production, prevent and reduce power accidents, and ensure the safe and stable operation and reliable power supply of the power system, laws and regulations such as People's Republic of China (PRC) Law on Safety Production, People's Republic of China (PRC) Law on Emergency Response, Regulations on Electricity Supervision, Regulations on Reporting and Investigation of Production Safety Accidents, and Regulations on Emergency Disposal and Investigation and Handling of Power Safety Accidents are formulated. Article 2 These Measures shall apply to power enterprises in People's Republic of China (PRC) whose main business is power generation, transmission, power supply and power construction, and have obtained relevant business licenses or are exempted from obtaining power business licenses according to regulations. Article 3 The National Energy Administration and its dispatched offices shall supervise and manage the power operation safety (excluding nuclear safety), power construction safety, power engineering quality safety, power emergency, dam operation safety and power reliability of electric power enterprises in accordance with these Measures. Article 4 The principle of "safety first, prevention first and comprehensive management" shall be adhered to in the work of electric power production safety, and the working mechanism of specific responsibility, government supervision, industry self-discipline and social supervision shall be established. Article 5 Electric power enterprises are the main body responsible for the safe production of electric power. We should follow the laws, regulations, systems and standards of the state on safety production, establish and improve the responsibility system for safety production of electric power, strengthen the management of safety production of electric power, improve the conditions for safety production of electric power, and ensure safety production of electric power. Article 6 Any unit or individual has the right to complain and report to the National Energy Administration and its dispatched offices for acts that violate these Measures and the relevant provisions of the State on the supervision and administration of electric power production safety, and the National Energy Administration and its dispatched offices shall handle them according to law.
Chapter II Responsibility for Safety in Production of Electric Power Enterprises
Article 7 The principal responsible person of an electric power enterprise shall be fully responsible for the safety production of his own unit. Employees of electric power enterprises shall fulfill their obligations of safe production according to law. Article 8 An electric power enterprise shall perform the following basic duties of electric power safety production management: (1) To formulate and implement its own electric power safety production management system and rules and regulations in accordance with national safety production laws, regulations, systems and standards; (two) to establish and improve the power production safety guarantee system and supervision system, and implement the responsibility for production safety; (three) in accordance with the relevant laws and regulations of the state to set up safety production management institutions, equipped with full-time safety management personnel; (four) in accordance with the provisions of the extraction and use of electricity safety production costs, earmarked for improving the conditions for safe production; (five) in accordance with the relevant provisions, establish and improve the system of investigation and management of hidden dangers in power safety production and risk pre-control, carry out hidden dangers investigation and risk identification, evaluation and monitoring, and manage and control hidden dangers and risks; (six) to carry out the standardization of power safety production; (seven) to carry out the publicity and education of electric power safety production training, and to be responsible for the safety training of employees focusing on team leaders, new workers and migrant workers; (eight) to carry out power reliability management, establish and improve the power reliability management system, and submit the power reliability information accurately, timely and completely; (nine) the establishment of electric power emergency management system, improve the coordination and linkage mechanism, formulate emergency plans at all levels and carry out emergency drills, build emergency rescue teams, and improve the emergency material reserve system; (ten) in accordance with the provisions of the report of power accidents and power safety incident information and timely emergency treatment, investigation and handling of power safety incidents. Ninth power generation enterprises shall, in accordance with the provisions of dam safety registration, regularly carry out dam safety inspection and information construction; Carry out safety filing for ash storage yard of coal-fired power plant, and carry out safety inspection and regular safety assessment. Article 10 An electric power construction unit shall assume overall management responsibility for the construction safety and engineering quality safety of electric power construction projects, perform the duties of project organization, coordination and supervision, file the safety production management of electric power projects with local agencies in accordance with regulations, and apply to the relevant electric power engineering quality supervision institutions for engineering quality supervision and registration. Eleventh power supply enterprises should cooperate with the local government to provide technical guidance for the safe use of electricity by power users.
Chapter III Safety of Power System
Article 12 Electric power enterprises shall jointly safeguard the safe and stable operation of the power system. In the process of power grid interconnection and generator grid connection, the safety responsibility should be strictly fulfilled, and it should be clearly defined in the joint (parallel) network dispatching agreement between the two parties, and the joint (parallel) network and network solution should not be carried out without authorization. Thirteenth power dispatching institutions at all levels are the command institutions to deal with power safety accidents (incidents). When an electric power safety accident (incident) occurs or the safety of the power system is endangered, the electric power dispatching institution has the right to take necessary emergency measures, and the relevant electric power enterprises shall strictly implement the dispatching instructions. Article 14 The power dispatching institution shall strengthen the management of safe and stable operation of the power system, scientifically and reasonably arrange the operation mode of the system, carry out safety analysis and evaluation of the power system, and coordinate the safety of the power grid and the safety of grid-connected units. Article 15 Electric power enterprises should strengthen the safety management and technical management of power generation equipment and facilities, transmission and distribution equipment and facilities, strengthen the professional management of power monitoring system (or equipment), improve the performance of frequency modulation, peak regulation, voltage regulation, phase modulation and emergency standby of power system, and meet the needs of safe and stable operation of power system. Sixteenth generator sets, wind farms and photovoltaic power stations shall meet the relevant technical standards and meet the relevant safety requirements for power grid operation. Article 17 Electric power enterprises shall, in accordance with relevant state regulations and standards, formulate, improve and implement safety technical measures, anti-accident measures and emergency plans to prevent large-scale power grid blackouts, and establish and improve emergency coordination and linkage mechanisms with the National Energy Administration and its dispatched offices, local people's governments and power users.
Chapter IV Supervision and Administration of Electric Power Safety Production
Article 18 The National Energy Administration shall be responsible for the supervision and administration of safe production of electric power throughout the country according to law. The dispatched office of the National Energy Administration (hereinafter referred to as the "dispatched office") shall be responsible for the supervision and management of power safety production within its jurisdiction in accordance with the principle of territorial management. Involving cross-regional supervision and management of power safety production, the National Energy Administration is responsible for or coordinates to determine the specific responsible regional institutions; Inter-provincial power production safety supervision and management in the same area shall be the responsibility of local regional institutions or coordinate to determine specific provincial institutions. Safety production supervision and management of small hydropower stations below 50 MW shall be implemented in accordance with relevant regulations. The grid-connected safety of small hydropower stations below 50 MW shall be supervised and managed by dispatched institutions. Article 19 The National Energy Administration and its dispatched offices shall take various forms to strengthen the publicity of laws, regulations, systems and standards related to production safety, convey the national requirements related to production safety to electric power enterprises, and raise the awareness of employees about production safety. Twentieth National Energy Administration and its dispatched offices shall establish and improve the coordination mechanism of safety production in the power industry, and coordinate and solve major problems existing in the supervision and management of safety production in a timely manner. Article 21 The National Energy Administration and its dispatched offices shall supervise and inspect the implementation of laws, regulations, standards and norms related to safety production by electric power enterprises according to law. The National Energy Administration organized and carried out a nationwide inspection of electric power safety production, formulated an inspection work plan, and conducted key inspections on key areas, important electric power enterprises and key links. The dispatched offices shall organize the inspection of power safety production within their respective jurisdictions, and conduct spot checks on some power enterprises. Article 22 The National Energy Administration and its dispatched offices shall order electric power enterprises to make corrections on the spot or make rectification within a time limit for violations of laws and regulations in production safety found in on-site inspections. Major safety hazards found in on-site inspection shall be ordered to be rectified immediately; When potential safety hazards endanger personal safety, people shall be ordered to evacuate from the dangerous area immediately. Article 23 The National Energy Administration and its dispatched offices shall supervise and guide the investigation and management of hidden dangers in electric power enterprises, and supervise major security risks in accordance with relevant regulations. Article 24 The National Energy Administration and its dispatched offices shall make statistical analysis on the information of safe production of electric power, and publish it to the public regularly. According to the needs of work, power enterprises may be required to submit documents, materials, drawings, audio or video recordings and related data related to power safety production. The National Energy Administration and its dispatched offices shall promptly correct and deal with irregularities such as fraud in the information submitted by electric power enterprises. Article 25 The National Energy Administration and its dispatched offices shall organize or participate in the investigation and handling of power accidents according to law. The National Energy Administration organizes or participates in the investigation and handling of major and particularly major power accidents; Supervise the power safety events with great social impact. The dispatched institutions organize or participate in the investigation and handling of large and general power accidents, and organize special supervision on power safety incidents that have a great impact on the safe and stable operation of the power system or society. Article 26 The National Energy Administration and its dispatched offices shall organize the implementation of electric power emergency management according to law. The National Energy Administration is responsible for formulating the development plan of power emergency system and the national special emergency plan for large-scale power outage, and carrying out emergency treatment, analysis and evaluation of major power emergencies. The dispatched office shall, in accordance with the prescribed authority and procedures, organize, coordinate and guide the emergency handling of power emergencies. Twenty-seventh National Energy Administration and its dispatched offices shall organize and carry out power safety training and publicity and education. Twenty-eighth National Energy Administration and its dispatched offices shall cooperate with the relevant departments of local governments and relevant industry management departments to supervise and manage the safe use of electricity, power supply configuration and self-provided emergency power supply for important power users. Twenty-ninth National Energy Administration and its dispatched offices shall establish a safety production reporting system, publicly report telephone numbers, mailboxes and e-mails, and accept reports on power safety production; After the accepted report is verified, the electric power enterprises with serious violations will be announced to the public.
Chapter V Punishment Rules
Article 30 If an electric power enterprise causes an electric power accident, it shall bear corresponding legal responsibilities in accordance with the Regulations on Reporting, Investigation and Handling of Production Safety Accidents and the Regulations on Emergency Disposal and Investigation and Handling of Electric Power Safety Accidents. Article 31 If the personnel of the National Energy Administration and its dispatched offices engaged in the supervision and administration of electric power safety production abuse their powers, neglect their duties or engage in malpractices for selfish ends, they shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated by judicial organs according to law. Thirty-second National Energy Administration and its dispatched offices may interview the main person in charge of the electric power enterprise or the person in charge of production safety when they find that the electric power enterprise violates the provisions of these measures through on-site inspection. If the circumstances are serious, it may be required to stop work for rectification according to Article 90 of the Safety Production Law, and the power generation enterprise may be required to suspend grid-connected operation. Thirty-third power enterprises in violation of the provisions of these measures, the National Energy Administration and its dispatched offices can inform the industry of their illegal acts, and announce to the public the handling of the behavior that affects the safe and reliable power supply of power users. Article 34 After an electric power enterprise has an electric power safety accident, the National Energy Administration and its dispatched offices may order it to make corrections within a time limit under any of the following circumstances. If it fails to make corrections within the time limit, it will be included in the "blacklist" of bad credit records and safety production integrity, and a fine of less than 654.38 million yuan will be imposed: (1) delaying, omitting, making false reports or concealing power safety incidents; (2) Failing to organize emergency response in time; (three) failing to investigate and deal with power safety accidents according to regulations. Article 35 If an electric power enterprise fails to fulfill the provisions of Article 8 of these Measures, the National Energy Administration and its dispatched offices shall order it to make rectification within a time limit; Overdue rectification, give a warning to the main person in charge of the power enterprise; If the circumstances are serious, the National Energy Administration and its dispatched offices will impose a fine of 1 000 yuan on the main person in charge of the electric power enterprise. Thirty-sixth power enterprises in any of the following circumstances, the National Energy Administration and its dispatched offices shall be ordered to make corrections within a time limit; If it fails to make corrections within the time limit, the National Energy Administration and its dispatched offices will be fined between 50,000 yuan and 500,000 yuan according to Article 34 of the Regulation on Electric Power Supervision, and will be included in the "blacklist" of bad credit records of safety production and integrity of safety production: (1) refusing or obstructing the personnel engaged in supervision and management of the National Energy Administration and its dispatched offices from performing their duties of supervision and management of electric power safety production according to law; (2) Providing documents and materials that are false or conceal important facts to the National Energy Administration and its dispatched offices.
Chapter VI Supplementary Provisions
Article 37 The meaning of the following terms in these Measures: (1) Power system refers to the system of electric energy production, transmission and distribution, which consists of power generation, transmission, transformation, distribution and power dispatching. (2) Electric power accidents refer to accidents that occur in the process of electric power production and construction, such as personal injury or death, damage to power generation equipment or power transmission and transformation equipment and facilities, and direct economic losses. (3) An electric power safety incident refers to an incident that does not constitute an electric power safety accident, but affects the normal supply of electric power (heat), or poses a threat to the safe and stable operation of the electric power system, which may lead to an electric power safety accident or cause significant social impact. (4) Major safety hazards refer to accidents that may cause more than average personal injuries and deaths, power safety accidents, power equipment accidents with direct economic losses of more than 6,543,800 yuan, and other hidden dangers that have a great impact on society.
