Legal Analysis: The Education Law of the People's Republic of China stipulates that the state, enterprises, institutions, social organizations, other social organizations and individual citizens have the right to establish schools and other educational institutions, that is, the organizers can be divided into two categories: state and social forces according to the different subjects of rights, and educational and training institutions belong to social forces. Article 2 of China's Private Education Promotion Law clearly gives social organizations or individuals the right to receive social education. The right subject of education and training institutions is the interest groups or individuals of non-governmental organizations, and the source of education funds mainly depends on the investment, donation, fund-raising and lending of social organizations and individuals, rather than the investment of state finance in education. Judging from the identity of its organizers, most of them are legal person organizations established according to law.

Legal basis: Article 11 of the Law of People's Republic of China (PRC) on the Promotion of Private Education establishes private schools in People's Republic of China (PRC) that carry out academic education, preschool education, self-study exams and other cultural education. The administrative department of education of the people's government at or above the county level shall examine and approve the implementation of vocational qualification training and vocational skills training for private schools, and the administrative department of labor and social security of the people's government at or above the county level shall examine and approve them according to the authority prescribed by the state, and send a copy to the administrative department of education at the same level for the record.

Article 11 of the Regulations on the Implementation of the Law on the Promotion of Private Education in People's Republic of China (PRC) shall be governed by relevant laws and regulations.
