The specific scope of special equipment shall be in accordance with the provisions of laws and administrative regulations.
The production of special equipment as mentioned in these Regulations includes design, manufacture, installation, repair, transformation, mobile pressure vessels and gas cylinder filling. Article 3 The municipal and district people's governments (hereinafter referred to as municipal and district governments) shall strengthen their leadership over the safety and energy conservation of special equipment, and guide, supervise and support the safety supervision and management departments of special equipment to perform their duties of safety supervision and management according to law; Increase investment, encourage the use of advanced technology, implement scientific management methods, and improve the safety and energy-saving management level of special equipment.
Sub-district offices shall include special equipment in the scope of safety production inspection and assist in the safety supervision and management of special equipment. Article 4 The municipal special equipment safety supervision and management department and its dispatched offices (hereinafter referred to as the special equipment safety supervision department) shall perform the duties of special equipment safety supervision and management in accordance with the provisions of these Regulations. The agency of the municipal special equipment safety supervision department may make specific administrative acts in its own name.
The installation of elevators on the construction site and the installation and use of hoisting machinery and special motor vehicles in the field (factory) used on the construction site shall be supervised and managed by the administrative department responsible for safety supervision and management on the construction site in accordance with relevant laws and regulations.
Municipal gas pipelines and long-distance natural gas pipelines that have been put into operation shall be supervised and managed by the construction administrative department in accordance with relevant laws and regulations.
Other relevant departments and institutions of the municipal and district governments shall, in accordance with their respective responsibilities, do a good job in the safety supervision and management of special equipment according to law. Article 5 Units producing and using special equipment shall fulfill the responsibility of safety and energy saving of special equipment and ensure the necessary investment in safety and energy saving. Article 6 Inspection and testing institutions and their relevant personnel shall independently carry out inspection and testing according to law, ensure the objectivity and accuracy of inspection and testing, and be responsible for their inspection and testing conclusions. No unit or individual may illegally interfere. Seventh special equipment industry associations should establish industry self-discipline mechanism, promote the construction of industry credit system, provide industry-related services such as training, publicity, evaluation and consultation, strengthen industry exchanges, and promote the healthy development of the industry.
The municipal and district governments shall support the special equipment industry associations to carry out related activities. Article 8 Any unit or individual may report to the safety supervision department of special equipment and other relevant departments if it finds that there are potential safety hazards or illegal acts involving the safety of special equipment.
The department that receives the report or report shall promptly organize the investigation and handling.
The safety supervision department of special equipment shall publish the telephone number and e-mail address of the report. Ninth special equipment production, sales, use, inspection and testing units shall purchase special equipment safety liability insurance in accordance with state regulations. Chapter II Production and Sales of Special Equipment Article 10 A production unit of special equipment (hereinafter referred to as the production unit) shall abide by the following provisions when engaging in production activities:
(1) Obtaining an administrative license according to law;
(two) the time limit, scope and conditions that meet the requirements of the administrative license;
(3) Conforming to the provisions of safety technical specifications;
(4) Before starting the licensing business for the first time, it shall inform the safety supervision department of special equipment in writing or in the form of data messages (hereinafter referred to as written notification);
(five) if the main information such as the scope of administrative license, the address of the unit and the main person in charge changes, it shall inform the safety supervision department of special equipment in writing within five working days from the date of change. Article 11 The quality, safety performance and energy efficiency indicators of special equipment and related products manufactured by special equipment manufacturing units (hereinafter referred to as manufacturing units) shall meet the requirements of safety technical specifications and related standards, and comply with the following provisions:
(a) shall not manufacture special equipment and related products explicitly eliminated or prohibited by the state;
(two) the manufacturing unit of large amusement facilities and passenger ropeways shall provide factory documents, maintenance instructions and technical guidance documents for emergency treatment;
(three) the manufacturing unit of large amusement facilities and passenger ropeways shall indicate the service life of the whole machine and important parts on the carrier such as factory materials and nameplates. Article 12 Where special equipment has defects that may endanger personal and property safety and identity, the production unit shall immediately stop production from the day when it is discovered or should have known, and the products already produced shall not be delivered for use, and the relevant product defects shall be announced to the public, and the users, sales units and other relevant units shall be notified in time to eliminate the product defects by means of return, replacement or repair. Thirteenth special equipment installation, repair, renovation construction unit (hereinafter referred to as the construction unit) is responsible for its construction quality and its impact on the safety performance and energy efficiency of special equipment, bear the responsibility of safety management in the construction process, and abide by the following provisions:
(a) shall not use materials, components, components and accessories that do not meet the mandatory requirements;
(2) Inform the safety supervision department of special equipment in writing before construction. In case of any change in the matters notified, it shall notify the safety supervision department of special equipment in writing within three working days from the date of change;
(3) Record the construction process and file it;
(four) special equipment without supervision and inspection shall not be delivered for use;
(five) within thirty days from the date of supervision and inspection, the relevant technical data of special equipment shall be handed over to the user.
The construction unit shall not install special equipment and related products that have not obtained the production license, are eliminated by the state, are prohibited from manufacturing, and are forced to be scrapped.
