Article 1 In order to strengthen and standardize the prevention of duty crimes, effectively prevent duty crimes and promote the building of a clean government, these Regulations are formulated in accordance with the provisions of the Constitution and relevant laws and regulations and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to the prevention of duty crimes within the administrative area of this Municipality. Article 3 The term "duty crime" as mentioned in these Regulations refers to the crime of corruption and bribery by state functionaries, the crime of dereliction of duty by state functionaries, the crime of violating citizens' personal rights and democratic rights by taking advantage of their powers, and other major crimes committed by state functionaries by taking advantage of their powers. Article 4 To prevent duty crimes, we should start from the source, base ourselves on education, improve the system, strictly manage and strengthen supervision, and prevent and correct the acts of state functionaries who do not perform their duties according to law and are not honest. Article 5 The prevention of duty crimes should combine the rule of law with the rule of virtue, special prevention with social prevention, special work with mass work, mobilize all social forces, and implement comprehensive management by political, economic, cultural, educational, administrative and legal means. Article 6 The prevention of duty crimes shall abide by the laws and regulations of the state and safeguard the normal work, production and business activities of state organs, state-owned companies, enterprises, institutions and people's organizations. Article 7 State organs, state-owned companies, enterprises, institutions and people's organizations shall incorporate the prevention of duty crimes into the target management of socialist spiritual civilization construction and popularization of legal knowledge education in their own units, and seriously organize the implementation, inspection and assessment.

State organs, state-owned companies, enterprises, institutions and people's organizations shall establish a responsibility system for preventing duty crimes, implement the principle of combining collective leadership with individual division of responsibilities, and whoever is in charge shall be responsible, and deploy, implement, check and assess them together with their professional work. Article 8 State organs, state-owned companies, enterprises, institutions and people's organizations shall perform their respective duties, cooperate closely, and establish a linkage mechanism of education, management, supervision and punishment for the prevention of duty crimes.

Judicial organs, supervision, auditing, personnel, finance, news, culture, publishing and other relevant departments shall establish a joint conference system for the prevention of duty crimes, exchange information and strengthen work contact and coordination. Article 9 Procuratorial organs shall perform their legal supervision functions according to law and organize and coordinate the prevention of duty crimes.

The duty of the procuratorial organ to prevent duty crimes is:

(a) in conjunction with the relevant departments to formulate plans to prevent job-related crimes;

(two) responsible for the daily work of the joint meeting, to guide the prevention of duty crimes;

(three) to investigate and analyze the causes, characteristics and laws of duty crimes in this area;

(4) Summarizing and popularizing the experience of preventing duty crimes, and establishing and commending advanced models;

(five) in conjunction with the relevant departments to check and prevent job-related crimes. Article 10 When the supervisory and auditing organs perform their supervisory duties according to law, they shall promptly transfer the suspected duty crimes to the procuratorial organs; Put forward supervision suggestions and audit opinions on units with imperfect systems and irregular management, and urge rectification. The relevant units should seriously rectify and timely feedback the rectification situation. Eleventh news, culture, publishing units should use various forms of publicity to prevent job-related crimes, and supervise the job behavior of state functionaries by public opinion. Article 12 The people's government and its functional departments shall administer according to law, strictly govern the government and make government affairs public.

When making decisions on major issues such as economy and society, measures to prevent duty crimes should be formulated at the same time and organized for implementation.

To exercise the power of administrative examination and approval, we should standardize the examination and approval items, procedures and results according to law and accept social supervision.

Government procurement should follow the principles of openness, fairness, justice and efficiency, establish and improve the supervision and restriction mechanism, and ensure the integrity of government procurement. Thirteenth judicial organs shall perform their duties according to law, strengthen and improve the supervision and restriction mechanism, open trials, procuratorial work and police affairs, enforce the law impartially, be honest and efficient, ensure judicial justice and prevent duty crimes. Fourteenth state-owned companies, enterprises and institutions should establish and improve various management systems, and strengthen the management and supervision of senior managers and personnel in important positions such as finance, supply and sales.

State-owned companies, enterprises and institutions shall not appoint or employ persons with bad records such as criminal punishment as legal representatives, financial directors, chief financial officers and accountants in violation of laws and regulations such as companies, accountants and securities. Article 15 State functionaries shall abide by the Constitution, laws and regulations, consciously accept supervision and guard against duty crimes. Article 16 State functionaries shall not take advantage of their positions to defile the integrity of their positions and infringe upon the ownership of public and private property.

State functionaries shall not engage in malpractices for selfish ends, abuse their powers, neglect their duties, or interfere with the normal activities of state organs; Shall not use their powers to infringe upon citizens' personal rights and democratic rights. Article 17 State functionaries and other citizens have the right to make suggestions on the prevention of duty crimes, and have the right to criticize the imperfect system and chaotic management of their own units. The relevant units shall study and deal with the suggestions or criticisms. Eighteenth state organs, state-owned companies, enterprises and institutions, people's organizations should incorporate the education of duty crime prevention into the training plan, and strengthen the legal education, moral education and duty crime prevention education for state staff.

The employing unit shall incorporate the job code of conduct and the education on duty crime prevention into the probation training and on-the-job training of state staff.
