(1) In the national vocational qualification catalogue published by Ministry of Human Resources and Social Security in February 2065438+2006, both fire facility operators and registered fire engineers are listed as the access professional qualifications; Firefighters belong to skilled personnel with professional qualification rating.

(II) On September 2, 20 17, 12, Ministry of Human Resources and Social Security issued the Notice on Publishing the Catalogue of National Vocational Qualifications (Ministry of Human Resources and Social Security Fa [2065438+07] No.68), and the operators of fire control facilities belong to the professional qualifications of skilled personnel with access. The Notice on Promulgating the Catalogue of National Vocational Qualifications points out that the occupations (jobs) involved in the establishment of access to vocational qualifications must be related to public interests or national security, public safety, personal health and safety of life and property, and must be based on laws and regulations or the State Council decisions.

(III) On October 29th, 20 17 10, the General Office of the State Council issued the Measures for the Implementation of the Responsibility System for Fire Safety (Guo Ban Fa [2017] No.87), in which Article 15 stipulates that organs, organizations, enterprises, institutions and other units shall implement the main responsibility for fire safety and perform the following duties. If there is a fire control room, a 24-hour duty system shall be implemented, with no less than 2 people in each shift and certificates. Key fire safety units and high-risk fire units should also actively apply technologies and physical prevention measures such as remote fire monitoring, electrical fire monitoring and Internet of Things technology.

Article 20 of the Measures for the Implementation of the Responsibility System for Fire Control Safety stipulates that fire control technical service institutions and employees such as detection, maintenance, fire control safety assessment, consultation and monitoring of fire control facilities shall obtain corresponding qualifications according to law, provide fire control safety technical services according to law, and be responsible for the service quality.

Three, the local fire laws and regulations on the provisions of the building (structure) firefighters certified.

Article 35 of the Regulations on Fire Protection in Hubei Province requires that the fire safety management personnel, full-time fire brigade members, automatic fire control system operators and fire control facilities and equipment inspection and maintenance personnel of key fire safety units shall be qualified by professional skills appraisal in the fire protection industry and hold relevant certificates. Article 67 stipulates that if the relevant fire-fighting practitioners fail to pass the professional skill appraisal of the fire-fighting industry and hold posts with certificates, the fire department of the public security organ shall order the employer to make corrections within a time limit; If no correction is made within the time limit, a fine of 1000 yuan or more 1000 yuan or less will be imposed.

Article 31 of Zhejiang Fire Protection Regulations stipulates that the fire control room shall be on duty 24 hours a day, and the personnel on duty shall hold the professional qualification certificate of fire protection, master the procedures and methods of fire alarm handling and starting fire control facilities and equipment, and ensure the timely detection and accurate handling of fire and fault alarms.

Article 40 of the Regulations on Fire Protection in Henan Province stipulates that the operator of automatic fire protection system shall obtain the professional qualification certificate of fire protection before taking up his post.

Article 37 of the Regulations on Fire Protection in Heilongjiang Province stipulates that the personnel who implement the professional qualification system for special types of work in the fire protection industry shall carry out professional skill appraisal and obtain professional qualification certificates before taking up their posts.

Article 29 of the Regulations on Fire Protection in Jiangsu Province stipulates that full-time firefighters engaged in fire fighting and emergency rescue work and relevant fire-fighting employees engaged in building fire prevention work shall obtain the qualification of special occupation (type of work) in the fire-fighting industry in accordance with state regulations; Encourage other fire practitioners to obtain professional (job) qualifications unique to the fire protection industry. Article 48 Whether the operators of automatic fire-fighting systems have obtained the corresponding professional qualification certificates in accordance with the regulations is one of the conditions for putting public gathering places into use and applying to the fire-fighting institutions of public security organs for fire safety inspection before opening.

Article 24 of the Regulations on Fire Protection in Hebei Province stipulates: operators and managers of automatic fire protection systems; Personnel engaged in electric welding, gas welding and other operations with fire hazards; Employees of fire control technical service institutions shall be certified by professional skills and obtain professional qualifications before taking up their posts.

Article 80 of the Regulations on Fire Control in Beijing stipulates: "If the personnel on duty in the fire control room of the unit violate the operating rules of the state and the city's fire control room without authorization, or if the unit fails to provide special training for the personnel in key positions such as fire equipment operation control personnel and full-time and part-time firefighters, it shall be ordered to make corrections and may be fined not less than 5,000 yuan in 500 yuan."

Article 31 of the Fire Protection Regulations of Gansu Province regards the professional qualification certificate of the operators of automatic fire protection system as one of the conditions for public gathering places to apply to the fire control institutions of public security organs for fire safety inspection before putting into use or business. The personnel of special types of work specified in Article 59 who fail to obtain corresponding professional qualification certificates according to law shall be ordered to make corrections; If no correction is made within the time limit, the directly responsible person in charge and other directly responsible personnel shall be punished according to law or given a warning.

Article 34 of the Regulations on Fire Protection in Guizhou Province stipulates that if the state implements the vocational qualification certificate system, it shall also obtain the vocational qualification certificate issued by the relevant industry administrative department. Article 52 stipulates that those who use personnel who have not been trained by professional fire training institutions or have not obtained professional qualification certificates shall be ordered to make corrections within a time limit, and those who fail to make corrections within the time limit shall be fined from 65,438 yuan to 0,000 yuan to 5,000 yuan.

Article 40 of the Regulations on Fire Protection in Hainan Province stipulates that employees in special occupations (jobs) in the fire protection industry shall obtain professional qualification certificates according to law and hold relevant certificates. Those who have not obtained the professional qualification certificate shall be ordered to make corrections, and the unit shall be fined 1000 yuan or more 1000 yuan or less (Article 65).

Article 42 of the Regulations on Fire Protection in Qinghai Province stipulates that fire engineering construction personnel, operators of automatic fire control facilities and employees of fire control technical service institutions shall obtain corresponding professional qualification certificates before taking up their posts.

Article 24 of the Regulations on Fire Protection in Shandong Province regards the professional qualification certificate of the operators of automatic fire protection system as one of the conditions for public gathering places to apply to the fire control institutions of public security organs for fire safety inspection before putting into use or business. Twenty-ninth units of the following personnel should receive professional skills training in fire control: fire inspection and inspection personnel; Automatic fire fighting system operator; Fire facilities inspection and maintenance personnel; Firefighters of full-time fire brigades and volunteer fire brigades shall obtain professional qualification certificates recognized by the state and hold relevant certificates. Automatic fire control system operators do not have the corresponding professional qualifications or automatic fire control system personnel do not reach the required number, shall be ordered to make corrections within a time limit; If no correction is made within the time limit, a fine of not less than 5,000 yuan but not more than 50,000 yuan shall be imposed (Article 70).

Article 19 of the Shaanxi Provincial Fire Protection Regulations regards the professional qualification certificate of the operators of automatic fire protection systems as one of the conditions for public gathering places to apply for fire safety inspection to the fire control institutions of public security organs before they are put into use or business. Article 26 stipulates that employees of fire technical service institutions shall have corresponding technical titles and professional qualification certificates. Those who work at their posts without obtaining a professional qualification certificate shall be ordered to make corrections, and the unit shall be fined 1000 yuan or more 1 10,000 yuan or less (Article 65).

Article 18 of Sichuan Fire Protection Regulations: fire safety management personnel, full-time and part-time firefighters and personnel on duty in the fire control room; Fire engineering construction management personnel, fire facilities installation, maintenance and operation personnel; Employees of fire technical service institutions shall be qualified by the national vocational skills appraisal and obtain fire professional qualifications according to law. Relevant personnel who have not passed the professional fire safety training or obtained the corresponding fire professional qualification shall be ordered to correct or stop the illegal act, and the individual shall be given a warning or a fine of not more than 500 yuan; A fine of not less than 1,000 yuan but not more than 10,000 yuan shall be imposed on the unit (Article 70).

Article 35 of the Regulations on Fire Protection in Yunnan Province: Employees listed in the fire protection industry's unique jobs or the national fire protection professional standards promulgated by the state shall not take up their posts until they have passed the professional skills appraisal in the fire protection industry. Where an employer uses employees who fail to pass the professional skill appraisal or fire safety examination in the fire fighting industry in accordance with the regulations, and a fire fighting technical service institution uses personnel who do not have the corresponding technical titles and professional qualifications to engage in fire fighting technical service activities, it shall be ordered to make corrections, and a fine of not less than 5,000 yuan from 500 yuan shall be imposed (Article 56).

Article 34 of the Regulations on Fire Protection in Liaoning Province stipulates that full-time firefighters shall receive training and obtain corresponding fire protection professional skills certificates.

Article 39 of the Regulations on Fire Protection in Inner Mongolia Autonomous Region stipulates that fire-fighting technical service institutions such as fire-fighting facilities inspection, fire-fighting equipment maintenance and fire-fighting safety monitoring and their employees shall obtain fire-fighting professional qualification certificates according to law.

Article 35 of the Fire Protection Regulations of Xizang Autonomous Region stipulates that the following personnel engaged in special fire protection work shall be trained by a fire safety professional training institution established according to law and obtain corresponding professional qualifications: (1) employees engaged in fire product quality certification, fire facilities inspection and fire safety monitoring; (two) the supervision, operation and maintenance personnel of the automatic fire fighting system; (3) full-time firefighters; (4) Other personnel as prescribed by laws and regulations. Units shall employ persons with corresponding professional qualifications to engage in special fire control work. Those who employ persons who have not obtained the professional qualification of fire fighting to engage in special fire fighting work shall be ordered to make corrections, and the unit shall be fined more than 1000 yuan 1000 yuan (Article 77).

Article 47 of the Regulations on Fire Control in Xinjiang Uygur Autonomous Region stipulates that the inspection and maintenance personnel of fire control facilities, the operators of automatic fire control systems and full-time firefighters shall obtain professional qualifications for fire control according to law. Failing to arrange operators to be on duty in the fire control room or using personnel who have not obtained fire professional qualifications, it shall be ordered to make corrections within a time limit; If no correction is made within the time limit, a fine of not less than one thousand yuan but not more than ten thousand yuan shall be imposed; Personnel on duty who leave their posts without authorization shall be fined more than 500 yuan 1000 yuan (Article 70).
