The other is that labor service companies and intermediary organizations recruit employees and send them to other companies to work. That is, the employee's labor relationship is in the labor service company, and the labor contract is signed directly with the labor service company. The actual employer only pays wages and is not responsible for personnel management.

Mode of labor distribution

Enterprises engaged in labor dispatch must obtain the permission of the Ministry of Commerce, obtain the qualification of foreign labor cooperation in accordance with these Measures, and receive the People's Republic of China (PRC) Foreign Labor Cooperation Qualification Certificate (hereinafter referred to as the Qualification Certificate) before they can carry out foreign labor cooperation activities. Overseas enterprises, natural persons and foreign institutions in China are not allowed to directly recruit workers in China.

Working procedures: people fill in the application form for workers and make an appointment for registration. The dispatching company is responsible for arranging the employer to interview the workers, or recommending the personal data retained by the applicant to the employer for selection. The dispatching company signs a labor contract with the employing unit, and the employing unit sends an invitation letter to the employed person, and the employed person submits the relevant materials required for handling the formalities, and the workers receive exit training.
