In any of the following circumstances, the company may arrange for employees to wait for their posts:
1, unable to work in this position;
2. The annual performance appraisal is unqualified;
3. Party B seriously violates the company system, but does not meet the conditions for dissolving the labor contract;
4. Dereliction of duty, causing direct economic losses of more than 50,000 yuan to the company;
5. Violate the company's labor discipline, disobey management or disobey the work arrangement of the department;
6. Other circumstances that lead to being off duty.
Employees awaiting approval process
If there is any employee waiting for work, the department will evaluate and report it according to the actual situation, and wait for work after approval by the general manager. The specific process is as follows:
1, the head of the department evaluates the work of the personnel who need to be on standby, puts forward written opinions and reports them to the leaders in charge for approval, and reports them to the administrative comprehensive department;
2. The General Administration Department investigates and verifies the working conditions of the waiting staff according to the opinions of the department, and issues a written investigation opinion to the general manager;
3. After being approved by the general manager, the General Administration Department will issue a waiting notice to the waiting employees. After receiving the notice, the staff waiting for the post shall go through the handover formalities on the same day and report to the administrative comprehensive department after leaving their original posts;
4. After the waiting notice is issued, employees who refuse to accept the waiting arrangement shall be treated as absenteeism from the day of waiting.
Treatment of waiting personnel
1. The waiting period of employees shall not exceed three months. Only post salary is paid during the waiting period, and performance salary and post subsidy are not enjoyed;
2. If the post-waiting personnel fail to take up their posts smoothly after training, their post-waiting salary will be paid according to the standard of 80% of the original post salary;
3. During the employee's waiting period, social security and other welfare benefits shall be implemented according to the unified regulations of the company.
Legal basis: Article 39 of the Labor Contract Law: In any of the following circumstances, the employer may terminate the labor contract:
(a) during the probation period, it is proved that it does not meet the employment conditions;
(two) a serious violation of the rules and regulations of the employer;
(three) serious dereliction of duty, corruption, causing great damage to the employer;
(4) The laborer establishes labor relations with other employers at the same time, which has a serious impact on the completion of the work tasks of the unit, or the employer refuses to correct it;
(5) The labor contract is invalid due to the circumstances specified in Item 1 of Paragraph 1 of Article 26 of this Law; (6) Being investigated for criminal responsibility according to law.
