Chapter I General Provisions
Article 1 In order to standardize the collection and management of special funds for the development of film industry in Jiangsu Province, improve the performance of funds and support the high-quality development of films in our province, according to the Budget Law of the People's Republic of China, the Regulations on Film Management, the Measures for the Administration of Special Funds for Provincial Finance in Jiangsu Province and the Measures for the Administration of the Collection and Use of Special Funds for the Development of National Film Industry (Cai Shui [2015] 9/KLOC-0
Article 2 The term "special funds for the development of film industry in Jiangsu Province" as mentioned in these Measures refers to the collection and management of special funds arranged by the provincial financial budget to support the development of film industry in Jiangsu Province and the development of national film industry.
Article 3 The special funds for the development of the national film industry shall be included in the budget management of government funds, and the budget shall be compiled according to the needs of income and actual expenditure, so as to collect and support.
Article 4 The collection, use and management of special funds for the development of national film industry shall strictly implement national laws and regulations and relevant rules and regulations, and accept the supervision and inspection of financial and auditing departments.

Chapter II Management Responsibilities
Article 6 The Jiangsu Provincial Management Committee (hereinafter referred to as the "Provincial Film Committee"), a special fund for the development of the national film industry, consists of the Provincial Film Bureau and the Provincial Department of Finance, which jointly manage the special funds. The departments in charge of finance and film in cities with districts and counties (cities) shall carry out their duties in accordance with the division of functions, cooperate closely and do a good job in related work.
Article 7 Responsibilities of the Provincial Department of Finance: Work with the Provincial Film Bureau to formulate measures for the management of special funds; Organize the preparation of the annual special fund budget; Review the arrangement plan of special funds and distribute funds according to regulations; Organize the performance management of special fund budget; Supervise the implementation of the special fund policy; Cooperate with the Provincial Film Bureau to recover the unused and idle special funds of the provincial project undertaker according to the regulations; Make public the budget of special funds; Other duties as prescribed by laws, regulations and rules.
Eighth Provincial Film Bureau responsibilities: cooperate with the Provincial Department of Finance to formulate measures for the management of special funds; Organize project declaration and selection, and put forward suggestions on the allocation and use of special funds; Cooperate with the Provincial Department of Finance to issue funds, supervise the use of special funds, organize project acceptance, and specifically implement budget performance management of special funds; Recover the unused and idle special funds of provincial project undertakers in accordance with regulations; Disclosure of relevant information according to laws and regulations; Other duties as prescribed by laws, regulations and rules.
Article 9 The office under the Provincial Film Committee (hereinafter referred to as the "Office of the Provincial Film Committee") is responsible for the daily work of the Provincial Film Committee, specifically responsible for the collection of special funds for the development of the national film industry, the preparation of budget and final accounts, budget performance management, accounting, bill use, statistical analysis, report submission, box office revenue supervision, business training, etc. Responsible for the management of the provincial platform of the national film ticketing comprehensive information management system; To undertake the work assigned by the National Film Special Office; Other duties as prescribed by laws, regulations and rules.
Tenth District, city, county (city) Finance Bureau responsibilities: the implementation of special funds budget, timely disbursement of funds according to the provisions of centralized treasury payment; Organize the project performance management at the corresponding level; Supervise the implementation of the special fund policy; Cooperate with the film authorities at the same level to recover the unused and idle special funds of the project undertaker at the same level in accordance with the regulations; Other duties as prescribed by laws, regulations and rules.
Eleventh district, city, county (city) film department responsibilities: to urge local cinemas to pay special funds for the development of the national film industry in accordance with regulations; Organize the project declaration, and be responsible for reviewing the credit status of the project declaration subject and the authenticity and integrity of the project materials; Specific supervision and management of project implementation, responsible for project performance management, and timely submit the project implementation and the use of special funds to the Provincial Film Bureau; Recover the unused and idle special funds of the project undertaker at the corresponding level in accordance with the regulations; Other duties as prescribed by laws, regulations and rules.
Article 12 Responsibilities of the fund-using unit (project implementation unit): declare the project according to regulations, be responsible for the authenticity, feasibility, scientificity and compliance of the declared project, and do a good job in financial management and accounting of the project; Actively accept and cooperate with the financial and film authorities to carry out project supervision and inspection, performance management and other work; Other duties as prescribed by laws, regulations and rules.
Chapter III Collection of Special Funds for the Development of National Film Industry
Article 13 According to Article 7 of the Administrative Measures on the Collection and Use of Special Funds for the Development of the National Film Industry (Caishui [2015] No.91), the operating film projection units registered in industry and commerce shall pay the special funds for the development of the national film industry according to 5% of their box office income.
Operating film projection units include cinemas, cinemas, theaters, auditoriums, open-air clubs, and special cinemas such as ring screen, giant screen, water screen, dynamic, three-dimensional and super-large screen.
The box office income of operating film projection units shall be verified according to the data recorded by the national film ticketing comprehensive information management system.
The special funds for the development of the national film industry are paid into the central and provincial treasuries according to the ratio of 4: 6.
Fourteenth special funds for the development of the national film industry shall be collected by the provincial film special fund office on a monthly basis.
The operating film projection unit shall, before the 8th day of each month, declare to the provincial film donation office the box office receipts of last month and the special funds for the development of the national film industry, and pay the funds in full according to the designated account of the provincial film donation office.
The provincial film special fund office shall review the situation that the operating film projection unit has turned over the special fund for the development of the national film industry. If it is found that the declaration is false and the funds are underpaid, it shall report to the provincial film bureau in a timely manner. The provincial film bureau shall order commercial film projection units to pay overdue fines within a time limit, and impose additional overdue fines according to the provisions of Article 65 of the Regulations on Film Administration.
Article 15 The provincial film special office shall, before the 20th of each month, actually remit the special funds for the development of the national film industry this month to the designated account of the provincial film special office, and pay them into the special account for the remittance of central finance and the special account for the remittance of non-tax revenue of provincial finance respectively. The provincial department of finance will remit the funds from the special account of provincial financial non-tax income to the provincial treasury in time. The collection of special funds for the development of national film industry should use non-tax revenue bills in Jiangsu Province.
Sixteenth operating film projection units shall, in accordance with the management requirements of the national film ticketing comprehensive information management system, timely and accurately declare the box office income of the film, and truthfully declare and pay the special funds for the development of the national film industry in accordance with the regulations.
Seventeenth provincial film office collection and management of funds required by the provincial budget to solve.
Chapter IV Support Scope and Distribution Mode
Eighteenth special funds focus on supporting the following areas:
(1) production of domestic key films
1. For those included in the national key film projects, in principle, the total funds of each department shall not exceed 30% of the actual total investment of the project, with a maximum of 20 million yuan. After the record (project) is passed, 30% of the total funds will be supported; After the filming is completed and approved, 30% of the total funds will be supported; Obtain the Film Distribution License and distribute it nationwide, and cash in the remaining total funding.
2. Included in the provincial key film projects, in principle, the total subsidy for each film does not exceed 30% of the actual total investment of the project, and the maximum subsidy does not exceed150,000 yuan, of which the subsidy for opera films does not exceed 3 million yuan, and the subsidy for opera films does not exceed 5 million yuan. From the date of launch, 30% of the total funding will be supported; After the filming is completed and approved, 30% of the total funds will be supported; Obtain the Film Distribution License and distribute it nationwide, and cash in the remaining total funding.
3. In principle, the provincial matching funds for key films funded by the National Film Bureau's special funds are 1: 1, and the total funding does not exceed100000 yuan.
The above-mentioned funded key films are all films produced in Jiangsu by film and television institutions (independent legal persons) registered in Jiangsu as the first producers and recognized by the Provincial Film Bureau. The above 1, 2, and 3 items are not duplicated. If the project is transferred out of Jiangsu (subject to the written consent of the Provincial Film Bureau), or it is not released nationwide within the prescribed time limit, all the funded funds will be recovered.
(2) Outstanding Domestic Film Award
1. The film that won the "Five Ones" Project Award for National Spiritual Civilization Construction will be awarded 5 million yuan each.
2. Those who won the China Film Huabiao Award for outstanding feature films, outstanding minority films, outstanding youth films, outstanding rural films, outstanding children's films and other comprehensive awards will be awarded 4 million yuan each.
3. The films that won the Golden Rooster Award for Best Feature Film, Best Small and Medium Cost Feature Film, Best Children's Film, Best Science and Education Film, Best Documentary Film, Best Art Film, Best opera film Award and Best Feature Film Award in Hundred Flowers Award will be awarded 3 million yuan each.
4. Each film that won the main competition unit award of the International Class A Film Festival will be awarded 2 million yuan.
The above items 1, 2, 3 and 4 will not be rewarded again. The scope of the award is Jiangsu-produced films with the film and television organization (independent legal person) registered in Jiangsu as the first producer, which has the copyright of works, the right to declare awards and the right to honor awards.
5. For domestic films with a cumulative box office of more than 65.438+billion yuan (inclusive) shown in city theaters for the first time, each film will be rewarded with 3 million yuan. For every 65.438+billion yuan increase in box office, the corresponding reward will be increased by 6.5438+million yuan, and the total prize money will not exceed 5 million yuan.
The scope of the above-mentioned fifth award is the film produced in Jiangsu by a film and television organization (independent legal person) registered in Jiangsu as the first producer.
(3) Awarding outstanding performance awards.
1. For Suzhou cinemas that have made outstanding performance in the distribution and screening of Jiangsu-made films, the performance ranking is determined according to factors such as film screening times, box office, number of people, and publicity effect. The top five cinemas will give each family a reward of no more than 200,000 yuan; Give appropriate rewards to the top 3 box office receipts of Suzhou cinemas. This award is implemented according to the principle of "high priority and no repetition".
2. For the national film management companies (independent legal persons) whose headquarters are registered in Jiangsu, the performance rankings are determined according to management efficiency, cinema expansion, box office growth, service reputation and other factors, and each of the top three film management companies is rewarded with no more than 500,000 yuan.
The above-mentioned 1 2 awards, if the cinema and the film management company belong to the same legal person company, shall be implemented according to the principle of "high priority and no repetition".
3. For the cinemas in Suzhou that have joined the People's Cinema and Art Film Projection Alliance, the performance ranking is determined according to the film projection times, box office, number of people, announcement effect and other factors recommended by the film authorities, and the top 10 cinemas are given a reward of no more than 654.38+10,000 yuan each.
4. According to the Measures for the Budget Management of Special Funds for the Development of National Film Industry at the Central Level (Cai Jiao [2065438+09] No.260), those who have made achievements in screening domestic films will be given provincial supporting awards. The reward amount of a single cinema is not higher than the part of the domestic film shown by the cinema that is turned over to the provincial treasury.
The sum of the above-mentioned third and fourth prizes enjoyed by a single cinema is not higher than the part that the cinema turned over to the provincial treasury for screening films.
Construction of township cinemas
1. According to the Opinions of the State Film Bureau on Accelerating the Construction of Cinemas to Promote the Prosperity and Development of the Film Market (Fa [2018] No.4), the newly-built township cinemas that meet the requirements and are headquartered in Suzhou will be given a one-time subsidy of 500,000 yuan at the provincial level according to the principle of "build first and then make up".
2. According to the annual financial situation, special subsidies will be given to newly-built eligible township cinemas and cinemas headquartered in Suzhou. The sum of the annual subsidies of a single cinema and the awards of outstanding units that enjoy the performance of distribution and screening shall not be higher than the part that the cinema turned over to the provincial treasury for screening films.
(5) Construction and development of film parks (bases)
1. Give provincial-level supporting awards to film parks (bases) supported by central financial funds.
2. Give appropriate support to major facilities and technical projects of key film parks (bases) included in the "Fourteenth Five-Year Plan" for economic and social development in the province.
(6) According to the fifth paragraph of Article 6 of the Measures for the Budget Management of Special Funds for the Development of National Film Industry at the Central Level (Caijiao [2065438+09] No.260), Jiangsu film enterprises funded by special funds at the central level are given supporting support at the provincial level.
(7) Film financial services
We will adopt subsidies such as risk compensation and discount interest to improve film financial products such as "Su Yingbao" and improve the film financial service ecosystem in our province.
(eight) major film brand activities and platform construction.
1. The key film screening and theme screening activities listed in Jiangsu's "14th Five-Year Plan" action plan, and the subsidy for each activity shall not exceed 2 million yuan.
2. The national key film activities held in Jiangsu are supported by the provincial level.
3. Support the construction and maintenance of major platforms such as all-media film announcement and cinema supervision in the province.
(nine) other approved projects.
Nineteenth special funds are allocated by combining project method and factor method. If the project method is adopted, the provincial film bureau will organize the implementation of project selection, and mainly adopt the methods of identification, evaluation and bidding to determine the projects to be supported; If the distribution method is adopted, the distribution factors include film screening times, box office, person-times, publicity effect, management efficiency, cinema expansion, box office growth, service reputation and related factors in the central-level national film industry development special fund award standard.
Chapter V Project Declaration and Fund Distribution
Twentieth Provincial Film Bureau shall, according to the annual budget, formulate guidelines for the release and declaration, and clarify the support areas, support methods and declaration requirements of special funds.
Twenty-first eligible enterprises and units may, according to the requirements of the annual declaration guide, declare projects to the film authorities of districts and cities. Provincial units directly reported to the provincial film bureau. Where data can be collected through the national movie ticketing comprehensive information management system and the amount of funds can be determined, the step-by-step declaration method is not adopted.
Article 22 In any of the following circumstances, it shall not be supported or rewarded: it violates the relevant laws and policies of the party and the state or disputed projects such as intellectual property rights; Units that have won performance awards by cheating, plagiarism, bribery and other improper or illegal means; Units suspected of illegal acts are being investigated by relevant departments, or listed in the list of abnormal enterprises or serious illegal and untrustworthy enterprises by market supervision, taxation and other departments; Cinema where the last year's project was not completed as scheduled (project implementation unit) or the national film industry development special fund was not paid in full and on time; Other laws and regulations do not support and reward.
Twenty-third provincial film bureau proposed to support the project (unit) and publicity. According to the publicity or on-site inspection, put forward suggestions on special fund arrangement.
Twenty-fourth provincial finance department according to the prescribed procedures for examination and approval, with the provincial film bureau issued special funds. Special funds should be included in the budget management and allocated in accordance with the relevant provisions of the centralized payment management of the state treasury. Involving the need to perform government procurement procedures, it should be implemented in accordance with the relevant provisions of government procurement.
Chapter VI Performance Management and Legal Responsibility
Twenty-fifth Provincial Department of Finance and Provincial Film Bureau should strengthen the whole process budget performance management of film special funds. The Provincial Department of Finance shall establish a performance management mechanism for special funds, and organize and guide departments and units to carry out performance management for special funds. The provincial film bureau specifically implements the performance management of special fund budget.
Twenty-sixth provincial film bureau set special funds budget performance targets, approved by the Provincial Department of Finance and the budget issued simultaneously. The Provincial Film Bureau conducts performance operation monitoring and performance self-evaluation of special funds. The Provincial Department of Finance shall, according to the needs, organize key performance evaluation on the use of special funds, and the evaluation results shall serve as an important basis for the budget arrangement of special funds.
Twenty-seventh Provincial Department of Finance and Provincial Film Bureau shall, in accordance with the principle of "who uses, who benefits, who is responsible", conduct irregular supervision and inspection on the use and management of special funds to ensure the safe, standardized and effective use of funds.
Twenty-eighth levels of finance, film authorities and the use of funds (project implementation units) and individuals should consciously accept the supervision and inspection of the use of special funds, and accept social supervision. Units and individuals who cheat special funds by means of false reports, concealed reports and repeated reports, and use special funds in violation of laws and regulations, shall be held accountable in accordance with the Regulations on Penalties and Punishment for Financial Violations, the Regulations on Financial Supervision in Jiangsu Province, and the Measures for the Administration of Provincial Financial Special Funds in Jiangsu Province. In the examination and approval of projects and funds, there are illegal disbursement of funds, disbursement of funds to unqualified units (institutions, projects), unauthorized disbursement of funds beyond the prescribed scope or standards, and other violations of discipline and law, such as abuse of power, dereliction of duty, and corruption, in accordance with the Budget Law of the People's Republic of China, the Civil Service Law of People's Republic of China (PRC) and the Supervision Law of People's Republic of China (PRC). Suspected of committing a crime, it shall be transferred to the competent department for handling according to law.
Article 29 Enterprises that fail to pay the special funds for the development of the national film industry in full as required shall be investigated for responsibility in accordance with the relevant provisions of the Interim Measures for the Administration of Government Funds (Caizong [2010] No.80) and the Administrative Measures for the Collection and Use of Special Funds for the Development of the National Film Industry (Caishui [2015] No.9/KLOC-0).
Chapter VII Supplementary Provisions
