Regulations of Beijing Municipality on Traditional Chinese Medicine
Chapter I General Provisions Article 1 In order to inherit and carry forward Chinese medicine, guarantee and promote the development of Chinese medicine, give full play to the unique role of Chinese medicine in medical and health undertakings, improve people's health level and promote the construction of a healthy Beijing, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on Traditional Chinese Medicine and other relevant laws and administrative regulations, and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to Chinese medicine, preventive health care, scientific research, education, culture, industry and other activities within the administrative area of this Municipality and their supervision and management. Article 3 This Municipality shall vigorously develop the cause of traditional Chinese medicine, follow the law of development of traditional Chinese medicine, inherit the essence, innovate in good faith, and give full play to the characteristics and advantages of traditional Chinese medicine; Adhere to both Chinese and western medicine, support the complementary and coordinated development of Chinese and western medicine, and promote the integration of Chinese and western medicine; Promote the cooperation and regional coordination between the central and local governments of traditional Chinese medicine, and promote the foreign exchange and open development of traditional Chinese medicine. Article 4 The municipal and district people's governments shall strengthen their leadership over the work of traditional Chinese medicine, establish and improve a management system that conforms to the characteristics of traditional Chinese medicine, incorporate the development of traditional Chinese medicine into the national economic and social development plan, establish a sustainable and stable multi-input mechanism for the development of traditional Chinese medicine, and provide necessary conditions and guarantees for the development of traditional Chinese medicine.

The municipal and district people's governments shall establish and improve the system of joint meetings of Chinese medicine work, study policies to promote the development of Chinese medicine within their respective administrative areas, guide and supervise the implementation of relevant policies and measures, and coordinate and solve major problems in the development of Chinese medicine. Fifth city and district departments in charge of traditional Chinese medicine are responsible for the management of traditional Chinese medicine within their respective administrative areas, coordinating the allocation of traditional Chinese medicine resources and rationally staffing.

Departments of development and reform, education, science and technology, economy and informatization, civil affairs, finance, human resources and social security, agriculture and rural areas, commerce, culture and tourism, health and wellness, market supervision and management, statistics, intellectual property rights, medical security, and drug supervision and management shall, according to their respective functions and duties, do a good job in the work related to traditional Chinese medicine. Article 6 This Municipality supports Chinese medicine industry organizations to establish and improve industry norms, strengthen industry self-discipline, provide services according to law, participate in the formulation of relevant laws, regulations, policies, plans and standards, safeguard the reputation and legitimate rights and interests of the industry, and promote the healthy development of the industry. Article 7 This Municipality promotes Chinese medicine culture, popularizes Chinese medicine knowledge, and creates a social atmosphere of caring for and supporting the development of Chinese medicine. Article 8 This Municipality shall, in accordance with the relevant provisions of the State and this Municipality, commend and reward organizations and individuals that have made outstanding contributions to the development of Chinese medicine. Chapter II Guarantee of Chinese Medicine Services Article 9 This Municipality shall establish and improve a Chinese medicine service system composed of municipal and district Chinese medicine medical centers, various Chinese medicine medical institutions at all levels, Chinese medicine departments of other medical institutions and grass-roots medical and health institutions, give play to the important role of Chinese medicine in preventive health care, disease treatment and rehabilitation, and provide Chinese medicine services covering the whole people and the whole life cycle. Article 10 The municipal and district people's governments shall, according to the demand of Chinese medicine services, set up Chinese medicine medical institutions according to the national and municipal medical institution setting plans and standards, and adjust and improve the layout and scale.

Each district should run at least one Chinese medicine medical institution that undertakes the function of regional Chinese medicine medical center. If the District People's Government merges, cancels or changes the nature of Chinese medicine medical institutions organized by the government, it shall solicit the opinions of the municipal competent department of Chinese medicine. Eleventh government-run general hospitals, maternal and child health care institutions and qualified specialized hospitals should set up Chinese medicine departments, and be equipped with beds for Chinese medicine doctors, Chinese pharmacists, Chinese medicine or integrated Chinese and Western medicine according to regulations; Improve the working mechanism of cooperation between Chinese and western medicine and promote the complementary advantages of Chinese and western medicine services.

Community health service centers and township hospitals should set up Chinese medicine departments, equipped with a certain number of Chinese medicine doctors.

Community health service stations and conditional village clinics should be equipped with doctors who can provide Chinese medicine services, and equipped with necessary equipment and facilities for Chinese medicine diagnosis and treatment; Village clinics do not have the conditions to provide Chinese medicine services, and township health centers shall arrange rounds for Chinese medicine doctors. Article 12 This Municipality encourages social forces to establish medical institutions of traditional Chinese medicine.

Chinese medical institutions run by social forces enjoy the same rights as Chinese medical institutions run by the government in basic medical insurance, key specialty construction, scientific research and teaching, grading evaluation, access to specific medical technologies, and evaluation of professional titles of medical and health personnel.

Encourage Chinese medical institutions organized by social forces to provide basic medical services. Thirteenth city, district health departments, departments in charge of traditional Chinese medicine should take the following measures to strengthen the community health service center (station), township hospitals, village clinics and other grassroots medical and health institutions of Chinese medicine service capacity building:

(a) in accordance with national and municipal standards, the construction of Chinese medicine clinics, Chinese medicine clinics and other comprehensive service areas in grassroots medical and health institutions;

(two) to support qualified Chinese medical institutions to take the lead in establishing a medical consortium with primary medical and health institutions;

(three) to encourage Chinese medicine practitioners to practice more in primary medical and health institutions;

(four) to encourage retired Chinese medicine practitioners to serve in primary health care institutions;

(five) training general practitioners and rural doctors in Chinese medicine knowledge and skills. Article 14 This Municipality supports the construction of key specialties of traditional Chinese medicine, rationally distributes the resources of key specialties of traditional Chinese medicine, and leans towards key specialties in scientific research, personnel training and investment in facilities and equipment. Support key specialties to give play to the characteristics and advantages of traditional Chinese medicine in the fields of major and difficult diseases, acute and critical diseases, and prevention and treatment of infectious diseases.

The municipal competent department of traditional Chinese medicine shall screen and publish the dominant diseases of traditional Chinese medicine in this city, organize research and summarize the basic clinical diagnosis and treatment rules of dominant diseases of traditional Chinese medicine, and promote the application of diagnosis and treatment programs.
