What needs to be explained here is that the food hygiene license is a qualification license issued by the health department to the food business unit when the food function was originally managed by the Ministry of Health. But now, China's food industry supervision has been divided and combined several times, and now it is headed by the food and drug supervision department. The health department no longer conducts specific supervision over the food industry and no longer issues food hygiene licenses. At present, the food industry mainly issues two certificates: one is the food production license, which is mainly aimed at food production and food processing; The second is the food business license, which is mainly aimed at food circulation and catering services.
According to the Measures for the Administration of Food Business License:
Article 9 To apply for a food business license, one should first obtain the qualifications of a legal subject such as a business license.
Enterprise legal person, partnership enterprise, sole proprietorship enterprise, individual industrial and commercial households, etc. The applicant is the subject specified in the business license.
For canteens of government agencies, institutions, social organizations, private non-enterprise units, enterprises and other tendering units, the applicant shall be the subject specified in the registration certificate or business license of the registration certificate of government agencies, institutions and social organizations as legal persons.
Article 12 To apply for a food business license, the following materials shall be submitted to the local food and drug supervision and administration department at or above the county level where the applicant is located:
(1) An application for a food business license;
(two) a copy of the business license or other qualification documents;
(three) the layout of major equipment and facilities, operating procedures and other documents that are suitable for food business;
(four) food safety self-inspection, health management of employees, incoming inspection records, food safety accident handling and other rules and regulations to ensure food safety.
Where vending equipment is used to sell food, the applicant shall also submit the product qualification certificate of the vending equipment, the specific location, the name, residence, contact information of the operator, and the publicity method of the food business license.
Where the applicant entrusts others to apply for a food business license, the agent shall submit the power of attorney and the identity certificate of the agent.
According to the Measures for the Administration of Food Production License:
Article 10 To apply for a food production license, one should first obtain the qualifications of a legal subject such as a business license.

(3) the plan of the food production and processing place and its surrounding environment, the layout of each functional area, the layout of process equipment and the flow chart of food production process;
(4) List of major equipment and facilities for food production;
(5) Rules and regulations for ensuring food safety, such as incoming inspection records, production process control, ex-factory inspection records, food safety self-inspection, health management of employees, recall of unsafe food, and handling of food safety accidents.
Where the applicant entrusts others to apply for a food production license, the agent shall submit the power of attorney and the identity certificate of the agent.
Article 14 When applying for the production license of health food, formula food for special medical use and formula food for infants and young children, the production quality management system documents and relevant registration and filing documents suitable for the food produced shall also be submitted.
Fifteenth engaged in food additive production activities, should obtain a food additive production license according to law.
To apply for a food additive production license, one should have a place, production equipment or facilities, food safety management personnel, professional and technical personnel and management system suitable for the variety of food additives produced.
