Is there an early education and child care center in Jialing District?
The transformation of old residential areas is a key housing project and livelihood project promoted by the state at present. According to Yan Huang, Vice Minister of Housing and Urban-Rural Development, by the end of 2020 and 2025, there will be 1.7 million old residential areas in China, which were mainly built before 2000. In addition, judging from the upgrading of urban renewal mode in the past two years, the "old reform" will gradually replace the "shed reform" in the future.

What is the far-reaching significance of "old reform" replacing "shed reform"? First of all, in cities that rely on shed reform to drive up housing prices, it is difficult for housing prices to rise sharply in the future. The fundamental reason is that shed reform is to create demand and eliminate supply, while the old reform is to eliminate demand and increase supply. So generally speaking, the old reform is more conducive to the stability of the current real estate market; Secondly, the "old reform" of urban residential quarters is of positive significance to further expand domestic demand, especially to effectively promote consumption and promote the smooth circulation of economic supply and demand. Professionals estimate that from 202 1 to 2025, the "old reform" project will incite 4.5 trillion yuan of investment; Moreover, the old reform followed the "people-oriented" ruling philosophy and won the hearts of the people. The transformation of old residential areas is not only a hardware upgrade, but also a reshaping of lifestyle; It is not only the guarantee of living quality, but also the deep cultivation of the feelings of home and country. In addition, the old reform is more in line with the concept of energy saving and low carbon health, that is, the old reform of people's livelihood projects can be effectively combined with the peak action of carbon dioxide emissions.

In fact, the old reform didn't start this year. As early as 20 19, the old reform has been piloted nationwide. According to the data released by the Ministry of Housing and Urban-Rural Development, in 20 19 and 2020, * * arranged the central subsidy funds to exceed14 billion yuan, supporting 58,000 old urban communities in various places, benefiting about10.43 million households. Seeing the brilliant achievements of the old reform in the past two years and the positive feedback from thousands of residents in Qian Qian, Qian Qian, the Ministry of Housing and Urban-Rural Development officially announced that "the transformation of old urban communities will be comprehensively promoted from 202 1".

What exactly does the "old reform" change? According to Yan Huang, deputy director of the Ministry of Housing and Urban-Rural Development, the old reform mainly includes three aspects: first, the basic category, focusing on transforming and upgrading infrastructure such as water circuits and gas signals; The second category is improvement, including adding elevators to eligible old houses, introducing properties and increasing parking lots; The third category is promotion, which generally refers to the development of services such as providing for the aged, helping children and helping meals to effectively improve people's living conditions and living environment.

According to the experience of "renovation" of tens of thousands of old residential areas in China in the past two years, we have to say that everyone agrees with the basic renovation and upgrading renovation, because these two renovations are not only a long-term pain point for the residents of tens of thousands of old residential areas in Qian Qian, but also an effective measure to improve the living environment of the whole residential area. However, many residents have strong resistance to the improvement of "old houses plus elevators".

In June 5438 +2020 10, the National Development and Reform Commission issued a document clearly "encouraging qualified existing houses to install elevators". The survey data also shows that more than 80% residents in old residential areas are eager to realize the "dream of adding elevators to old houses" as soon as possible. Then why is the progress of installing elevators in old communities extremely slow after the introduction of the policy? The staff of the Ministry of Housing and Urban-Rural Development explained that most residents in old communities really want to install elevators, but they often cannot install elevators in old communities for some reasons, such as planning reasons, such as not having installation conditions, for example, residents cannot reach a unified opinion.

In the opinion of professionals, the main reason why it is difficult to advance the project of installing elevators in old buildings in recent two years is that the opinions between high floors and low floors are difficult to coordinate: specifically, the residents on the fifth and sixth floors responded positively, while the residents on the 1 floor and the second floor resolutely opposed it, especially the residents on the 1 floor often made things difficult.

Recently, a real case happened in Nanchong City:1October 24th, 165438 "Nanchong Politics and Law" reported that residents on the 4th-7th floors of a unit in Jialing District of Nanchong City applied to install elevators. After publicity, approval and other procedures, the elevator company entered the construction site, but it was blocked by five residents on the 0 th and 2 nd floors of 65438+. Therefore, the residents on the 4th-7th floor 14 sued the five residents on the 6th and 2nd floors to the Jialing District Court, requesting to order the five residents to stop obstructing the construction and cooperate with the execution of the elevator installation contract of this unit.

In this contradiction and dispute over the installation of elevators in the old community, the residents of 1 building clearly stated that they "resolutely disagreed with the installation of elevators and did not discuss it. If you want to live in a house with an elevator, buy an elevator room. " Generally speaking, there are three objections to the 1 floor: First, the installation of elevators will affect the lighting and ventilation of the 1 and 2 floors, and at the same time, it will bring noise pollution, which has too many disadvantages and is unacceptable; Second, there is no elevator at the 1 floor, so there is no need in this respect, and there is no obligation to cooperate with the upstairs to agree to install the elevator; Thirdly, there are many problems after installing the elevator. The most important thing is that adding the elevator will directly lead to the decline of the house price on the second floor of 1, especially on the second floor of 1, and the house will depreciate. Who will pay for this loss?

At the court coordination meeting, the presiding judge made it clear that neighbors should handle relations well in line with the principle of being conducive to production and life. For the objections mentioned on the 1 floor and the second floor, the judge also replied one by one according to the current laws and regulations: First, the hidden dangers of lighting and ventilation caused by the installation of elevators will be professionally appraised according to the "Design Standard for Lighting in Buildings". You can ask the quality and technical supervision department to coordinate with the third-party technical appraisal institution to measure whether the illuminance measuring instrument is lower than the standard value of lighting according to the prescribed measurement method, and the court can also judge whether the lighting right is damaged according to this; Two, whether the elevator noise exceeds the standard, the quality supervision department needs to coordinate the third-party professional technical appraisal institutions to measure and identify with noise measuring instruments; Third, according to the relevant provisions of the Civil Code and the Property Law, the court held that the claim was not supported without prejudice to the owner's due neighboring rights.

To sum up, if the professional organization certifies that the elevator installation meets the requirements, that is, the lighting, ventilation and noise are within the standard range stipulated by the state, the 1 and/or/and/or/and/or/and/or/and/or/and/or/and/or/and/or/and/or/or/and/or/or/or/and/or/or/or/and/or/or Even if the installation of elevator affects the lighting, it can be solved by improving the installation of elevator. For example, widening the distance between the elevator and the building, such as using a fully transparent glass elevator. In short, the court is more inclined to support the demands of the majority when the vast majority of residents are in favor of installing elevators.

There is no need to argue about installing elevators in old houses. 6th floor: There is a win-win solution.

Do you really have to go to court to install elevators in old houses to get a clear result? Another real case tells us that there is no need to fight for installing elevators in old houses, and there is a "win-win plan" that can completely satisfy the residents upstairs and downstairs. This "win-win plan" was put forward on the 6th floor: "bus elevator+compensation" plan.

The following example is a real case of a district in Nanchang. This community belongs to the first batch of old communities included in the pilot. After the street was informed on 20 19 that the elevator could be installed, the community began to organize the installation of the elevator, led by Mr. Wang on the sixth floor. Referring to other cities, the original plan is "floor-by-floor allocation": the total elevator cost is 400,000, 1 floor does not contribute, 2% on the second floor, 3 10%, 20% on the fourth floor, 30% on the fifth floor and 38% on the sixth floor. When Mr. Wang showed this plan to everyone, the residents on floors 3-6 all agreed at first, 1 and the second floor objected. After unremitting efforts, Mr. Wang also got through the work on the second floor. But only the residents in 1 building strongly disagree. The reason for the objection is simple. Building 1 suffered the most, the house depreciated, the sixth floor benefited the most, and the house appreciated. In short, the residents of 1 building have to pay compensation. Later, after the second floor learned that 1 building wanted compensation, the second floor also repented and followed 1 building's opposition and wanted compensation.

In this way, the installation of elevators began in February 20 19, and there was no progress until the end of 2020. 202 1 February, by chance, Mr. Wang learned that several communities in Hangzhou, Shijiazhuang and other places began to pilot the "bus elevator" scheme. Simply put, the elevator is installed free of charge by a third-party elevator company. Residents only need to apply for monthly cards, season cards and annual cards, and brush their faces to take a bus. It costs 20 to 50 cents to take a bus once, which is similar to taking a bus. Only when they use it, they don't need to pay the bus fee. At the same time, the elevator adopts glass curtain wall, which reduces the lighting impact on low floors.

Mr. Wang contacted these two communities to learn from their successful experiences. So at the beginning of March, I made a plan that I thought was "satisfying everyone"-Mr. Wang added the content of "compensation" on the basis of "bus elevator", specifically, the whole building did not need to spend money. In order to take care of the victims of elevator installation on 1 and the second floor, the fifth and sixth floors made reasonable compensation to 1 and the second floor. This part of the funds was originally spent on the fifth and sixth floors. If it is a "layer-by-layer sharing plan", the fifth and sixth floors will have to pay more. For this scheme, floors 3-6 naturally agreed unconditionally, while 1 and floors 2 finally agreed after seeing this scheme.

1 and the second floor agreed for two reasons: first, they felt valued and chose to take a step back for the sake of neighborhood harmony; Secondly, I know that installing elevators in old communities is the general trend. In the past two years, many cities have abolished the "one-vote veto system". 1 and 2 floors know that if the traffic jam continues, it will probably be solved through legal channels in the future, and no benefits will be obtained then. Now the tenants on the sixth floor have put forward a "win-win plan" and got the "compensation" they deserve. There is no reason not to accommodate the needs of the fifth and sixth floors.

Li Peilin, an expert in the renovation of old buildings, praised this scheme as a "win-win" scheme, which not only solved the problem of funding for installing elevators, but also compensated the lower floors in a friendly way, killing two birds with one stone and satisfying both upstairs and downstairs.

According to media reports, after March this year, more than a dozen cities across the country successively piloted the "bus elevator" scheme, some directly copied the experience of Hangzhou and Shijiazhuang, and some added "compensation schemes" on this basis. Judging from the feedback from the owners of the community who have completed the elevator installation, everyone is full of praise for the "win-win plan" proposed by the 6th floor.

Summary: With the development of China's aging, the demand for installing elevators in old houses is increasing, and the policy has been continuously supported in the past two years, so it will become a trend to install elevators in old communities in the future. However, in practice, the installation of elevators in old residential areas is not smooth sailing, and sometimes even encounters many obstacles. Therefore, expanding the "common denominator" of the owners of each floor is a principle that must be adhered to. During this period, active coordination among residents, communities and streets is indispensable. Judging from the "win-win" scheme put forward on the 6th floor to satisfy both upstairs and downstairs, it is not difficult to install elevators in old houses. Sometimes 1 and the second floor want a feeling of being "valued". As Mr. Wang said on the 6th floor, "I always think that the residents on the 6th and 2nd floors of 1 should not agree, but should fulfill it. After all, installing the elevator has caused them harm. "
