Regulations of Liaoning Province on Publishing Management (revised on 20 10)
Article 1 In order to strengthen the management of publishing activities and promote the prosperity and development of the publishing industry in this province, these Provisions are formulated in accordance with the relevant laws of the state and the Regulations on the Administration of Publishing in the State Council, combined with the actual situation of this province. Article 2 All units and individuals engaged in the publication, printing, production, reproduction and distribution of newspapers, periodicals, books, audio-visual products, electronic publications and other publications (hereinafter referred to as publishing activities) within the administrative region of this province shall abide by these provisions. Article 3 The administrative department of publication of the people's governments of provinces, cities and counties (including county-level cities and districts, the same below) shall be responsible for the supervision and management of publishing activities within their respective administrative areas. Public security, taxation, industry and commerce administration and other relevant departments shall, in accordance with their statutory duties, supervise and manage relevant publishing activities within their respective administrative areas. Article 4 The establishment of a publishing entity must meet the conditions stipulated in Article 10 of the Regulations on the Administration of Publishing in the State Council, and the organizer shall submit an application to the administrative department of publishing of the provincial people's government with an application form. The publishing administrative department of the provincial people's government shall make an audit conclusion within 60 days from the date of receiving the application for establishing a publishing unit and report it to the publishing administrative department of the State Council for approval; If it does not agree to the establishment, it shall explain the reasons. Article 5 A publishing entity shall designate a person in charge and a sponsor, who shall be responsible for leading and supervising the publishing activities of its publishing entity according to law and ensuring the normal publication, printing, production, reproduction and distribution of publications. Article 6 A publishing entity shall publish publications in accordance with its purpose of running a cooperative and the scope of professional division of labor, and shall not go beyond the scope without authorization. Publishing houses shall not publish serials without authorization, and newspapers and periodicals shall not publish books or other newspapers and periodicals in disguised form with newspaper registration numbers. The publication of a supplement that conforms to the purpose of this journal must be approved by the administrative department of publication of the provincial people's government. Newspapers, periodicals and books published by publishing houses shall not infringe the copyright of others. Article 7 Books publicly issued shall be published by publishing units established according to law. Among them, if the content needs special approval according to the regulations, it must be approved by the relevant competent department in advance. Article 8 When publishing books, a publishing house shall submit a topic selection plan to the publishing administrative department of the provincial people's government in advance in accordance with the relevant provisions of the state. The publication of books that should be specially declared according to the provisions of the state must be submitted with a special application in addition to the topic selection plan, and can only be published after the publication administrative department of the provincial people's government reports to the the State Council publication administrative department for the record. The publishing administrative department of the provincial people's government is responsible for the supervision and inspection of the implementation of the publishing house's topic selection plan. Article 9 Internal informational publications used for internal guidance and information exchange of systems, industries and units shall be implemented in accordance with relevant state regulations. Article 10 Units engaged in the printing or reproduction of publications shall apply to the administrative department of publication of the provincial people's government in accordance with the relevant provisions of the state, and the administrative department of publication of the provincial people's government shall make an audit conclusion within 60 days from the date of receiving the application, and issue a publication printing license in accordance with the relevant provisions of the state. Article 11 When printing books published by provincial publishing houses, a printing unit shall have a Power of Attorney, a distribution list and a printing list issued by the publishing house. The printing unit shall sign a contract according to the newspaper registration certificate when printing newspapers and periodicals published by the newspaper and periodical agency of this province; In this province, the supplement and layout of newspapers and periodicals shall be printed with the approval documents of the administrative department of publication of the provincial people's government. Printing units that print newspapers, periodicals and books from other provinces (autonomous regions and municipalities directly under the Central Government) must hold a record certificate issued by the publishing administrative department of the people's government of our province. The undertaking printing unit shall not sell, print without authorization or accept the publication commissioned by a third party, and shall not print the publication illegally. Twelfth units engaged in the general distribution of newspapers, periodicals and books shall go through the formalities in accordance with the provisions of the second paragraph of Article 36 of the Regulations on the Administration of Publishing in the State Council. Distribution units engaged in the wholesale business of newspapers, periodicals and books must be approved by the publishing administrative department of the provincial people's government and apply for a business license from the local administrative department for industry and commerce with the Publishing Business License before they can engage in the wholesale business of newspapers, periodicals and books. Units and individuals engaged in the retail business of newspapers, periodicals and books can engage in the retail business of publications only after being approved by the publishing administrative department of the county people's government and obtaining a business license from the local administrative department for industry and commerce according to law. The distribution of newspapers and periodicals by postal enterprises shall be handled in accordance with the provisions of the Postal Law of People's Republic of China (PRC). Article 13 The publishing administrative department shall inform the parties concerned of the written materials required for applying for permission or approval at one time. Fourteenth units and individuals engaged in publication distribution business shall not purchase goods from non-publication publishing units. Fifteenth without the approval of the administrative department of publishing, no unit or individual may subscribe to newspapers, periodicals and books. No unit or individual may sell or rent newspapers, periodicals and books published by non-publishing units or prohibited by the smuggling country. No unit may raise prices, force or disguise the sale and apportionment of various publications. Sixteenth publications wholesale, retail and rental units shall go through the relevant formalities at the original examination and approval authority when they close down, change jobs or change the original registered items.
