Posts and telecommunications, railways, civil aviation, highways and other departments should assist in the management of books, newspapers and periodicals market. Article 5 All units and individuals engaged in business activities such as wholesale, retail and rental of books and newspapers within the administrative region of this province shall abide by these regulations. Sixth citizens and organizations have the right to report and expose violations of these regulations. Chapter II Application and Approval Article 7 An entity applying for the wholesale business of books, newspapers and periodicals must meet the following conditions:
(1) Having managers who are familiar with the laws, regulations and business of books, newspapers and periodicals management;
(2) Having the qualification of a legal person;
(3) The main business of publishing books, newspapers and periodicals;
(4) Having a sound management and financial management system for books, newspapers and periodicals;
(5) Having corresponding liquidity;
(6) Having a fixed business place and necessary facilities.
No individual may engage in the wholesale business of books, newspapers and periodicals. Article 8 An entity applying to engage in the retail and rental business of books and newspapers must meet the conditions listed in Items (1), (2), (4) and (6) of Article 7. Article 9 An individual applying to engage in the retail or rental business of books, newspapers and periodicals must meet the following conditions:
(a) familiar with books and newspapers management laws and regulations;
(two) there should be a designated business place or mobile business area. Article 10 Units engaged in the wholesale business of books, newspapers and periodicals shall apply to the local (state, city) press and publication authorities, and after examination and approval, they shall be submitted to the Provincial Press and Publication Bureau for approval, and the Qinghai Provincial Press and Publication Bureau shall issue the Business License for Books and Newspapers (hereinafter referred to as the license). Units and individuals engaged in the retail and rental business of books, newspapers and periodicals shall apply to the competent department of press and publication at or above the county level, and after examination and approval, the competent department of press and publication at or above the county level shall issue a license.
Bidders and individuals can engage in business activities only after they have obtained a business license from the local administrative department for industry and commerce.
The license shall not be resold, leased, altered or lent. Eleventh books and newspapers operators to suspend business or change the mode of operation, scope, place, must go through the cancellation or change procedures at the original licensing authority. Chapter III Operation and Management Article 12 Book and newspaper operators shall engage in business activities within the scope stipulated in the license. "License" implements the annual verification and registration system. Thirteenth in addition to Xinhua Bookstore, foreign language bookstores and publishing houses directly engaged in wholesale business, other wholesale units must engage in wholesale business in the wholesale places designated by the competent department of press and publication. Fourteenth books and newspapers wholesalers shall not wholesale books and newspapers to units and individuals without a "license". Fifteenth foreign and Hongkong, Macao, Taiwan Province Province published books and newspapers, must be approved by the provincial press and publication bureau. Sixteenth important documents of the party and the state, works of party and state leaders, textbooks for primary and secondary schools, and internal publications shall be distributed by units determined by the competent department of press and publication in accordance with regulations. Article 17 The sale and lease of antique books and newspapers shall be carried out at counters set up by Xinhua Bookstore or antique books and newspapers shops and stalls approved by the competent department of books and newspapers market. Eighteenth prohibit the operation of the following books and newspapers:
(a) reactionary, undermining the reunification of the motherland and national unity, endangering social stability;
(two) to promote obscenity, pornography, murder violence, feudal superstition and other harmful content;
(three) published by the unit without the approval of the competent department of press and publication;
(4) Illegal publications and smuggled imported overseas publications;
(5) Publications for internal use shall not be publicly distributed;
(six) other books, newspapers and periodicals prohibited by the competent department of press and publication. Nineteenth books, newspapers and periodicals wholesale units shall submit sample books or relevant certificates to the provincial press and publication bureau before approval. Twentieth books, newspapers, advertisements and orders shall not use low-level, vulgar and obscene language and pictures, and shall not make false propaganda. Article 21 For books, newspapers and periodicals that have been notified by the press and publication authorities and publishing units to stop wholesale or explicitly prohibited, business operators shall immediately stop publishing activities and promptly hand them over to the local press and publication authorities, and shall not delay, conceal or transfer them. Its economic losses can be claimed from the original supplier in accordance with relevant state regulations. Twenty-second press and publication departments at all levels and their administrative law enforcement personnel may exercise the following functions and powers when engaging in management activities:
(a) access to relevant books, newspapers and other materials;
(two) ask the parties and relevant witnesses, and obtain relevant information;
(3) Books, newspapers and periodicals that should be appraised or banned may be sealed up, detained or confiscated according to law.
