Article 1 In order to standardize the management of electric bicycles, maintain road traffic order, guide civilized travel, prevent and reduce road traffic accidents, and ensure people's personal and property safety, in accordance with the Road Traffic Safety Law of the People's Republic of China, the Regulations for the Implementation of the Road Traffic Safety Law of the People's Republic of China, the Measures of Hubei Province for the Implementation of the Road Traffic Safety Law of the People's Republic of China and other laws and regulations, combined with the actual situation of this Municipality.
Article 2 These Regulations shall apply to the production, sale, registration, traffic, parking, charging and related management activities of electric bicycles within the administrative area of this Municipality. The term "electric bicycle" as mentioned in these Regulations refers to a two-wheeled bicycle that uses the vehicle battery as an auxiliary energy source, has pedaling ability, and can realize the function of electric assistance or electric drive.
Article 3 The management of electric bicycles shall follow the principles of management according to law, ensuring safety, facilitating the masses and collaborative governance.
Article 4 The people's governments at or above the county level shall strengthen their leadership over the management of electric bicycles within their respective administrative areas, establish a work coordination mechanism, guarantee work funds, and urge relevant departments to perform their duties according to law. Township people's governments and sub-district offices shall urge the units under their jurisdiction to implement the responsibility for traffic safety and fire safety of electric bicycles. Residents' committees and villagers' committees shall assist neighborhood offices and township people's governments in the management of electric bicycles.
Article 5 Public security organs shall be responsible for road traffic safety management such as registration and traffic of electric bicycles. The market supervision and management department is responsible for the supervision and management of the quality, production and sales of electric bicycles. The urban management department is responsible for the administrative punishment of illegal parking of electric bicycles on sidewalks, footbridges, crossing tunnels and other areas. Relevant departments and organizations such as transportation, development and reform, housing and urban and rural construction, economy and informatization, natural resources and planning, ecological environment, education administration, finance, fire rescue, etc. shall do a good job in the management of electric bicycles within their respective functions and duties.
Article 6 State organs, enterprises, institutions, social organizations and other organizations shall educate their personnel on traffic safety and fire safety of electric bicycles, and advocate civilized travel. Schools should incorporate electric bicycle traffic safety and fire safety education into the content of safety education. Press and publication, radio and television, Internet sites and other media should carry out public welfare publicity on traffic safety, fire safety and civilized travel of electric bicycles, and popularize the laws and regulations on the management of electric bicycles.
Seventh electric bicycles produced and sold within the administrative area of this Municipality shall meet the national safety technical standards, pass the compulsory product certification, and mark the certification mark. The market supervision and management department shall disclose to the public the inquiry method for obtaining the information related to compulsory product certification of electric bicycles.
Article 8 A seller of electric bicycles shall establish a purchase ledger and a real-name registration system sales ledger, and publicize the relevant information that the electric bicycles sold meet the national safety technical standards and obtain compulsory product certification in a prominent position in the sales place. If the electric bicycle purchased by consumers cannot be registered because it does not meet the national safety technical standards and has not obtained compulsory product certification, the seller may be required to return or exchange it; If losses are caused to consumers, the seller shall bear civil liability according to law.
Article 9 Electric bicycles shall be subject to the real-name registration management system. The owner of the electric bicycle shall apply to the public security organ for registration within 30 days from the date of purchase, submit the vehicle for inspection and submit the following materials: the identity certificate of the motor vehicle owner; Car purchase invoice or other legal source certificate of the vehicle; Vehicle ex-factory certificate; Other certificates and vouchers as prescribed by laws and regulations. The public security organ shall register those who meet the requirements and issue registration certificates, number plates and driving licenses; Those who do not meet the registration conditions shall explain to the applicant the reasons for not registering. The public security organ may make an electronic driving license for electric bicycles, which has the same legal effect as the driving license.
Article 10 An electric bicycle that meets the compulsory national standards purchased before the implementation of these regulations shall apply for registration in accordance with the provisions of the second paragraph of Article 9 of these regulations within six months from the date of implementation of these regulations. If the electric bicycle purchased before the implementation of this Ordinance does not meet the mandatory national standards, it shall apply to the public security organ for transitional registration within six months from the date of implementation of this Ordinance, and the public security organ shall register with reference to the provisions of the second paragraph of Article 9 of this Ordinance, and issue a registration certificate, a transitional number plate and a driving license. The transition period is three years, counting from the date of implementation of these regulations, and it is not allowed to drive on the road after the expiration.
Eleventh public security organs shall publicize the conditions, procedures, demonstration texts and materials to be submitted for the registration of electric bicycles. The public security organ shall set up electric bicycle registration points or agency points in traffic police teams, police stations, convenience service centers and qualified sales outlets to provide convenience for registration. The public security organ shall register the electric bicycle and issue the registration certificate, license plate and driving license free of charge. When handling the registration of electric bicycles, drivers should be guided to learn road traffic safety knowledge by organizing watching promotional videos, distributing promotional materials and conducting traffic safety knowledge tests.
Article 12 Where the ownership of a registered electric bicycle is transferred, the parties concerned shall apply to the public security organ for transfer registration.
Article 13 If the number plate and driving license of an electric bicycle are lost or damaged, the owner of the motor vehicle shall bring his identity certificate and apply to the public security organ for replacement or replacement.
Fourteenth electric bicycle license plate shall be installed in accordance with the provisions, keep clear and complete, and shall not be intentionally obscured, defaced, lent, misappropriated, forged or altered.
Article 15 People's governments at or above the county level shall organize transportation, urban management, traffic management of public security organs, housing and urban and rural construction, natural resources, planning and other departments to determine the scope, quantity and related management requirements of renting electric bicycles on the Internet according to local actual conditions.
The transportation department shall establish a big data platform for Internet rental electric bicycle supervision and service informationization, and implement total supervision.
Article 16 Owners of electric bicycles are encouraged to take out third-party liability insurance, personal injury insurance and related commercial insurance.
Encourage producers and sellers to insure their electric bicycles against third-party liability insurance, personal injury insurance and related commercial insurance.
Encourage commercial insurance companies to develop relevant commercial insurance products to provide benefits and convenience for electric bicycle owners.
Seventeenth unregistered electric bicycles are prohibited from driving on the road.
Electric bicycles that are not registered during the registration period can be temporarily driven on the road with vehicle origin certificates such as car purchase invoices and vehicle factory certificates.
Article 18 The following electric bicycles are prohibited from driving on the road: assembled; Changing or removing the speed limit device of electric bicycle, resulting in the maximum speed exceeding the mandatory national standard; Replace the motor, battery pack and other components that affect the safety performance of the vehicle; Installation of hood, carriage, windshield and other devices that change the external structure or affect driving safety; Other acts prohibited by laws and regulations.
The Municipal People's Government shall, according to the needs of urban management, standardize the configuration and use of windshields.
Article 19 When driving an electric bicycle on the road, the following provisions shall be observed: the driver shall be at least 16 years old; The implementation of the right traffic, not reverse driving; Observe traffic lights and signs; If there are non-motor vehicle lanes, the maximum speed shall not exceed fifteen kilometers per hour when driving in non-motor vehicle lanes; If there is no non-motor vehicle lane, you should drive on the right side of the roadway on the premise of ensuring safety; Don't drink and drive; Don't help each other and chase each other; Don't use the phone by hand; Do not drive into urban expressways, expressways, elevated roads, tunnels, bridges and other areas where non-motor vehicles are prohibited; Other provisions of laws and regulations.
Twentieth people's governments at or above the county level shall formulate plans and build a road traffic system. According to the actual situation of existing roads, delimit non-motor vehicle lanes to realize the diversion of motor vehicles and non-motor vehicles. New construction, reconstruction and expansion of urban roads should be set up in accordance with the planning of non-motor vehicle lanes.
Twenty-first electric bicycles should be parked in the designated parking signs and markings. Where parking signs and markings are not delineated, parking electric bicycles shall not occupy, block or close evacuation passages, safety exits, fire truck passages, blind roads or obstruct the passage of other vehicles and pedestrians.
Twenty-second electric bicycles should be charged safely, and it is forbidden to pull wires and install sockets for electric bicycles in violation of the requirements for safe electricity use. If you really need to charge in rural courtyards and other places, you should ensure safety.
Twenty-third people's governments at all levels and relevant departments shall scientifically plan and build electric bicycle parking places and charging facilities. Stations, hospitals, schools, shopping malls, libraries, stadiums, theaters and other public places and units shall, in accordance with the planning requirements, support the construction of public parking spaces and charging facilities for electric bicycles. Newly-built residential areas should designate centralized parking areas for electric bicycles in public parking lots and build charging facilities. The people's governments at or above the county level shall, according to the actual situation, delimit the parking area of electric bicycles and build charging facilities. Do not have the conditions for centralized charging, centralized charging facilities should be built nearby.
Twenty-fourth state organs, enterprises and institutions, social organizations and other organizations are responsible for the fire safety management of electric bicycles in their own units, and should promptly discourage and stop illegal parking and unauthorized wiring and charging. The management unit of public places and residential areas shall implement fire safety management for the parking and charging of electric bicycles within the management area, strengthen inspections and inspections, and promptly discourage and stop illegal parking and unauthorized wiring and charging. The implementation of property management, property services companies should implement management responsibilities. Without the implementation of property management, residents' committees and villagers' committees shall determine the safety management personnel for electric bicycle parking and charging, and implement management responsibilities.
Twenty-fifth Internet rental electric bicycle business enterprises should strengthen the management of the parking order of their own vehicles, timely recover damaged and abandoned vehicles, timely clean up vehicles in prohibited parking areas, and maintain road traffic safety order.
Twenty-sixth in violation of the provisions of the provisions of the second paragraph of article tenth, after the expiration of the transition period, driving an electric bicycle on the road, the public security organ shall order it to make corrections and impose a fine on 300 yuan.
Article 27 Whoever, in violation of the provisions of Article 14 of these regulations, fails to install, intentionally conceals, defaces, lends, misappropriates or forges or alters the number plate of an electric bicycle shall be given a warning by the public security organ or fined from 20 yuan to 50 yuan, and the forged or altered number plate shall be confiscated.
Twenty-eighth in violation of the provisions of the first paragraph of Article seventeenth of these regulations, driving an unregistered electric bicycle on the road, the public security organ shall order it to make corrections and impose a warning or a fine of fifty yuan.
Twenty-ninth in violation of the provisions of the eighteenth paragraph of this Ordinance, driving an assembled electric bicycle on the road, the public security organ shall give a warning or impose a fine of fifty yuan to one hundred yuan. In violation of the second, third and fourth provisions of the first paragraph of Article 18 of these regulations, if an electric bicycle is installed or modified on the road, the public security organ shall order it to be restored to its original state and impose a warning or a fine on 50 yuan.
Thirtieth whoever, in violation of the provisions of the fifth paragraph of Article 19 of these regulations, drunk drives an electric bicycle shall be given a warning or fined fifty yuan by the public security organ. Whoever, in violation of the provisions of Item 8 of Article 19 of these regulations, drives an electric bicycle into an area where urban expressways, expressways, elevated roads, tunnels, bridges, etc. are prohibited from passing by non-motor vehicles, shall be given a warning or fined 50 yuan by the public security organ and ordered to leave quickly; Those who refuse to accept the fine may detain the vehicle. In violation of other road traffic regulations in Article 19 of these regulations, the public security organ shall give a warning or impose a fine on 20 yuan.
Article 31 Whoever, in violation of the provisions of Article 21 of these regulations, parks vehicles irregularly, occupies, blocks or closes blind roads or obstructs the passage of other vehicles and pedestrians, shall be given a warning or fined not more than 50 yuan by the public security organ and the urban management department according to the division of responsibilities; Occupy, block or close the evacuation passage, fire passage and fire truck passage, the fire rescue agency and the public security organ shall give a warning or impose a fine of not more than 500 yuan according to the division of responsibilities.
Article 32 Whoever, in violation of the provisions of Article 22 of these regulations, pulls wires privately or installs sockets to charge electric bicycles in violation of the requirements for safe electricity use, shall be given a warning or imposed a fine of not more than 500 yuan by fire-fighting and rescue institutions and public security organs according to the division of responsibilities.
Article 33 If, in violation of the provisions of Article 25 of these regulations, an Internet-leased electric bicycle business enterprise fails to properly manage the parking order of vehicles, fails to recover damaged and abandoned vehicles in time, and fails to clean up vehicles in no-parking areas in time, the public security organ and the urban management department shall order it to make corrections according to the division of responsibilities, and impose a fine on the business enterprise according to the standard of 20 yuan for each vehicle.
Thirty-fourth electric bicycle drivers who, in violation of the provisions of these regulations, voluntarily accept traffic safety study and education or help maintain traffic order may be mitigated or exempted from fines.
Thirty-fifth electric bicycle management departments and their staff who fail to perform their duties according to regulations, abuse their powers, neglect their duties, engage in malpractices for selfish ends, shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
