Interim Provisions of Anshan Municipality on the Prohibition of Smoking in Public Places
Article 1 These Provisions are formulated in order to control the hazards of smoking, safeguard citizens' health and protect the environment. Article 2 patriotic health campaign committee, Anshan City is the competent authority for banning smoking in public places in this Municipality.

Counties (cities) and District patriotic health campaign committee are responsible for the supervision and management of smoking prohibition in public places within their respective jurisdictions.

City, county (city), District patriotic health campaign committee Office (hereinafter referred to as Ivy's Office) is responsible for the specific work of banning smoking in public places, and may also entrust a legally established institution with the function of managing public affairs to supervise and manage the work of banning smoking in public places within its jurisdiction.

Departments of health, education, commerce, sports, transportation, culture, real estate, public utilities, urban construction, environmental protection, public security, railway areas and other social organizations at all levels should make joint efforts to ban smoking. Article 3 Smoking is prohibited in the following places:

(1) Audience hall, club, video hall (room), recreation hall (room), song (dance) hall and music teahouse (room) of theaters and concert halls;

(2) Meeting places and meeting rooms with more than 30 people;

(3) The auditorium and competition hall of the gymnasium (swimming pool);

(4) Library reading rooms, museum exhibition halls, science and technology museums, archives, memorial halls and exhibition halls;

(5) Stores (fields), closed markets, bookstores, postal services and financial business halls;

(six) in public transport, waiting rooms and ticket offices;

(7) Waiting areas, consulting rooms and wards of medical and health units;

(eight) schools and other places for children, adolescents and the elderly;

(nine) other public places where smoking is not allowed as stipulated by national laws and regulations. Article 4 No smoking units shall perform the following duties:

(a) to establish and improve the responsibility system for the management of smoking ban in public places, and do a good job in the publicity and education of smoking ban;

(2) Placing obvious no-smoking signs in places where smoking is prohibited;

(3) Smoking apparatus and attached tobacco advertising signs or articles shall not be placed in places where smoking is prohibited;

(four) in public places where people stay for a long time, smokers can be provided with smoking rooms (areas) with ventilation devices, and there are obvious signs; Article 5 Smoking is prohibited under a supervision system combining professional supervision with mass supervision. Smoking is prohibited in public places above the county (city), and Ivy will appoint a smoking supervisor to be responsible for supervision and inspection. Citizens have the right to discourage and report violations of these regulations. Article 6 State organs, enterprises, institutions, social organizations and other organizations may, according to actual conditions, decide on their own places where smoking is prohibited, and do a good job in supervision and management according to the requirements of these Provisions. Seventh education, culture, health, environmental protection and other departments and news units should often carry out social propaganda that smoking is harmful to health.

Every year on May 3 1 Day, World No Tobacco Day, in addition to stopping selling cigarettes, all units should actively carry out publicity work.

The industrial and commercial departments should strengthen the supervision and management of tobacco advertisements and seriously investigate and deal with illegal acts of setting up tobacco advertisements in public places. Article 8 In places where smoking is prohibited, citizens have the right to ask smokers to stop smoking, the right to ask the business or management unit of the place and the health inspector to discourage smoking, and the right to report violations of these provisions to the county (city) or district patriotic health campaign committee. Article 9 Units and individuals who violate these provisions shall be punished according to the following provisions:

(1) Whoever, in violation of the provisions of Article 3, smokes in public places where smoking is prohibited shall be fined 10 yuan; Those who do not listen to dissuasion will be punished by 2-5 times.

(two) in violation of the provisions of article fourth (a) and (two), given a warning and ordered to make corrections within a time limit.

(three) in violation of the provisions of article fourth (three) and (four), a fine of 500 yuan to 1000 yuan.

(four) in violation of the provisions of article seventh, in the "World No Tobacco Day" to sell cigarettes, punishable by 2000 yuan fine of 65438 yuan. Tenth health supervisors and inspectors at all levels and supervisors and inspectors of administrative organs or institutions entrusted by patriotic health campaign committee can impose penalties and fines, and must issue a receipt of fines uniformly printed by the Municipal Finance Bureau, and all fines will be turned over to the finance. Eleventh if a party refuses to accept the administrative punishment, it may apply for administrative reconsideration or bring an administrative lawsuit according to the relevant laws and regulations of the state. If it fails to apply for administrative reconsideration or bring an administrative lawsuit within the time limit and fails to perform the punishment decision, the organ that made the punishment decision may apply to the people's court for compulsory execution. Twelfth refuse or obstruct the supervision and inspection personnel to perform official duties according to law, shall be punished by the public security department in accordance with the "Regulations of the people's Republic of China on administrative penalties for public security"; Anyone who threatens the supervision and inspection personnel to perform official duties by violence or other means, which constitutes a crime, shall be investigated for criminal responsibility according to law. Thirteenth supervision and inspection personnel should strictly abide by the law and discipline and enforce the law impartially. For favoritism, bribery, dereliction of duty, be given administrative sanctions; If a crime is constituted, criminal responsibility shall be investigated according to law. Fourteenth these Provisions shall be interpreted by Anshan patriotic health campaign committee. Fifteenth these Provisions shall come into force as of the date of promulgation.
