Interim Provisions of the Press and Publication Administration and the State Administration for Industry and Commerce on Publishing Houses' Self-issuance of Books
Article 1 These Provisions are formulated in order to prosper and develop the publishing industry, promote publishers to publish books by themselves, improve management level, activate the book market and better serve the people and socialism. Article 2 When publishing books on its own, a publishing house shall strictly abide by the relevant laws and regulations of the state and the relevant provisions of the administrative department of press and publication. Article 3 The main purpose of publishing books by a publishing house is to expand the distribution of books of this edition (that is, books published by this publishing house, the same below), and pay special attention to the distribution of books with strong professionalism, narrow readership and high academic value. Article 4 To publish books by itself, a publishing house shall meet the following conditions:

(a) there is a formal issuing agency, and a person in charge of the community is responsible for the issuance work.

(two) there are fixed distribution professionals. Distribution professionals should have a high school education or above; The person in charge of the card issuing institution must be a regular employee on the job.

(3) Having funds and equipment suitable for its business scale.

(4) Having a fixed business place.

(5) Having a sound financial management system. Article 5 A publishing house that issues books on its own must go through the examination, approval and registration in accordance with the following provisions:

(a) the publishing house to carry out its own book distribution business must be approved by the local provincial press and publication administrative department. If the publishing house conducts independent accounting for its own issuance and meets the requirements of a legal person, it shall apply to the administrative department for industry and commerce for registration of an enterprise as a legal person with the approval documents of the provincial press and publication administration department, and issue a Business License for an Enterprise as a Legal Person; If it is unable to bear civil liability independently due to independent internal accounting, it shall apply to the administrative department for industry and commerce for industrial and commercial registration and issue a business license with the approval document of the provincial press and publication administration department. Publishers that operate as enterprises and whose funds are no longer appropriated by the state may apply to the administrative department for industry and commerce for increasing the business scope of "book distribution of this edition" and handling the change registration after being registered by the administrative department for industry and commerce.

(2) Publishing houses do their own publishing, and generally do not establish branches in other places. If it is really necessary for individual professional publishing houses to set up branches, they must be examined and approved by the Press and Publication Administration, apply for registration with the local administrative department for industry and commerce, and accept the supervision and management of the local administrative department for press and publication and the administrative department for industry and commerce in their business activities.

(3) When a publishing house establishes a professional bookstore or salesroom in other places, it shall apply to the local administrative department for industry and commerce for registration with the approval of the local administrative department for press and publication.

(four) the establishment of collective publishing institutions shall be implemented in accordance with the Interim Provisions on Strengthening the Management of Collective, Individual and Private Bookstores (stalls) issued by the Press and Publication Administration and the State Administration for Industry and Commerce. Article 6 A publishing house has the general right to distribute this edition of books, except those exclusively sold by Xinhua Bookstore. Article 7 Books issued by a publishing house may be distributed in the distribution shop of Xinhua Bookstore; You can choose distribution, consignment and other forms of purchase and sale; Xinhua Bookstore, foreign language bookstore and antique bookstore at all levels can also implement floating discounts. The floating discount measures shall be stipulated separately. Article 8 Books underwritten by Xinhua Bookstore may be distributed by retail and mail order, but they shall not engage in licensing and wholesale business. Under special circumstances, if a publishing house needs to carry out subscription and wholesale business, it should consult with the delivery shop or report to the administrative department of press and publication at or above the provincial level (including the provincial level) for approval. Article 9 A publishing house may engage in the retail or secondary wholesale business of foreign language books when it issues books on its own. Article 10 Books generally distributed by publishing houses shall not be transferred or transferred in disguised form to units without the right of general distribution of books; It is also not allowed to wholesale books to informal distribution units. Eleventh publishing houses should strive to meet the needs of readers, give priority to the ordering and replenishment of books in Xinhua Bookstore at all levels, especially in rural and remote areas, strive to ensure timely and sufficient supply, and strengthen the stocking work. Article 12 A publishing house shall, in accordance with the requirements of the administrative department of press and publication and the national statistical department, submit the statistical data published by its own unit to the designated competent department on time. Thirteenth any violation of these provisions, the existing provisions of the state, by the administrative department of press and publication and the administrative department for Industry and commerce in accordance with the relevant provisions; If there are no provisions in the state, the administrative department of press and publication shall, depending on the seriousness of the case, give a warning, informed criticism, suspend business for rectification and even cancel the registration. Article 14 These Provisions shall come into force as of the date of promulgation.
