Article 2 These Measures shall apply to the compilation and management of the tender control price published in the tender documents of the construction project with bill of quantities valuation within the urban area of this Municipality (excluding Yiling District).
The term "construction engineering" as mentioned in these Measures refers to construction engineering, decoration engineering, installation engineering, municipal engineering, landscape engineering and mine engineering.
Article 3 The term "tender control price" as mentioned in these Measures refers to the relevant valuation basis and method promulgated by the tenderee according to the national, provincial, municipal or industrial construction authorities, as well as the maximum project cost defined by the design and construction drawings.
Article 4 The tender control price shall be compiled by a tenderer who has the ability to compile it, or by an engineering cost consulting institution with the qualification of a corresponding engineering cost consulting enterprise.
A tenderer with the ability to prepare as mentioned in these Measures shall meet the following conditions:
(a) the editors of the bidding control price must be cost engineers and cost engineers registered in the bidding unit;
(two) the professional configuration of the tender control price editor must meet the requirements of relevant professional standards, operating procedures and norms.
Article 5 The compilation of tender control price shall follow the following basic principles:
(1) Only one tender control price can be compiled for a project subject to tender;
(two) the establishment of the tender control price shall conform to the basis and valuation method of the tender offer stipulated in the tender documents;
(three) the project cost consultant shall not accept the tender control price and tender offer of the same project at the same time.
(four) the tender control price shall not exceed the budget approved by the relevant departments.
Article 6 The compilation basis of tender control price is as follows:
(1) Code for Valuation with Bill of Quantities of Construction Projects (GB 50500-2008);
(two) the current construction project consumption quota, charging standards, pricing procedures, etc. Issued by the provincial and industrial construction administrative departments;
(three) construction engineering survey and design documents and related materials;
(four) the bill of quantities in the tender documents and related requirements;
(5) Standards, specifications and technical data related to construction projects;
(six) the situation of the construction site, the characteristics of the project and the conventional construction plan;
(7) Other relevant information.
Article 7 The establishment of tender control price shall strictly implement the valuation standard of bill of quantities, and reasonably reflect the market price level of the proposed project. The following basic requirements shall be met when pricing:
1, consumption level, unit price of labor wages, relevant expense standards and pricing procedures shall be implemented according to the current pricing quota and pricing methods promulgated by the provincial construction department;
2. The material price shall be subject to the project cost information released by the local cost management institution 28 days before the bidding deadline; For materials whose unit price is not published in the project cost information, the material price shall be determined through market investigation;
3. Measures The project cost should be calculated by considering the commonly used construction technology and construction scheme where the project is located.
Article 8 The tender control price shall be published in both written and electronic forms with the tender documents. These include:
(1) The published tender control price (written version) includes the cover, general description, summary table of tender control price of engineering project, summary table of tender control price of single project, summary table of tender control price of unit project, partial bill of quantities and valuation table, list and valuation table of measures and projects, list and valuation table of other projects, provisional amount table, material estimation unit price table, provisional valuation table of professional projects, valuation table of general contracting service fees and taxes. The general description shall include the following contents:
1, using the valuation basis and material price source;
2. Determination and calculation of construction scheme;
3, professional engineering price, comprehensive unit price risk factors, risk range (scope) and other determination principles and calculation basis;
4, the use of new materials, new technologies or new processes, etc.
(2) The published tender control price (electronic version) shall meet the following requirements:
1, which is in line with the current data exchange standard of construction engineering cost application software in Hubei Province;
2. It should be the embodiment of all the price composition details of the bidding control price.
Article 9 A tenderer shall be responsible for the accuracy and completeness of the tender control price. Where a tenderer entrusts a project cost consulting enterprise to prepare, it shall specify the corresponding responsibilities and obligations in the project cost consulting entrustment contract.
Article 10 A tenderer shall, before the tender control price is officially announced, report the tender control price and related materials to the construction project cost management institution where the project is located for the record. The filing materials shall include:
(a) Yichang city housing construction project and municipal infrastructure project bidding control price registration form (five copies);
(two) the bidding documents approved by the bidding supervision and management institution of the construction administrative department where the project is located (original);
(three) the written version and electronic version of the tender control price (original);
(four) the qualification and qualification certificate of the preparation unit and personnel (copy);
(5) Entrustment contract for project cost consultation (original).
Eleventh tender control price has not been filed by the construction project cost management agency where the project is located, and the tender control price is invalid. In any of the following circumstances, the tender control price shall not be put on record:
(a) the bidding control price filing information is incomplete;
(2) The compilation basis does not conform to the relevant provisions of the current valuation management;
(three) the preparation unit and personnel do not meet the current relevant management regulations;
(D) The data format does not conform to the current data exchange standard of Hubei construction engineering cost application software.
Article 12 If a bidder believes that the tender control price announced by the tenderer is wrong or not compiled according to the provisions of these Measures, and the tender control price is made public with the tender documents, it shall complain to the tender supervision institution of the construction administrative department where the project is located before clarifying and answering questions. The bidder shall provide the following information when making a complaint:
(1) Business license of enterprise legal person with independent legal person qualification;
(two) the main problems existing in the tender control price and related calculation data (required to be stamped by registered cost practitioners);
(three) the legal representative's identity certificate or the legal representative's power of attorney and the original ID card.
Thirteenth complaints about the accuracy of the bidding control price, the bidding supervision institution of the construction administrative department where the project is located shall deal with the project cost management institution, and instruct the tenderer to verify.
If the tenderer refuses to verify the complaint about the accuracy of the tender control price or the complainant still has objections after verification, the project cost management institution shall organize a review or entrust a qualified project cost consulting institution to conduct a review.
Fourteenth engineering cost management agencies entrust engineering cost consulting agencies to review, the review fee is paid in advance by the complainant, and the charging standard is calculated according to the current charging standard of engineering cost consulting services. If the error range of bidding control price is within 5% (including 5%), the review fee shall be borne by the complainant; If the error range is more than 5% and less than 10%, the review fee shall be borne by the complainant and the preparation unit, 50% respectively; If the error range is outside 10%, the review fee shall be borne by the compiling unit.
Fifteenth review of the tender control price error within 5% (including 5%), the original tender control price is valid; If the error range is outside 5%, the original tender control price is invalid, and the tender control price confirmed by the review shall prevail. The tender control price confirmed by the review shall not be reviewed again.
The tenderee will re-announce the tender control price according to the review and confirmation, and notify all bidders to postpone the deadline for submitting the tender documents.
Sixteenth engineering cost management institutions of engineering cost consulting enterprises and engineering cost practitioners in violation of laws, regulations, engineering cost valuation standards, valuation methods and the provisions of these measures, should be ordered to make corrections, and dealt with according to the following provisions, credited to the municipal construction industry credit files:
(a) the tender control price is not compiled according to the requirements of these Measures, and the complaints are verified. Depending on the seriousness of the case, the preparation unit and the preparation personnel will be given a warning 1 time. If the warning reaches 2 times within one year, the qualification (qualification) will be suspended for 6 months.
(2) If there is a major deviation in the quotation or the record of bad behavior reaches twice within one year, it shall not engage in business within the administrative area of Yichang City within one year.
Seventeenth counties and cities (including Yiling District) within the scope or the use of fixed valuation of the construction project bidding control price with reference to these measures.
Article 18 These Measures shall be implemented as of the date of issuance.
