Provisions on Fire Safety Management of Fire Risk Units in Gansu Province (revised in 2020)
Article 1 In order to strengthen the fire safety management of high-risk fire units, prevent and reduce fire hazards, and ensure personal and property safety, these Provisions are formulated in accordance with the Fire Protection Law of People's Republic of China (PRC), the Fire Protection Regulations of Gansu Province and other relevant laws and regulations, combined with the actual situation of this province. Article 2 These Provisions shall apply to the fire safety management activities of high-risk fire units within the administrative area of this province. Article 3 People's governments at all levels shall be responsible for coordinating and solving major problems in the supervision and management of high-risk fire units within their respective administrative areas, strengthening the construction of public fire control infrastructure, and ensuring fire fighting and emergency rescue. Fourth emergency management departments of the people's governments at or above the county level shall supervise and manage the fire control work of high-risk units within their respective administrative areas, and the fire rescue institutions of the people's governments at the corresponding levels shall be responsible for the implementation.

The education, housing construction, market supervision, civil air defense, cultural tourism, health and other departments of the people's governments at or above the county level shall, within the scope of their respective duties, strengthen the fire safety supervision of high-risk units according to law and urge them to do a good job in fire safety. Fifth fire rescue agencies should strengthen the supervision and inspection of high-risk fire units, not less than twice a year; Units with good fire safety assessment and high fire safety credit rating shall be inspected at least once a year. Article 6 Fire-risk units shall implement the fire control policy of putting prevention first and combining prevention with elimination, adhere to the principles of safety self-inspection, self-elimination of hidden dangers and taking responsibility for themselves, implement the responsibility system for fire control safety, strengthen fire control management and ensure fire control safety. Article 7 The units with high fire risk mentioned in these Provisions refer to places with dense personnel, inflammable and explosive places, high-rise and underground public buildings and other places prone to fire, which may cause heavy casualties or property losses. Including the following units and places:

(1) Hotels, restaurants, shopping malls and markets with a total construction area of over 20,000 square meters or a single-storey construction area of over 1 10,000 square meters;

(two) the total construction area of 15000 square meters above the civil airport terminal and passenger station waiting room;

(3) stadiums, auditoriums, public exhibition halls and museum exhibition halls with a total construction area of 1 10,000 square meters or more;

(4) theaters, libraries, nursing homes, welfare homes, hospitals, sanatoriums, places for religious activities, production workshops and dormitories of labor-intensive enterprises, teaching buildings and dormitories of schools with a total construction area of more than 5,000 square meters;

(five) nurseries, kindergartens, children's play halls and other indoor children's activities with a total construction area of more than 2000 square meters;

(6) Public entertainment places such as song and dance halls, video halls, recreation halls, saunas, Internet cafes and bars with a total construction area of 1500 square meters, and leisure places such as restaurants, teahouses and cafes with entertainment functions;

(7) Production, storage and business units of Class A and Class B combustible gases with a total reserve of 1 10,000 cubic meters or Class A, B and C combustible liquids with a total reserve of more than 30,000 cubic meters;

(8) Units that produce, store and operate Class A and B combustible solids and combustible fibers with a total construction area of 1 10,000 square meters or more;

(nine) high-rise public buildings with a single building area of more than forty thousand square meters or a building height of more than one hundred meters;

(ten) underground public buildings and civil air defense projects with a construction area of more than five thousand square meters;

(eleven) large storage warehouses and bases for storing combustible materials;

(twelve) a large power plant with a single capacity of more than three hundred thousand kilowatts or a total installed capacity of more than one million kilowatts;

(thirteen) the national key cultural relics protection units of wood structure or brick-wood structure;

(fourteen) other units that are prone to fire, and once a fire breaks out, it may cause heavy casualties or property losses. Eighth fire risk units shall establish and improve the fire safety system, implement the fire safety responsibility system step by step, determine the person responsible for fire safety, and implement the fire safety responsibility according to law. Article 9 Fire-risk units shall establish full-time fire brigades or volunteer fire brigades according to law, equip them with corresponding fire-fighting equipment and equipment, formulate fire-fighting and emergency evacuation plans in accordance with relevant regulations, and organize drills at least once a quarter.

Fire high-risk units that have not established full-time fire brigades shall establish miniature fire stations relying on volunteer fire brigades, and each class (group) shall have no less than 6 fire-fighting and disposal personnel. Article 10 The legal representative or principal responsible person of a high-risk fire unit is the first person responsible for fire safety of the unit, who is fully responsible for fire safety work and performs the following duties:

(a) the implementation of fire laws, regulations and rules;

(two) to determine the fire control institutions, formulate the annual fire control work plan, arrange the work funds, and organize regular fire safety meetings;

(three) sign the post fire control work target responsibility;

(four) to organize fire safety inspection, implement rectification measures for major fire hazards, and deal with major issues related to fire safety in a timely manner;

(five) to organize the formulation of fire fighting and emergency evacuation plans and conduct regular drills;

(six) other fire safety duties as prescribed by laws and regulations. Eleventh fire risk units shall designate fire safety administrators to assist the person in charge of fire safety in charge of fire safety work and perform the following duties:

(1) Organizing the implementation of daily fire safety management;

(two) to formulate and implement the fire safety system and operating rules;

(three) to organize the implementation of fire safety inspection and rectification of fire hazards;

(four) the organization and management of full-time fire brigade, regular training and assessment of fire fighting knowledge and skills of full-time fire brigade;

(5) Organizing publicity, education and training on fire control, and organizing the implementation and drills of fire fighting and emergency evacuation plans;

(six) other fire safety management work entrusted by the person in charge of fire safety.

Encourage fire safety management personnel to obtain the qualification of registered fire engineer.
