Encourage the publication of good works that carry forward China's excellent cultural traditions, absorb the achievements of world civilization, reflect the cause of reform and construction, and inspire the spirit of national endeavor, and resist the erosion of decadent feudal and capitalist ideas.
People's governments at all levels shall commend and reward units and individuals that have made remarkable achievements in publishing and distribution. Article 3 All publishing and distribution activities must abide by national laws and regulations, realize the unity of economic benefits and social benefits, put social benefits first, and shall not harm national interests, social public interests and citizens' legitimate rights and interests. Article 4 All publications printed, publicly distributed and disseminated by illegal publishing units are illegal publications. Publications published by legal publishing units containing obscene and reactionary contents are also illegal publications.
Identification of illegal publications, by the provincial press and publication management departments, radio and television management departments to organize personnel with specialized knowledge and certain political quality, which is officially published outside the province, reported to the competent state department for identification. Fifth books, audio-visual publishing and distribution management in this province, respectively, by the provincial, municipal and county press and publication (cultural) management departments and radio and television management departments.
The administrative departments for industry and commerce, public security departments and relevant competent departments at all levels shall supervise and manage the production and circulation of publications in accordance with the division of responsibilities. Chapter II Administration of Publication Article 6 The establishment of publishing houses and periodicals must meet the following conditions:
(1) Having a clear purpose, editorial policy and publication scope;
(2) Having a clear organizer and competent department;
(3) Having full-time editors, editors, publishers and managers;
(4) Having a fixed workplace, necessary material and technical conditions and funds. Seventh in accordance with the provisions of the preceding article, according to the following procedures for examination and approval:
A, the establishment of books, audio-visual publishing house, by the organizer respectively to the provincial press and publication management department, radio and television management department to submit a written application, submitted to the provincial government for examination and approval, and then submitted to the national press and publication management department or radio and television management department for examination and approval, after approval to obtain the publishing house number or audio-visual publishing license, by the local administrative department for Industry and commerce for approval and registration, issued a business license.
The establishment of branches by publishing units shall be examined and approved in accordance with the procedures for the establishment of new publishing units.
Two, the establishment of periodicals, by the organizer to the municipal or provincial press and publication (culture) management department to submit a written application, after the approval of the provincial press and publication management department, reported to the state press and publication management department for examination and approval. After obtaining the periodical registration certificate upon approval, the local administrative department for industry and commerce shall approve the registration and issue a business license. Article 8 If a publishing entity changes its name and scope of publication, or changes the name, date and scope of publication of a periodical, or suspends its business or publication, the organizer shall report to the original approval department and go through the registration of change at the administrative department for industry and commerce. Without approval and registration, it shall not be changed without authorization. Article 9 A periodical publishing entity shall not publish books under the periodical registration number or in disguised form.
If a provincial journal needs to publish a supplement consistent with the purpose of this journal, it must be approved by the provincial press and publication management department. Article 10 All publications are prohibited from publishing the following contents:
(1) Spreading counter-revolutionary remarks;
(2) divulging state secrets;
(3) propagating murder, superstition, obscenity and instigating others to commit crimes;
(4) Violating the lawful rights and interests of others;
(five) undermining national unity;
(6) Other contents prohibited by the state. Article 11 A publishing entity shall not transfer or sell its name, book number, periodical registration number, audio-visual publishing number, periodical name, paper type and edition number. Rent to other units or individuals (except for renting printed matter according to state regulations). Twelfth books must have a version record page. Periodicals must indicate the registration number, the name and address of the publishing unit and the name of the editor-in-chief (editor-in-chief or president) in a fixed position.
Audio-visual publications shall indicate the full name, registered trademark, publication number, publication year and names of authors and performers of the publishing unit and reproduction production unit.
Publications that do not conform to the provisions of the preceding two paragraphs shall not enter the market. Thirteenth publicly published maps are published by special publishing houses. Other publishing houses publish current affairs propaganda maps, thematic maps or publications with maps (except schematic diagrams), which shall be approved by the provincial surveying and mapping management department. Article 14 No unit or individual may violate the provisions of copyright and infringe upon the legitimate rights of copyright owners. If there is any infringement, the copyright owner may refer it to the local administrative department of press and publication (culture) and the administrative department of radio and television where the infringement occurred, or directly complain to the court. Article 15 No unit or individual may engage in illegal publishing activities such as purchasing, counterfeiting or forging the name of publishing unit, book number, audio-visual publication number and periodical registration number.
No unit or individual may reprint officially published books and periodicals, and may not make commercial reproduction of audio-visual publications.
