Han Depei's Life Experience
Mr. Han Depei was born in 19 1 1, Rugao, Jiangsu. His grandfather, Han Daxing, was a lieutenant who had fought side by side with Wing King Shi Dakai for many years.

When Han Depei was a child, he often listened to his grandfather's military career of riding horses, and inherited his grandfather's integrity.

Han Depei, who came into this world, was a bitter child-at that time, the Korean family had gradually declined. To make matters worse, Han Depei lost his loving mother at the age of 8, and at an early age, she tasted the coldness of the world brought about by her poor family and childhood loss.

19 17 years, Han Depei entered a private school, during which he studied university, Analects of Confucius, Mencius and excellent studies, and received strict calligraphy training, which laid a solid foundation for his old studies. /kloc-at the age of 0/0, Han Depei transferred to Jingjiang Primary School, a primary school run by Zhenjiang people who lived in Rugao and ran a bank, paying special attention to Chinese, arithmetic and English courses. Anyone familiar with Han Depei knows that he knows not only English, but also French, German, Japanese and Russian. His excellent language ability is related to his good foreign language training as a child. 1928, graduated from Han Depei Normal University.

1930 went to Hangzhou to take the exam, and was admitted to the Department of History and Politics of Zhejiang University. Half a year later, the then Ministry of Education decided to merge the Department of History and Politics of Zhejiang University into Central University, and Han Depei was transferred to Central University.

When I first arrived at Central University, a listening class changed Han Depei's ambition and hobbies. At that time, the professor who gave lectures was Xie, who was later the minister of judicial administration of the National Government and the head of the law department. His lecture is "Law is to solve disputes between people".

Han Depei still clearly remembers, "Professor Xie didn't give a speech, but only used a piece of chalk. He teaches jurisprudence, quotes classics and talks about Kan Kan, which is not only clear-cut, but also makes the boring law courses in the eyes of ordinary people interesting. " Later, Han Depei also attended lectures on "Jurisprudence", "Chinese Legal History" and "Roman Law" by Professor Xie. He can't sit in the classroom, so he stands outside the window and listens.

Thus, Han Depei became interested in law, and he knew that law is a science to solve disputes between people, which is very useful to society. So, he went to see Professor Xie and talked about his idea of studying law. With the help of Professor Xie, he got his wish and transferred from the Department of History and Politics to the Department of Law. At that time, the law department of Central University offered a very complete set of courses, such as criminal law, general introduction of civil law, property law, relative law, procedural law and so on. Many people from judicial practice departments come to give lectures, including judges of the Supreme Court and officials of the judicial administrative department. "Changing from the Department of History and Politics to the Department of Law has changed my life's fate, but I am worthy of my choice", as Han Depei, who is now a great jurist, commented on his choice. From 65438 to 0934, Han Depei graduated from the Law Department of Central University.

Old China was poor and backward, and was bullied by foreign powers. Han Depei deeply feels that education is very important to improve the quality of the people and realize the prosperity of the country. Hungry for knowledge, he hopes to go abroad for further study, but he was born in poverty and can only wait for the opportunity to study abroad at public expense.

At this time, CUHK needed an editor to come to acta editologica and publish the school magazine, and Han Depei volunteered to undertake the work.

Five years later, the opportunity finally came. China-UK Gengkuan Board of Directors recruits British public students in China. However, among these 24 places, only 1 was registered in private international law.

After fierce competition, 28-year-old Han Depei got the opportunity to study at Cambridge University. But just as Han Depei and others were about to leave, the European War broke out suddenly-Han Depei had to go back to Central University and wait for news, while continuing his teaching work.

However, the war in Europe is getting more and more serious, and it is very difficult to study in Britain.

1 year later, the board of directors of Sino-British Geng decided to transfer all 24 international students admitted at public expense to the University of Toronto, Canada. 1941At the end of July, Han Depei went to the University of Toronto with Qian Weichang, Zhang Longxiang and others who were admitted by Chinese and British G-class public students. Han Depei didn't expect, this is five years.

In the second year of studying at the University of Toronto, Han Depei wrote a paper under the guidance of Professor Moffat Hancock, a famous scholar of private international law. The topic of his thesis is the essence and procedure of private international law. He collected and quoted a large number of cases in Britain, America and Canada, analyzed the views of some scholars in Britain, America and Canada, and put forward his own views. Professor Hancock commented happily after reading this paper: "Your paper is very good, and I don't need to change a word." In this way, Han Depei successfully passed the defense of master's thesis and obtained a master's degree. This was the highest degree that could be awarded by the law school at that time.

From 65438 to 0942, Han Depei came to Harvard Law School, the most prestigious school in the world at that time, as a special graduate student, and used the extremely rich books and periodicals collected by one of the best law libraries in the world to further carry out planned, step-by-step and focused research. During his three years at Harvard, Han Depei focused on reading books and periodicals on private international law, public international law and jurisprudence, and tried to collect relevant information. Especially in private international law, he spent more time and made many detailed notes. In addition, he also attended lectures by several historians at that time, such as griswold's private international law, Hudson's public international law, Pound's jurisprudence, etc., which benefited a lot. At Harvard, Han Depei also wrote some new books on private international law, such as book reviews and comments on Pound's theory of social law school and kelsen's pure legal theory published in the academic journal Thoughts and Times published by Zhejiang University.

From 65438 to 0945, he returned to Wuhan University as a law professor at the invitation of President Zhou Yusheng, a famous jurist. Later, he served as the head of the law department, standing Committee member and deputy secretary-general, deputy provost and head of the law department. 1980 and 198 1, respectively, established the first international law institute and the only environmental law institute in China. He has served as honorary president of Wu Da Law School, director of the Institute of International Law, director of the Institute of Environmental Law, distinguished member of the first, second and third sessions of the Legal Review Group of the State Council Academic Degrees Committee, consultant of the State Council Economic and Legal Research Center, consultant of the State Environmental Protection Agency and consultant of China International Economic and Trade Arbitration Commission. At present, he is still working in Wu Da Law School. He is also the honorary director of the Institute of International Law and the Institute of Environmental Law, the key research base of humanities and social sciences of the Ministry of Education, and the honorary president of China Society of International Law, China Society of Private International Law and China Society of Environment and Resources Protection. Abroad, he has also served as a director of the International Union for Conservation of Nature and Natural Resources, director of the Environmental Law Research Center and director of the World Society for Urban and Regional Planning.

1In the autumn of 945, the preparatory meeting for the establishment of the United Nations was held in San Francisco, USA, and Dong attended the meeting as a member of the China delegation. After the meeting, Dong Lao was invited to give a speech in new york. In the speech, some pro-Kuomintang students studying in the United States had ulterior motives and raised some unreasonable questions. Local Chinese newspapers also made distorted reports. Han Depei was very angry and wrote a letter to Dong Lao. The letter said that those unreasonable people simply can't represent China students studying in the United States. Knowing that Dong Lao studied law in Japan and was a jurist himself, Han Depei also asked Dong Lao in his letter: Does the new China in the future need legal construction? How to conduct legal research?

In the early days of the founding of New China, Han Depei was the head of the Law Department of Wuhan University, but he had no idea how to engage in legal research and legal education to meet the needs of building a new country. So I asked Dong Lao, who presided over the national political and legal work.

Around 1955, Dong Lao visited Wuhan and specially called Han Depei to chat with him. Han Depei also talked with Dong Lao about the reform of the law department of Wuhan University. He refused the job invitation of the newly established United Nations and returned to China to teach at Wuhan University at the invitation of Zhou Yusheng in 1946.

At the end of 1945, Han Depei set out from Seattle, USA and returned to China with longing and excitement. When our motherland, which we haven't seen for many years, appears in front of us again, Han Depei can't help but burst into tears, and his vision is gradually blurred ... China, which has just come out of War of Resistance against Japanese Aggression, is experiencing escalating civil war, soaring prices, bureaucratic corruption, poor people and chaotic social order, which is far from the ideal democratic and legal society of "returnees" Han Depei. At that time, Han Peide published the article "The Rule of Law We Need" in the famous "Observation" magazine, and proposed that the rule of law needed by the people should be based on democratic politics.

In Wuhan University, Han Depei has served as the director of the Law Department of Wuhan University, the chairman of the Wuhan University Professors Association, and the deputy secretary-general of the Wuhan University School Committee. Because of his efforts and outstanding achievements, the law department of Wuhan University has become one of the only three comprehensive university law departments in China that have been specially reserved in the adjustment of departments.

At that time, Han Depei and Zhang, the founder of development economics and professor of economics, as well as world historians and professors of history, were dubbed "Harvard Three Musketeers" by China, a classmate of Harvard.

1957 was labeled as the right-wing "prime minister in the mountains", and a large number of notes were eaten up by termites. 1960 After taking off his hat, he returned to Wuda University. The law department no longer exists, and he was assigned to the Foreign Languages Department. At the beginning of the Cultural Revolution, when he was teaching English, he was accused by students of distinguishing the word "beard" from the beard in the portrait of "Marne Lesmao" above the blackboard in the classroom. Then he went shopping and was even put on a rightist hat for the second time.

From 65438 to the early 1970s, as a rightist and reeducation-through-labor worker, Han Depei was ordered to translate a large number of UN documents, which was highly praised by the Ministry of Foreign Affairs. After the Cultural Revolution, he was rehabilitated. At the repeated invitation of President Liu Daoyu (at the same time, Peking University also extended an olive branch for many times, hoping that Han Lao would teach at Peking University), Han Lao went out to rebuild the law department of Wuhan University and recruited a large number of outstanding talents such as Yao Meizhen, Ma Kechang, Zhang Quanlin and He Huahui. 1980 established the institute of international law, the first comprehensive university in China; 198 1 established the only institute of environmental law in China and even in Asia, which is also the largest in the whole Asia-Pacific region. The reconstruction process of Wuhan University Law School is based on Han Lao. For Wuhan University, Han Lao really contributed too much to Wuhan University! After teaching in the law department of Wuhan University for two years, Han Depei, who was only 36 years old, was appointed as the head of the law department.

Shortly after the founding of New China, almost all the law departments of national comprehensive universities were abolished, and only three universities kept the law departments, and Wu Da was one of them.

From 65438 to 0957, after the anti-rightist movement began, Han Depei, as a jurist, became one of the two largest rightists in Wuhan University. When he was classified as a rightist for the first time, Han Depei also argued that as a result, he was asked to examine the teachers and students of the whole school, but he was still refuting his "charges" one by one. Because it makes sense, it exposed many lies in the "anti-rightist" office, and the people below burst into laughter. Han Depei has another crime: his attitude is extremely bad.

After being criticized for a whole week, the "anti-rightist" office announced the punishment for him: revocation of all posts and sending him to work in Shayang Farm. By the time Han Depei 1960 returned to school, the law department had been revoked and went to Hubei University. At that time, Hubei University only accepted non-rightist teachers from the Law Department of Wuhan University, and the Rightists stayed in Wuhan University, so he had to switch to the Foreign Languages Department to teach English.

After the Cultural Revolution began, Han Depei was once again labeled as "Rightist" in 1969. Han Depei's right to teach English was also deprived because of "poisoning while teaching English". He was sent to Shayang Farm for another eight years. 1978 "Rightists" were completely rehabilitated and returned to work in Wuhan University.

After the "Cultural Revolution", how to recast the gold medal of the law department became the primary problem faced by Liu Daoyu, the new vice president.

But how easy is it for a department that has been wiped out in one pot to recover? Liu Daoyu thought of Han Depei.

"If the law department is a crystal of Wuhan University, it has been broken in the anti-rightist movement and the Cultural Revolution. Fortunately, although the crystal is broken, the crystal nucleus is still there. This crystal nucleus is the respected and famous international jurist Professor Han Depei, who is a master of law and a place where we can restore the confidence of the legal department. We firmly believe that as long as he climbs high, talents will gather under his banner from all directions. Before long, a beautiful giant crystal will grow around his nucleus. " Many years later, Liu Daoyu evaluated Han Depei's influence in Wuhan University in his autobiography Confessions of University Presidents.

Sure enough, under the call of Han Depei, the news that Wu Da resumed the Ministry of Justice soon spread all over the country and gained wide support in the legal field. Law talents who have been lost or buried for many years from all walks of life have taken the initiative to submit books, including many alumni who graduated from the law department of Wuhan University in their early years. They all made a sound: "Rebuild the glory of the past!" In the field of law and education, Han Depei's many pioneering contributions are almost well known: his academic activities cover many fields such as private international law, public international law, environmental law, jurisprudence and legal education. In private international law, he creatively put forward the theory of "one machine with two wings" and constructed the theoretical system and legislative system of private international law in New China. He is the pioneer of China's environmental law theory and the founder of environmental law research and education.

What made these outstanding achievements? Many people familiar with Han Depei mentioned two words: vision.

From 65438 to 0979, Wuhan University decided to resume law education and invited Professor Han Depei to preside over the reconstruction of the law department. At that time, China had just started the reform and opening up, and Han Lao was keenly aware that international law would play an important role in China's opening up. Therefore, while rebuilding the law department, he established the Institute of International Law of Wuhan University on 1980, which was the first international law institute established in China universities.

In the 1980s, not many people knew about "environmental law", and it was not an independent discipline at that time. 198 1 year, Han Depei promoted the cooperation between Wuhan University and china environmental science Research Institute, and established the Institute of Environmental Law of Wuhan University, which was the first in China and even in Asia. At the same time, Han Depei, a member of the evaluation group of law subject of the State Council Academic Degrees Committee, rushed to appeal to the Ministry of Education for approval, and environmental law became an independent subject in China's legal education system.

"Today, more than 20 years later, these two research institutes have developed very well. They are not only the key research bases of humanities and social sciences of the Ministry of Education, but also the national key disciplines, which have extensive academic influence at home and abroad. Looking back now, we sincerely admire Han Lao's extraordinary vision. " From Mr. Wang, the president of China University of Political Science and Law and the president of China Private International Law Association realized the importance of academic vision for academic achievements.

In addition to his unique academic vision, Han Depei's broad mind also made younger generations admire him.

Qin Huang recalled: "When evaluating professional titles, Han Lao always opposed seniority and rivalry, and United and condensed a large number of intellectuals. His understanding of people and the amount of people he uses are very convincing. With his support, Professor He Huahui, a famous constitutional expert, still works as a lecturer in 1980. Becoming a professor at 1982 set a miracle for the promotion of university titles in that era. "

"For the younger generation, Mr. Wang not only vigorously cultivates support, but more importantly, lets them shoulder heavy responsibilities and stand on a higher platform. Mr. Wang always dares not shy away from honor. This is a place that the younger generation cannot surpass. " In Qin Huang's view, Han Depei's broad mind brought a breeze to some impetuous legal circles at that time and even today. "Under the influence of Mr. Wang, the private international law circle in China is very harmonious."

In terms of academic achievements and influence, Han Depei can be called a master of law, but Han Depei doesn't want others to call him a master. He likes to be called sir best. ..

"My husband's lifelong admiration is Oppenheimer, Pound, Digi and other law masters. His wish before his death was that one day there would be such a master among his students or students. " Qin Huang told reporters: "mr. yi's achievements and influence in the legal field in China can be compared with those of the above-mentioned scholars in his own country."

"Why is it difficult for our younger generation to surpass the legal elite like Han Lao? Because they have the character and mind of a master. " Qin Huang said with emotion. From 1946' s first lecture in Wuhan University to his death, Han Depei never left Wuhan University, even the podium-until his death, he was still worrying about the thesis defense of five graduating doctoral students.

In 1964, flick your finger. Han Depei changed from the youngest professor to the oldest professor. It was not until his death that he officially retired. In the past 64 years, no one can tell how many students Han Depei has trained: Ma Kechang, a senior professor at Wuhan University, is a famous master of criminal law in China; Professor Liang, who is 85 years old, is the founder of China's international organization law. Professor Qin Huang, President of China University of Political Science and Law, Vice President china law society and Dean of Law School of Macau University were the first and second outstanding young and middle-aged jurists. Wang Han, Vice President of northwest university of politics and law, and Xiao Yongping, Dean of Wuhan University Law School are well-known scholars in the field of private international law ... According to scholars' statistics, almost all well-known domestic law colleges have "poor students".

In the political and legal system and administrative system, Wan Exiang, the vice president of the Supreme People's Court, is a student of Han Depei, and about one third of the officials in the Department of Law and Law of the Ministry of Foreign Affairs have been taught by Han Depei. Among international organizations, Liu Fang, director of ICAO Administration, is his student. She is also the highest-ranking China official in ICAO since China resumed her legal seat in 1974.

In 1964, Han Depei was most concerned about his students. Caring for students doesn't just stop at school.

"He is very concerned about each of our students. He remembers all the little things in our lives. " Wang, a doctoral student of Han Depei in 2006 and an associate professor of Shandong University of Political Science and Law, recalled.

In 2007, Wang found her husband and wanted to take time off to go home because his son took the college entrance examination that year. A month later, Wang returned to Wuhan, and Mr. Wang specially asked the children whether the college entrance examination was smooth.

The day before Han Lao died, Wang also went to the hospital to visit her husband. "At that time, he could not speak. When the escort told him that I was his student, he opened his eyes and there were only tears in his eyes. "

Wang said: "At that moment, he could only express his love with tears."

Just as Wang's doctoral student was enrolled, Han Depei delivered a speech: "I won't retire, and I don't want to retire. I still have to take my doctoral students. Even so, I am happy to shoulder these responsibilities and have three requirements for myself: my thoughts are not rigid, my knowledge is not aging, and my articles are not rigid. "

On May 2, 2009, Han Depei spoke clearly for the last time. He asked the last two questions in his life. The first question is how to prepare the papers of several of his doctoral students. The second question, how did the doctoral enrollment interview go? "Since we are recruiting students, we must be responsible for them." Han Depei said to the attendants around him.

According to the plan, the old professor Han will attend the defense of five doctoral students' theses, such as Wang and others. But on this day, the students are waiting for the bad news of Wang's death.

At Han Depei's farewell ceremony, the old man in the portrait was still smiling. Although we all know that the old man is optimistic and loves to laugh rather than cry, many people, from the 80-year-old professor to the younger generation of students, can't help crying. At this moment, students can only return their love with tears.
