Chapter II Rights and Obligations of Consumers Article 5 Consumers shall enjoy the following rights:

(five) when the legitimate rights and interests are damaged and the responsible party refuses to bear the responsibility, it may complain to the relevant departments and apply for arbitration. Where laws and regulations provide that a lawsuit can be brought to a people's court, a lawsuit can be brought to a people's court according to law. Article 6 Consumers shall undertake the following obligations:
(1) Pay attention to manners and respect the labor of sales staff and service personnel;
(2) observing the order of the business premises;
(3) take care of the goods when buying them;
(four) the complaint must conform to the facts, and provide shopping vouchers and relevant evidence. Chapter III Responsibilities of Operators Article 7 Operators must abide by the following provisions in their business activities:
(a) the production and sale of goods, where there are legal quality standards, must meet the prescribed quality standards; If it does not meet the quality standards, but it still has use value, it must be marked on the product or packaging and sold at a reduced price; Sales that endanger personal safety are not allowed.
(two) are not allowed to produce products that have been explicitly eliminated by the state, and are not allowed to sell expired goods.
(three) the laws and regulations must carry out quality inspection without inspection certificate of goods, are not allowed to be sold.
(four) the production and sale of goods that should be accompanied by instructions or labels indicating the name, address, production date, expiration date and shelf life as stipulated by laws and regulations. Sales are not allowed without instructions or labels.
(5) The materials, utensils and tableware of food and packaged food produced and sold by the catering industry must meet the hygiene standards stipulated by laws and regulations; It is not allowed to sell rotten food.
(six) the production and sale of goods, must be genuine, not fake, old, shoddy, lack of scales. Shops and markets should set up fair scales and scales.
(seven) are not allowed to use collocation or deception to sell goods.
(8) Goods that are guaranteed to be repaired, replaced, returned and redone as stipulated by the state or agreed by both parties must be repaired, replaced, returned and redone as stipulated.
(nine) the seller shall compensate the consumers for the economic losses caused by the poor quality and insufficient quantity of the goods; If the responsibility belongs to the producer, the seller will claim compensation from the producer.
(ten) the provision of living services must meet the quality standards prescribed by the competent department of business.
(eleven) the sale of goods or the provision of living services must be clearly marked, and the commodity prices and service charges stipulated by the state shall be implemented. It is forbidden to raise prices without authorization, raise prices in disguise or overcharge.
(twelve) books, newspapers, periodicals and audio-visual products prohibited by laws and regulations shall not be printed, recorded and sold.
(thirteen) advertising is not allowed to cheat consumers in any form.
(fourteen) sales and service personnel should be civilized service, polite hospitality, abide by professional ethics. Eighth operators must accept the supervision of the relevant administrative departments, consumer associations (committees) and consumers. Chapter IV Social Supervision and Supervision by Public Opinion Article 9 Consumers may report, expose and accuse business operators of illegal business operations and acts that harm the legitimate rights and interests of consumers to the relevant administrative departments. Article 10 Consumer associations (committees) are social organizations that safeguard consumers' legitimate rights and interests and guide consumption. Under the guidance of the people's government, assist the relevant administrative departments in social supervision of the quality of goods and services. Consumer associations (committees) shall perform the following duties in protecting the legitimate rights and interests of consumers:
(1) Accepting consumer complaints, investigating complaints, mediating disputes between consumers and business operators, making suggestions to relevant competent business departments and administrative departments or supporting consumers to apply to the Consumer Dispute Arbitration Committee for arbitration;
(two) to assist the relevant competent departments to inspect and supervise the quality and price of goods and services, and investigate and deal with the production and sale of fake and shoddy goods;
(three) listen to the opinions and demands of consumers, feedback the quality information of goods and services to operators, and reflect the opinions and demands of consumers to the relevant competent departments;
(four) to participate in the selection of quality products and services;
(five) to support consumers or accept the entrustment of consumers, and bring a lawsuit to the people's court for acts that seriously damage the legitimate rights and interests of consumers.
