Why is the bookstore in China called Xinhua Bookstore?
[Edit this paragraph]

194865438+In February, Comrade Mao Zedong wrote an inscription for Xinhua Bookstore in Xibaipo, Pingshan County, Hebei Province, which has been used ever since. After 10 years' efforts, the service trademark of Xinhua Bookstore registered by China Xinhua Bookstore Association was recently recognized as a well-known trademark in China by the Trademark Review and Adjudication Board of the State Administration for Industry and Commerce. "Xinhua Bookstore", an "old brand" with a glorious history of 70 years, why should it be recognized as a well-known trademark? How did she go through the road of well-known trademark recognition?

The origin of trademark registration in Xinhua Bookstore can be traced back to 1993. At that time, in Guangdong, Jiangxi, Fujian, Hubei, Liaoning, Beijing and other places, there were incidents in which individual bookstores illegally sold pirated books and illegal publications in the name of Xinhua Bookstore. Xinhua Bookstores in Yunnan, Hainan and other places have also sent letters to reflect that the local industrial and commercial administrative departments have no legal basis to stop the above-mentioned infringement.

Therefore, Xinhua Bookstore Corporation specifically reflected this problem to the General Administration of Press and Publication. The leaders of the General Administration decided to entrust Xinhua Bookstore Corporation to apply for registration of the service trademark of Xinhua Bookstore in the Trademark Office of the State Administration for Industry and Commerce (hereinafter referred to as the State Trademark Office) on behalf of the national Xinhua Bookstore system.

When I first applied for registration, I got the answer that the logo should not be registered as a trademark. The reason is that the word "bookstore" is the name of the enterprise, which is not within the scope of registration, and the word "Xinhua" has been registered first, so the registration of 1995 failed.

Grab a trademark and "provoke"

1996 10, an American Chinese came to Xinhua Bookstore Corporation, claiming that he had registered the trademark of Xinhua Bookstore in the United States, and expressed his hope to seek the cooperation of the corporation, or to jointly operate it in the form of a joint-stock system, or to acquire its trademark registration in the United States at the expense of the corporation. At that time, the head office replied, first, whether to cooperate or not depends on the instructions of the Press and Publication Administration. Secondly, the Mao-style "Xinhua Bookstore" storefront is an intangible asset of Xinhua Bookstore system. Only Chinese mainland Xinhua Bookstore has the right to use it, and Xinhua Bookstore Head Office has the right to register it. Others have no right to register this trademark overseas.

At the same time, a foreign-related patent and trademark agency in China informed the head office that it had received a letter from the American trademark retrieval company, and someone registered the trademark "Xinhua Bookstore" in the federal government of the United States on June 5438+August 0996. Considering the particularity of the trademark of Xinhua Bookstore and its influence abroad, the trademark agency requires the head office to treat it with caution (after verification by the head office, the registered person of the trademark in the United States is a Chinese American who came to the head office to talk about the repurchase of the trademark).

Publishing predecessors fully appealed

Since then, the Press and Publication Administration has clearly instructed Xinhua Bookstore Corporation to represent the whole industry and overcome all difficulties. First, the trademark of Xinhua Bookstore was successfully registered in China, and then it was registered abroad, especially in countries and regions where Chinese live in concentrated communities.

1997 is the 60th anniversary of Xinhua Bookstore. According to the instructions of the General Administration of Press and Publication on trademark registration, the head office entrusted the China Trademark Patent Office to apply to the State Trademark Office for trademark registration of Xinhua Bookstore. However, this application was rejected again by the State Trademark Office for the same reason as the reply of 1995. Therefore, the head office turned to the Trademark Review and Adjudication Board of the State Administration for Industry and Commerce (hereinafter referred to as the Trademark Review and Adjudication Board), an arbitration institution for trademark registration. The head office prepared a lot of written materials, introduced the history of Xinhua Bookstore in detail, fully stated the reasons for registering the trademark of Xinhua Bookstore, and requested the Trademark Review and Adjudication Board to support the trademark registration of Xinhua Bookstore according to the particularity of Xinhua Bookstore industry. After studying the representations, the Trademark Review and Adjudication Board visited the headquarters of Xinhua Bookstore several times to learn about the situation and organized special seminars.

At the same time, many old-timers in the publishing industry also called for the registration and protection of Xinhua Bookstore, a state-owned intangible asset and famous brand, through different channels. At that time, Liu Gao, Wang Yi and other old leaders in the publishing industry initiated a joint proposal at the CPPCC meeting, demanding that the trademark registration of Xinhua Bookstore be paid attention to and that this well-known trademark be protected from infringement.

Successfully registered and won the prize again.

According to the glorious history of Xinhua Bookstore in the past 60 years, and considering the particularity of Xinhua Bookstore industry, especially the influence of wool font Xinhua Bookstore at home and abroad, the Trademark Review and Adjudication Board made a final ruling on the trademark registration of Xinhua Bookstore. The State Trademark Office finally accepted and published the 35th and 39th service trademark registrations of Xinhua Bookstore. After the expiration of the announcement, the trademarks of Xinhua Bookstore were registered at 1998, 1998, 1 1 respectively. After the establishment of China Xinhua Bookstore Association in 2003, Xinhua Bookstore Head Office transferred all the trademark registration rights and ownership of Xinhua Bookstore to the Association free of charge, and the Association registered the trademarks of Xinhua Bookstore in the State Trademark Office as 16 and 4 1 respectively.

With the promotion of brand awareness of Xinhua Bookstore, in order to further strengthen the protection of Xinhua Bookstore's trademark, the president's office of China Xinhua Bookstore Association decided to apply to the Trademark Review and Adjudication Board for the recognition of Xinhua Bookstore's well-known trademark in August 2006. After reviewing a lot of written evidence prepared by Xinhua Bookstore Association, the Trademark Review and Adjudication Board decided that the trademark of Xinhua Bookstore was a well-known trademark in China in August 2007 according to Article 14 of the Trademark Law of People's Republic of China (PRC).

According to the instructions of the General Administration of Press and Publication, in order to comprehensively strengthen the overseas protection of Xinhua Bookstore trademarks, China Xinhua Bookstore Association hired China Trademark Patent Office as an agent in May 2006 to apply for the registration of Xinhua Bookstore trademarks in 22 countries. These 22 countries are Australia, Japan, Korea, Vietnam, Singapore, Britain, the United States, Austria, Belgium, the Netherlands, Luxembourg, France, Germany, Italy, Mongolia, Poland, Portugal, Romania, Russia, Spain, Switzerland and Ukraine. At present, China Xinhua Bookstore Association has obtained the registration certificate of the Madrid International Registration Bureau of the World Intellectual Property Organization.

At this point, Xinhua Bookstore, a golden signboard and an important well-known brand of state-owned culture, has been fully protected at home and abroad.
