"Perfecting the emergency rescue mechanism" is the requirement put forward by the 17th National Congress of the Communist Party of China. Considering the advantages of public security fire brigade in active service system, equipment and training management, and the remarkable achievements made by public security fire brigade in emergency rescue work in recent years, especially its outstanding role in Wenchuan earthquake disaster rescue, the new fire protection law further strengthens the emergency rescue capacity building and necessary safeguard measures of public security fire brigade and government full-time fire brigade. Compared with 1998 fire protection law, it is mainly embodied as follows:
People's governments at all levels should strengthen the construction of fire control organizations, establish various forms of fire control organizations according to the needs of economic and social development, strengthen the training of fire control technicians, and enhance the ability of fire prevention, fighting and emergency rescue.
Local people's governments at or above the county level shall, according to the characteristics of fires within their respective administrative areas, organize relevant departments to formulate emergency plans, establish emergency response and disposal mechanisms, and provide personnel and equipment for fire fighting and emergency rescue work.
Public security fire brigade and government full-time fire brigade shall participate in emergency rescue work focusing on saving lives in accordance with state regulations; The public security fire brigade and the full-time government fire brigade participate in the emergency rescue work of other major disasters or accidents other than fires, and are led by the people's governments at or above the county level.
Where the firefighters who rushed to the emergency rescue site and the mobilized fire-fighting equipment and materials need to be transported by rail, water or air, the relevant departments shall give priority to transportation.
The Fire Protection Law also stipulates that people who are injured, disabled or killed due to participating in emergency rescue should be given corresponding medical and pension funds.
