Legal analysis: the profit is less than the filing standard. Article 218 of the Criminal Law of People's Republic of China (PRC) stipulates that anyone who knowingly sells infringing copies as stipulated in Article 217 of this Law for the purpose of making profits, with huge illegal gains, shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention and shall also, or shall only, be fined. Article 2 17 stipulates that the fourth item of infringing copies is "books with exclusive publishing rights enjoyed by others", which is commonly referred to as pirated books. Individuals with illegal income of more than 100,000 yuan and units with illegal income of more than 500,000 yuan shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention and shall also or only be fined. If it is not serious enough for criminal punishment and damages the public interest, the copyright administrative department may order it to stop the infringement, confiscate the illegal income, confiscate and destroy the infringing copy, and may also impose a fine. If the circumstances are serious, the copyright administrative department may also confiscate the materials, tools and equipment mainly used for making infringing copies.

Article 17 The basic people's courts shall have jurisdiction over civil cases of first instance, except as otherwise provided by this Law.
Article 18 The Intermediate People's Court shall have jurisdiction over the following civil cases of first instance:
(1) Major foreign-related cases;
(two) cases that have a significant impact in the region;
(3) Cases determined by the Supreme People's Court to be under the jurisdiction of the Intermediate People's Court.
Article 119 A prosecution must meet the following conditions:
(1) The plaintiff is a citizen, legal person and other organization that has a direct interest in the case;
(2) Having a clear defendant;
(3) Having specific requests, facts and reasons;
(4) It falls within the scope of civil litigation accepted by the people's court and is under the jurisdiction of the sued people's court.
