The publications mentioned in these Provisions refer to books, newspapers, periodicals, audio-visual products and electronic publications.
Distribution as mentioned in these Provisions includes wholesale, retail, rental, exhibition and other activities.
Wholesale refers to the sale of publications by suppliers to other publication operators.
Retail refers to the direct sales of publications by business operators to consumers.
Rental means that operators provide publications to consumers in the form of collecting rent.
Exhibition means that the organizer organizes publication operators to concentrate on exhibition, sales and ordering publications at a certain place and time. Article 3 The State shall practise a licensing system for the wholesale and retail of publications according to law. Units and individuals engaged in the wholesale and retail activities of publications shall carry out the wholesale and retail activities of publications on the strength of the Publication Business License; Without permission, no unit or individual may engage in wholesale or retail activities of publications.
No unit or individual may entrust non-publication wholesale or retail units or individuals to sell publications or sell publications as agents. Article 4 The State Administration of Press, Publication, Radio, Film and Television shall be responsible for the supervision and administration of publication distribution activities throughout the country and formulate the development plan for the publication distribution industry throughout the country.
The publishing administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for the supervision and management of publication distribution activities within their respective administrative areas, and formulate the development plans for the publication distribution industry of the provinces, autonomous regions and municipalities directly under the Central Government. The publishing administrative department of the people's government below the provincial level shall be responsible for the supervision and administration of publication distribution activities within its administrative area.
The development plan of publication distribution industry must be scientifically demonstrated and follow the principles of legality, justice, reality and promoting development. Article 5 The State guarantees and promotes the development, transformation and upgrading of the hair industry, and supports the physical bookstores, rural distribution outlets, distribution logistics system, information construction of the hair industry, etc. , promote the development of emerging formats such as online distribution, and promote the integrated development of the development industry and other related industries. Units and individuals that have made important contributions to the development of industries shall be rewarded in accordance with relevant state regulations. Article 6 Social organizations in the publishing industry shall, in accordance with their articles of association and under the guidance of the publishing administrative department, implement self-discipline management. Chapter II Application for Publication Distribution Article 7 An entity engaged in the wholesale business of publications shall meet the following conditions:
(a) has completed the industrial and commercial registration, with legal personality;
(2) The business scope of industrial and commercial registration includes publication wholesale business;
(3) Having equipment and fixed business premises suitable for the publication wholesale business, with a total business area of not less than 50 square meters;
(four) a sound management system and an information management system that meets industry standards.
The term "business premises" as mentioned in these Provisions refers to the enterprise domicile registered in the administrative department for industry and commerce. Article 8 An entity applying for the wholesale business of publications may submit application materials to the administrative department of publication of the local municipal people's government. The publishing administrative department of the Municipal People's Government shall complete the examination and approval within 10 working days from the date of accepting the application materials, and then report to the publishing administrative department of the people's government of the province, autonomous region or municipality directly under the Central Government for examination and approval. The applicant may also directly report to the publishing administrative department of the people's government of a province, autonomous region or municipality directly under the Central Government for examination and approval.
The publishing administrative department of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall make a decision on approval or disapproval within 20 working days from the date of accepting the application. If it is approved, the publishing administrative department of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall issue a publishing business license and report it to the State Administration of Press, Publication, Radio, Film and Television for the record. If it is not approved, it shall explain the reasons in writing to the applicant.
The application materials include the following written materials:
(1) original and duplicate copies of the business license;
(2) An application, stating the basic information of the unit and the application matters;
(3) Articles of association of the enterprise;
(4) The amount, source and nature of the registered capital;
(5) Information on the business premises and proof of the right to use;
(six) the identity certificate of the legal representative and the main person in charge;
(seven) certification materials of enterprise information management system. Article 9 Units and individuals engaged in the retail business of publications shall meet the following conditions:
(a) has completed the industrial and commercial registration;
(2) The business scope of industrial and commercial registration includes the retail business of publications;
(3) Having a fixed business place. Article 10 Units and individuals applying for engaging in the retail business of publications shall report to the publication administration department of the local people's government at the county level for examination and approval.
The publishing administrative department of the people's government at the county level shall make a decision of approval or disapproval within 20 working days from the date of accepting the application. Upon approval, the publishing administrative department of the people's government at the county level shall issue the Publishing Business License and report it to the publishing administrative department at the next higher level for the record; If the business area of the store is more than 5000 square meters, it shall be reported to the publishing administrative department of the provincial people's government for the record. If it is not approved, it shall explain the reasons in writing to the applicant units and individuals.
The application materials include the following written materials:

(2) An application, stating the basic information of the unit or individual and the application matters;
(3) Proof of the right to use the business premises.
