The publication business activities mentioned in these Regulations include the publication, printing and distribution of books, newspapers and periodicals.
These Regulations shall apply to the entrustment and printing activities of internal information books, newspapers and periodicals. Article 3 The publishing and business activities of books, newspapers and periodicals must abide by the Constitution, laws and regulations, and may not harm the interests of the state and the people.
It is forbidden to publish and operate illegal books, newspapers and periodicals that contain contents explicitly prohibited by the state. Article 4 People's governments at all levels shall support the publication of books, newspapers and periodicals, and encourage state organs, social organizations, enterprises and institutions to set up special funds or support and guarantee the publication of academic and scientific works and teaching materials in other ways.
People's governments at all levels should take measures to prosper the book and newspaper market and ensure that legitimate publishing activities are not illegally interfered by any organization or individual.
The people's governments at all levels shall commend and reward the units and individuals that have made outstanding contributions to the implementation of these Regulations, or that have exposed and assisted in the investigation and punishment of illegal publishing business activities. Article 5 The municipal publishing administrative department shall be responsible for the management and supervision of the publishing business activities of books, newspapers and periodicals in the whole city.
The district and county publishing administrative departments shall be responsible for the management and supervision of the printing and distribution activities of books, newspapers and periodicals within their respective administrative areas.
Public security, industry and commerce, customs, taxation and other administrative departments shall be responsible for relevant management according to their respective responsibilities. Chapter II Administration of Publishing Article 6 To establish a publishing entity of books, newspapers and periodicals, the organizer shall submit a written application to the municipal publishing administrative department. The municipal publishing administrative department shall, within twenty days from the date of accepting the application, submit it to the publishing administrative department of the State Council for examination and approval.
The municipal publishing administrative department shall notify the organizer within ten days from the date of receiving the approval decision of the the State Council publishing administrative department.
The organizer shall, within 60 days from the date of receiving the notice of approval, register with the municipal administrative department of publishing, obtain a publishing license, and apply for a business license from the local administrative department for industry and commerce with the publishing license.
The conditions and requirements for the establishment of publishing units of books, newspapers and periodicals shall be implemented in accordance with the Regulations on the Administration of Publishing. Article 7 A publishing entity of books, newspapers and periodicals shall meet the requirements of a legal person, be approved and registered, obtain the status of a legal person, and independently bear civil liability with all its legal person property.
If a legal person publishes newspapers and periodicals without establishing a newspaper or periodical agency, the newspaper editorial department and periodical editorial department established by it shall be regarded as publishing units, and the civil liability of the editorial department shall be borne by the legal person who established the editorial department. Article 8 If a book publishing unit fails to carry out publishing activities or stops publishing activities for 1 year after registration for 180 days, the municipal publishing administrative department shall cancel its license and report it to the the State Council publishing administrative department for the record.
If the newspaper publishing unit fails to publish the newspaper within 90 days after registration or stops publishing on 180, the registration shall be cancelled by the municipal publishing administrative department and reported to the the State Council publishing administrative department for the record. Article 9 If a publishing entity changes its name, sponsor and business scope, merges or splits, or publishes a new newspaper or periodical, or changes its name and date of issue, it shall go through the examination and approval formalities again in accordance with the provisions of Article 6 of these Regulations. Article 10 It is forbidden to forge, alter, buy, sell or transfer the name, book number, serial number and quasi-confirmation number of a publishing entity. Article 11 No unit or individual other than a publishing unit may publish books, newspapers and periodicals that are publicly distributed in the society. Twelfth books and periodicals publishing units shall abide by the provisions of the Regulations on the Administration of Publishing on the filing of major topics, and shall not be published without filing before publication. Article 13 The publication of periodical supplements shall meet the following conditions:
(a) the official periodicals have been published normally for more than one year in a row, and the sample periodicals have been submitted in time as required;
(two) the official journal has not been subject to administrative punishment by the state and municipal publishing administrative departments within two years;
(three) the purpose, editorial policy, format and distribution scope of the supplement are consistent with the main issue.
To publish a periodical supplement, the organizer shall submit a written application to the municipal publishing administrative department, which shall make a decision of approval or disapproval within 20 days from the date of accepting the application. If approved, a supplementary license shall be issued; If it is not approved, it shall explain the reasons. Fourteenth books, newspapers and periodicals should indicate the version records. Periodicals shall not replace the year number with the total serial number on the cover, and shall not replace or cover the title with the main item.
The book number and serial number used by the publishing unit shall not be replaced with each other. Fifteenth books, newspapers and periodicals for minors shall not contain contents that induce minors to imitate behaviors that violate social morality and commit crimes, and shall not contain contents that hinder minors' physical and mental health, such as terror and cruelty. Article 16 The selection or compilation of textbooks for primary and secondary schools in this Municipality shall be examined and approved by the administrative department of education in accordance with the provisions of the state, and the publishing, printing and distribution units shall be determined by the municipal publishing administrative department, the administrative department of education in conjunction with the competent price department through bidding or other open and fair means; No other unit or individual may engage in the publication, printing and distribution of textbooks for primary and secondary schools.
