(1) Publishing, printing, distribution, sale and lease of books, newspapers and periodicals;
(two) the publication, production, reproduction, distribution, sale, rental and projection of audio-visual products;
(3) Film screening and cultural and entertainment business activities;
(4) Commercial theatrical performances, fashion and bodybuilding performances;
(5) Cultural relics, paintings, calligraphy and works of art approved for sale by the state;
(six) business culture and art training;
(seven) other cultural market business activities. Article 4 The management of the cultural market must adhere to the principle of "letting a hundred flowers blossom and a hundred schools of thought contend" and put social benefits first. Fifth cultural market management should actively promote the prosperity and development of socialist cultural undertakings, encourage all healthy and beneficial cultural and artistic products and cultural and recreational activities, and protect the legitimate rights and interests of operators and citizens according to law.
Units and individuals engaged in business activities in the cultural market must establish and improve the responsibility system for public security and other management systems in accordance with regulations to ensure the safe and healthy development of cultural activities. Article 6 The propaganda of obscenity, terror, murder, feudal superstition, reactionary content and other publications explicitly prohibited by the state must be investigated and punished. Chapter II Management Institutions Article 7 The management of the cultural market shall be under the unified leadership and comprehensive management of the people's governments at all levels. The relevant departments are responsible for the division of labor, graded responsibility and mutual cooperation. Article 8 The administrative department of press and publication is the competent department in charge of the management of books and newspapers, the administrative department of radio and television is the competent department in charge of the management of audio-visual products, and the administrative department of culture is the competent department in charge of the management of cultural and recreational activities. Where there is no separate administrative department of press and publication, the administrative department of culture shall be responsible for the management of books and newspapers.
Social and cultural management committees at all levels are responsible for organizing and coordinating the management of cultural markets. Article 9 Departments of industry and commerce, taxation, prices, public security, customs, transportation, railways, civil aviation, posts and telecommunications, etc. Should be in accordance with the relevant laws, administrative regulations and the provisions of this Ordinance, with the cultural market management department to do a good job in cultural market management. Tenth all units and individuals engaged in business activities in the cultural market, must obtain a license from the competent department of cultural market, and to the local administrative department for Industry and commerce for business license, before business. If it belongs to a special industry, it must also obtain a "Special Industry License" from the public security department. Chapter III Management of Books, Newspapers and Publications Article 11 Without approval, no unit or individual may engage in the printing, distribution and sale of books, newspapers and periodicals.
To apply for the business of selling books, newspapers and periodicals, there should be a definite business scope and corresponding funds, equipment, places, fixed personnel and financial management systems. Twelfth books, newspapers and periodicals entering the cultural market must be publications of publishing units approved by the state. Non-publishing units and individuals are not allowed to publish and sell books, newspapers and periodicals. Article 13 Publications of publishing units approved by the state must be printed in printing units of books, newspapers and periodicals approved by the state in accordance with regulations. Printed books, newspapers and periodicals must be certified by the competent department of press and publication. It is not allowed to increase the number of prints without authorization, and it is not allowed to transfer or sell printed plates and paper types to other units or individuals. Printing units that print books, newspapers and periodicals without approval shall not print books, newspapers and periodicals. Fourteenth other state-owned and collective bookstores except Xinhua Bookstore must meet the following conditions when purchasing books, newspapers and periodicals from publishing houses, periodical agencies and Xinhua Bookstore for secondary wholesale:
(a) there is a clear department in charge;
(2) It has funds suitable for its business scale;
(3) Having distribution professionals suitable for carrying out wholesale business;
(4) Having a fixed business place and necessary equipment;
(5) Having a sound financial management system.
Individual and private bookstores and book stands shall not engage in the wholesale business of books, newspapers and periodicals. Fifteenth units that apply for the second-level wholesale business of books, newspapers and periodicals shall be audited by the local press and publication or cultural administrative department and reported to the provincial press and publication administrative department for approval. Cross-regional branches of books, newspapers and periodicals or agency stations are set up, and the examination and approval procedures are the same as those for newly opened bookstores. Sixteenth books, newspapers and periodicals distribution units and individuals shall abide by the following provisions:
(a) shall not engage in publications and other illegal publications prohibited by the state, and shall not engage in cooperative publishing, rental publishing, agency publishing, printing and distribution, and making covers and illustrations on behalf of others;
(2) Except for foreign language bookstores and Xinhua Bookstore, it is not allowed to engage in imported books and periodicals or books and periodicals whose distribution scope is limited by the state;
(3) Except Xinhua Bookstore, no other unit or individual may engage in the general wholesale and distribution of books to the publishing house; Books exclusively sold by Xinhua Bookstore shall not be wholesale in any form.
